According to the Henderson County Assessor's Office, the site is identified as PIN 9631640262. Description of projects area and activity: The proposed project consists of the construction of a commercial development and the associated attendant features. In order to achieve the proposed project purpose, approximately 386 linear feet (0.022-acre) of an intermittent channel would be culverted. Applicable Law: ® Section 404 (Clean Water Act, 33 USC 1344) ❑ Section 10 (Rivers and Harbors Act, 33 USC 403) Authorization: Regional General Permit Number or Nationwide Permit Number: Nationwide Permit 39- SEE ATTACHED RGP or NWP GENERAL, REGIONAL AND SPECIAL CONDITIONS Special Conditions: To offset the impacts to 386 linear feet of channel, 193 units of cold -water preservation credits shall be purchased from the Tarkilin Branch Mitigation Site. Documentation of this credit purchase shall be provided to this office prior to January 31, 2023. Notes: Per a letter from the North Carolina Wildlife Resources Commission (NC WRC) dated November 16, 2022, the following recommendations were provided to further reduce effect to wildlife resources: 1. Due the importance of the Mills River, which supports state and federally listed species, it is extremely important to use excellent erosion and sediment control on site. NC WRC requests that the applicant use sediment and erosion control practices outlined in the Design Standards in Sensitive Watersheds (15A NCAC 4B .0124). NC WRC asks that disturbed areas be stabilized on a tight timeframe to minimize risk of sediment loss, namely, the disturbed areas be seeded, mulched and/or matted as soon as possible, preferably at the end of each work day. At a minimum, disturbed areas should be stabilized within five working days or seven calendar days, whichever is shorter. 2. Any erosion control matting used should be free of nylon or plastic mesh, as this type of mesh netting frequently entangles wildlife and is slow to degrade, resulting in a hazard that may last for years. 3. Maintain open space areas with native vegetation and maintain the undeveloped areas as a forested green space. Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached conditions, above noted special conditions, and your submitted application and attached information dated October 19, 2022 and subsequent information provided on December 9, 2022. Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action. This verification will remain valid until the expiration date identified below unless the nationwide/regional authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide/regional permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified nationwide/regional permit. If the nationwide/regional permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide/regional permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide/regional permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide/regional permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case -by -case basis to modify, suspend or revoke the authorization. Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You should contact the NC Division of Water Resources (telephone 919-807-6300) to determine Section 401 requirements. For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA), prior to beginning work you must contact the N.C. Division of Coastal Management. This Department of the Army verification does not relieve the permittee of the responsibility to obtain any other required Federal, State or local approvals/permits. Once the Sponsor has signed this form, it is the Permittee's responsibility to ensure that Wilmington District Project Manager identified on page two is in receipt of a signed copy of this form before conducting authorized impacts, unless otherwise specified below. If more than one Mitigation Sponsor will be used to provide the mitigation associated with the permit, or if the impacts and/or the mitigation will occur in more than one 8-digit Hydrologic Unit Code (HUC), multiple forms will be attached to the permit, and the separate forms for each Sponsor and/or HUC must be provided to the appropriate Mitigation Sponsors. When NCDMS provides mitigation for authorized impacts conducted by the North Carolina Department of Transportation (NCDOT), construction within jurisdictional areas may proceed upon permit issuance; however, a copy of this form signed by NCDMS must be provided to the District within 30 days of permit issuance.
