Sullins, Director Division of Water Quality July 9, 2007 Honorable Joe Collins, Mayor Town of Franklin 188 West Main Street Franklin, NC 28734 Dear Mr. Collins: RE: Proposed Dillsboro dam removal project Jasckon County DWQ # 2003-0179 version 3.0 I am in receipt of your letter dated February 6, 2007 sent to Cyndi Karoly concerning the possible removal of the Dillsboro dam in Dillsboro, NC. I did not respond earlier to your request since we did not have a complete application from Duke Power to remove the dam. As of June 27, 2007, the Division now has a complete application from Duke Power requesting issuance of a 401 Water Quality Certification to remove the Dillsboro dam. Public notice for this project will soon be published in the Cherokee Scout, The Highlander, The Western Carolinian and The Smoky Mountain Times requesting comments from the public by August 15, 2007. You were copied on all four public notices but if you do not receive these copies soon, please call me at 919-733-9646 and leave a fax number or email address and I can make certain that you receive copies. In your February letter (as well as previous letters), you mention that you will request a public hearing for the project. That request is most appropriately done within the comment period for the project now that we have a complete application. If you still want to make that request, please do so in writing to me by August 15, 2007 and I will forward that request to our Director for her decision. Your earlier letter requested a large amount of information from the Division and Department regarding 401 Certifications and supporting documentation for similar projects in the mountains of North Carolina. Most of the information you have requested is available in our offices in Raleigh but may not be available in our Asheville office. We have begun to scan in all information received as of January 1, 2007 so we have the Dillsboro dam removal application that is the subject of the public notice available electronically. However the other information that you requested has been packaged to send to Richmond, VA to be scanned and will not be available for about two months. Please advise if you would like me to send an electronic version of the Dillsboro application to you (probably via CD since it is a rather large file) and how you would like to me to handle your earlier request.
