Overview
•The Division of Waste Management is seeking approval to proceed to the EMC
in March 2023 for adoption of a technical correction to a citation in 15A NCAC
02L .0509(b) “Notification Requirements” for Risk-Based Assessment and
Corrective Action for Petroleum Releases from Aboveground Storage Tanks and
Sources.
•This technical correction to a citation falls under G.S. 150B-21.5(a)(3)as a
circumstance where the agency is not required to publish a notice in the NC
Register, hold a hearing, or submit the amended rule to the Rules Review
Commission.

•Proposed Amendment to 15A NCAC 02L .0509(b):
•Correct the citation from .0507(e) to .0507(f)
•Rule .0507 was re-lettered during the readoption process in 2019, and the
citation in Rule .0509 needs to be corrected to reflect that change to the
lettering.
•This correction is being made to ensure the rule is correct prior to submittal of
the renewal application to the US EPA for UST state program approval.
•The proposed amendment is included in Attachment A.

•April 1, 2023 -Tentative/Expected Effective Date
