In accordance with 15A NCAC 2H Section .0503 (e) (PUBLIC NOTICE), please add my
name to the Water Quality Certification Mailing List for the following hydroelectric
projects:

I am also requesting the following materials:
Copies of all prior notices issued for the above-captioned projects and for Project
No. 2602-007 Dillsboro Dam License Surrender.
2. Copies of all determinations involving existing uses of the waters impounded by
the dams associated with the above-captioned projects.
3. Copies of any determinations made pursuant to the guidelines set forth in 1 SA
NCAC 02H Sec. 506 REVIEW OF APPLICATIONS that the proposed activity
has the potential to remove or degrade those significant existing uses which are
present in the wetland or surface water impounded by the projects' dams.
4, Copies of any determinations, reports, studies or data involvingl SA NCAC
02K Sec. 0502 REQUIRED MINIMUM FLOW FOR DAMS (NOT SMALL
HYDRO PROJECTS) or 15A NCAC 02K .Sec. 503 REQUIRED MINIMUM
FLOW FOR SMALL HYDROELECTRIC PROJECTS
5. With regard to the issue of Appalachian Elktoe mussels, please provide any
reports, plans or assessments in your department's possession concerning
Appalachian Elktoe current and future populations and habitat in the vicinity of
the Dillsboro Dam and down stream thereof to the next impoundment. In this
regard, I note that the Wildlife Resources Commission issued a press release in
November of 2006 expressing a concern over the declining Appalachian Elktoe
populations.
6. Copies ofsite-specific management strategies under the provisions of I SA NCAC
2B .0225 or 15A NCAC 2B .0227for above projects as well as any
determinations that would affect the Maximum Daily Loading Target Limits for
the same waters.
Upon receipt of the requested material, and reasonable period for review thereof, I
and others will be seeking the convening of a public hearing to take public
comments for the issuance of certificates for the relicensing projects and to
consider revocation of the Dillsboro water quality certificate for dam and
powerhouse removal and the need for additional minimum flow studies for the
East and West Fork Projects.
