Work in waters of the United States (U.S.) will occur within the Elisha Creek, Dutchman Creek, Buffalo Creek, Carter Creek, and Yadkin River watersheds (8-di0t HUC: 03040101). Description of projects area and activity: The applicant, Duke Energy Carolinas, has requested a Department of the Army (DA authorization to discharge fill material into waters of the U.S. in coniunction with the approximate 11-mile Silas 100kV Line Rebuild Proiect. Proiect activity will involve rebuilding the existing Duke Energy Silas 100kV transmission line from Mocksville substation to Idols Tap, along with the construction of permanent maintenance/access roads. The proposed project will occur within the existing Duke Energy mowed and maintained right-of-way. The installation of new poles, aerial transmission lines, and the use of timber matts will not require a DA permit. Construction of the road crossings will permanently impact 120 linear feet (0.007 acre) of stream channel at five (5) sinnle and complete proiect locations. All other impacts associated with the proposed proiect will be conducted in uplands, outside of waters of the U.S. Upon proiect completion, all temnorari1v disturbed waters will be restored to their pre -disturbance conditions. Compensatory mitigation is NOT required in conjunction with the activities The applicant has also agreed to the following Section 7 (ESA) Schweinitz's sunflower Conservation Measures: 1. Duke will conduct a snecies survev within the areas where work may occur during the growing season. The surve will be conducted ahead of the construction work and results would be reported to the Corps and Bryan Tompkins (USFWS) 30 days before construction activities being. 2. No grading/trenching/soil disturbance will occur in the upland areas immediately adiacent to the stream crossings. Vegetation will not be disturbed. 3. Plans will be established to onlv mow ROWs in the nroiect area during winter months and "NO MOW" signaae will be installed to prevent mowing during the growing season. Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action. This verification will remain valid until the expiration date identified below unless the nationwide and/or regional general permit authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide and/or regional general permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified nationwide permit. If the nationwide and/or regional general permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide and/or regional general permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide and/or regional general permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case -by -case basis to modify, suspend or revoke the authorization. Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA), prior to beginning work you must contact the N.C.
