The impacts will occur within two (2) different areas of the protected riparian buffers associated with an unnamed intermittent tributary of Dry Creek, within the Laurel Ridge Development, as described within your application submitted July 27, 2022, and on the Buffer Impact Maps, completed by CE Group. Review and approval of the buffer restoration was required under 15A NCAC 02B .0267(9) — Table of Uses. Per your application this review, and authorization is only valid for those impacts stated above. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you proceed with your project including (but not limited to) Erosion and Sediment Control and Non -discharge regulations. This authorization certification is for the purpose and design that you described in your application. If you change your project, you must notify us, and you may be required to send us a new application. Temporary Impacts Such impacts are typically associated with construction corridors, temporary access roads, and the installation and operation of temporary sediment and erosion control measures and devices. Approved temporary impacts must remain temporary in nature, minimize impacts to the riparian buffer, meet or exceed required Best Management Practices (BMP), perform, and be maintained so that no violations of county riparian buffer or state water quality standards, statutes, or rules occur, and must be returned to the uses that were existing at the time of authorization. No temporary impacts are proposed or approved for this project. 3. No Waste, Spoil, Solids, or Fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in riparian areas beyond the footprint of the impacts depicted in the Pre -Construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of county riparian buffer or state water quality standards, statutes, or rules occur. 4. Diffuse Flow An additional condition is that all stormwater shall be directed as diffuse flow at non -erosive velocities through the protected stream buffers and will not re -concentrate before discharging into the stream as identified within Section 304(J)2 of the Watershed Protection Ordinance. 5. Protective Fencing The outside buffer boundary and along the construction corridor within these boundaries approved under this authorization shall be clearly marked with orange warning fencing (or similar high visibility material) for the areas that have been approved to infringe within the buffer, stream channel or water prior to any land disturbing activities to ensure compliance with the Watershed Protection Ordinance. 6. Certificate of Completion All activities as proposed, and any subsequent modifications, approved within this authorization must be completed within one year of the issuance of the authorization. The applicant is required to certify that the completed project is in accordance with this authorization and shall submit actual `as -built' plans. If proof of completion is not presented within this timeframe, then the person shall be in violation of both the State's and Chatham County's riparian buffer protection program. Any disputes over determinations regarding this Authorization of Approvable Impacts (associated with the approved buffer impacts) shall be referred in writing to the Director of the Division of Water Resources, c/o the 401 & Buffer Permitting Unit. The Director's decision is subject to review as provided in G.S. 150B Articles 3 and 4. Explain the purpose of the proposed prqject a. Why does this project need to impact a protected riparian buffer? This comment was satisfactorily met through the submittal on September 2. 2. Buffer Impact Summary i. Please see attached for comments on the buffer impact summary This comment was not adequately addressed. Please see attached excel file for an example. 3. Specifically describe measures taken to avoid or minimise the proposed impacts through construction techniques. a. What will be done during construction to minimize impacts to riparian buffers? Construction measures may include pre -construction conferences with contractors to ensure expectations and concerns are understood, establishing a clear protocol for addressing problems quickly, locating equipment maintenance and washing facilities away from riparian buffers, hand -clearing of vegetation instead of more disruptive equipment clearing in sensitive areas, clearly marking protected areas with protective fencing or other means prior to construction, etc. i. Please revise and respond to answer the requirements above. This comment was satisfactorily met through the submittal on September 2. Buffer Impact Map 4. Buffer Impact Table a. Update all "Impact Tables" on the plan. b. Please break the tables on each sheet to look like the Impacts Summary. This comment was not adequately addressed. Provide facewidth of impact at its widest point as a dimension line and in the table This comment was satisfactorily met through the submittal on September 2. b. Provide maintenance corridor widths for non -electric underground utilities (include fiber, telephone and all other utilities) Page 1 of 3 Response Provided: Per the project engineer, essentially this entire driveway (28' from headwall to headwall) is a maintenance corridor. We have shown the utilities in the 4' grass strip between the gravel drive and headwalls. See Response in item C below. c. Provide linear width impacts for all underground electric utilities Response Provided: Per the project engineer, the utilities will not be an additional impact. Utilities are not described beneath the Driveway Crossing section in the Table of Uses. They are broken out into their own individual impacts within the Table of Uses and shall be submitted for review in the same manner. Utilities have their own individual maintenance corridors that must be shown on the plan to determine if those impacts would meet the definitions of exempt, allowable, or allowable with mitigation. While they are included in the total impact for the stream crossing their individual impacts must be broken out to meet the requirements of the Table of Uses. Not showing fiber, telephone, cable, or electric service routes will result in the home builder being required to permit these impacts prior to construction. 6. Sheet 4 a. Include all utilities (telephone, electric, fiber) See comments above 7. Sheet 5 a. Provide facewidth of impact at its widest point as a dimension line and in the table b. Please provide this information The detail culvert installation sequence has not been provided. A minimum 4 step detail should be provided. • Step 1 Includes (at a minimum) o Clearing and grading of initial side of riparian buffer to the stream. o Installation of erosion control measures and in stream measures (coffer dams, pump around) • Step 2 Includes (at a minimum) o Excavation pit for culvert installation at appropriate width and side slope elevation to adequately install and backfill the culvert o Dewatering pump detail should be shown. o Cross sectional views showing the excavation depth and width • Step 3 Includes (at a minimum) o All backfill activities of the culvert o Cross section views showing the backfill and pipe bedding material used and depth of bedding o Installation of all utilities (cross section showing bury depths and coverage details) • Step 4 Includes (at minimum) o Final Conditions o Removal of all erosion control measures o Final stabilization details Soil Erosion & Sedimentation Control Plan Comments 9. Please provide full construction drawing for erosion control Page 2 of 3 The erosion control plans provided show no detailed grading or site improvement information depicting what will occur within the riparian buffer. Please provide a full erosion control plan that shows proposed grading and all land disturbing activity associated with the project. 10. Please provide a cut/fill plan for the site with specific references to the source of fill material for the riparian buffer impacts Response Provided: Per the project engineer, the following has been added to sheets 3 & 5: "The purpose of this plan is to install permanent stream crossing; no mass site grading is proposed. All fill material will come from off -site permitted source consisting of process fill or other approved material." Cut/Fill plans are a requirement under section 164.10(F)(d) of the Chatham County Soil Erosion and Sedimentation Control Ordinance. The erosion control plan provided shows no grading to install the culvert however the plans in your response show the pipe buried 1' in the stream bed. How will this be achieved without depicting grading on the plan? This completes the review of the Riparian Buffer Authorization Application.
