Dear Mr. Pearce:
It has come to our attention that Durham County has withdrawn from the Upper Cape Fear River Basin Association
(UCFRBA), and is now responsible for instream sample collection as stated in sheet A(2) of the subject permit. Per your
request, we have clarified the locations of the Upstream and Downstream stations and have attached a revised sheet A(2).
The Upstream Station is located at Northeast Creek and Sedwick Drive (Lat 35.88665, Long -78.89970), and the
Downstream Station is located at Northeast Creek and Grandale Drive (Lat 35.87243, Long -78.91319). If you have any

Footnotes:
1. See Condition A. (2.), for Instream Monitoring Requirements.
2. The monthly average effluent BOD5 and TSS concentrations shall not exceed 15% of the respective influent value (85%
removal).
3. The daily effluent dissolved oxygen concentration shall not be less than 6.0 mg/L.
4. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units.
5. Limit and/or monitoring applies only when chlorine is added to treatment system. The Division shall consider all effluent
TRC values reported below 50 pg/L to be in compliance with the permit. However, the Permittee shall continue to record
and submit all values reported by a North Carolina certified laboratory (including field certified), even if these values fall
below 50 pg/L.
6. Refer to Special Condition A.(8.), Calculation of Total Nitrogen or Total Phosphorus Loads.
7. Compliance with mass limits shall be determined in accordance with Special Condition A.(7.), Annual Limits for Total
Nitrogen or Total Phosphorus.
8. Mercury samples shall be analyzed using EPA Method 1631E.
9. Sampling should be conducted 3 times during the 5 year permit term. See Special Condition A. (4.), Effluent Pollutant
Scan.
10. Chronic Toxicity (Ceriodaphnia) at 90%; February, May, August, and November; refer to Special Condition A.(3.).
There shall be no discharge of floating solids or visible foam in other than trace amounts.

These are the logical locations. Both are good sites. The upstream site is an UCFRBA station and the downstream site is

Re: Permit NC0026051 Clarification
Dear Mr. Belnick:
Durham County holds an NPDES permit (NC0026051) that requires stream monitoring. The monitoring locations
specified in the permit are upstream at NCSR 1102 and downstream at NCSR 1100. To determine the actual road
names staff used the Department of Transportation's Secondary Roads Database Lookup. The road names provided
are no longer the actual names. Durham County staff has researched the locations and believe we have found the
accurate locations for stream monitoring but request clarification/approval of these locations. Included is a map and
pictures for your review.
• Upstream monitoring location is located on Sedwick Drive. (Latitude 35.886616, Longitude 78.89689)
• Downstream monitoring location is located on Grandale Drive. (Latitude 35.872325, Longitude 78.91325)
Please review the information provided and confirm whether or not these are acceptable stream monitoring
locations to fulfill our NPDES permit requirement.

Upstream (2006 and 2011 permits) — SR 1102
Though SR 1102 in Durham County appears to be the location of UCFRBA station(8330000.Qri the Terrain Navigator map, it is
Foxcroft Lane according to the SR database. Foxcroft Ln was verified as a residential cul-de-sac with no access to Northeast Creek.

SR 1100 in Durham County, is Grandale Rd. This is the location of AMS station B3660000)

Because no county information was provided in th'e permit for this station, an exact location could not be identified, though neither
of the possible locations appear to be on Northeast Creek. In Durham County, SR 1732 is Innesbrook Way. It is located northwest of
Falls Lake and has no access to Northeast Creek. In Chatham County, SR 1732 is Oakley Road. This road appears to be located on an
UT to Nancy Branch, A tributayyr-of Panther Creek.

Monitoring Update
12 months of hardness monitoring was completed in 2011. Samples are no longer being collected for this
parameter.
Cy Stober (PTRC) noted that a comment recorded with the August 2011 data at station B1350000 described the
creek as a "puddle". Field measurements were still collected at this station. Mr. Stober informed the lab not to
sample disconnected pools of water, such as puddles. They will begin using the "dry stream" comment to
address these situations in the future.
Membership
Stephanie Brixey (Durham County) explained to members, their request to discontinue membership. Ms.
Brixey stated that Durham County was issued a new permit in October 2011, with "significantly less in -stream
monitoring than in their previous permit". She noted their new requirements, field parameters and fecal
coliform sampled weekly upstream and downstream, and said that the state was "very generous" during this
permit cycle. The in -stream parameters that were left in their 2011 permit are now going to be analyzed in-
house under their laboratory's current certification.
Ms. Brixey said that many meetings were held, in which the terms of their new permit were negotiated, and the
outcome of most were favorable for Durham County. Additionally, she noted that their permit writer conducted
a site visit prior to issuing the permit. Durham County was pleased by this. Other members chimed in, who
were also visited by their permit writers prior to issuance of their draft permits. Everyone appreciated the
chance to show their facilities to the regulators.
Other UCFRBA members, specifically Greensboro, were shocked to see nutrients removed from their in -stream
stations. And others joked that they may have to attempt to convince the State that they don't need to sample
nutrients either, regardless of the problems in Jordan Lake. On the flip side however, both Greensboro and
Fayetteville (MCFRBA) voiced their concerns about the precedent that may be set by Durham County's
permitting victory and how it may lead to other large facilities withdrawing their membership from the coalition.
Unfortunately, this would lead to the downfall of the program, which is not what most members want to see. If
the large members, those who pay the most in dues, withdraw from the coalition, the smaller facilities will not
be financially able to keep the monitoring network up and running, which will cause the group to collapse.
iddle Cape Fear Nutrient Concerns
Chad Ham (MCFRBA) gave a presentation on the nutrient and algae issues in the Cape Fear River, beginning
above Buckhom Dam. Mr. Ham specifically noted the elevated chlorophyll a above Buckhom and Lock &
Dam 3. He also mentioned the study performed in conjunction with UNC that indicated the productivity in
the river is controlled by light and retention time. This study found that neither nitrogen, nor phosphorus were
limiting.
Mr. Ham briefly mentioned Western Wake Partners and their role in the MCFRBA. He said that the group is
ready to meet with DWQ, likely in April.
Nutrient Trading
Members are interested in potentially getting a nutrient trading program up and running. Carrie Ruhlman and
Jay Sauber (DWQ) mentioned the Neuse River Compliance Association and suggested that they speak with
Haywood Phthisic or Rich Gannon about the logistics of the group instead of re -inventing the wheel.

Durham County was recently issued a new NPDES permit (NC0026051) with reduced stream monitoring
requirements. The cost of completing this sampling with our personnel is significantly less than the cost
of our membership in the Upper Cape Fear River Basin Association (UCFRBA), and therefore, we are
terminating our membership as of June 30, 2012. Completing sampling with our staff will also improve
our response time to potential stream issues.
The Memorandum of Agreement (MOA), Page 3, Paragraph 2 states, "Any UCFRBA permittee may
terminate and cancel its participation in this MOA by providing 90 days written notice to the UCFRBA,
the DWQ Coalition Coordinator, the appropriate DWQ Regional Office, and the DWQ Point Source
Compliance/Enforcement Unit."
