This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated December 6, 1983. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 15UB of the North Carolina General Statutes, and filed with the Office of Administrative Hearings. Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding. Please take notice this permit is not transferable. Part II, E.4. addresses the requirements to be followed in case of change in ownership or control of this discharge. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area Management Act or any other Federal or Local governmental permit that may be required. Quantitation shall be required for all compounds named in the EPA Method 624 (if detected) G and other significant levels of organic chemicals shall be identified and approximately - quantified. For the purpose of implementing this requirement, the 10 largest GC/MS peaks not identified as one of the target compounds (or fewer than 10, if less than 10 identified peaks occur) should be identified and approximatile quantified. Note: Ag and Cd have been dropped from permit as per recommendation from RRO. These parameters will continue to be monitored through LTMP. Since the last permit rewnewal/WLA the classification of the receiving stream has changed from C-NSW to WS-IV NSW (as of 8/3/92) which change applicable standards and limits for toxicants. Toxicant analysis indicated that the limit for Cr can be dropped from the permit, but this parameter will continue to be monitored through LTMP. All other toxicant limits should remain in permit. Evaluation of APAM data and additional organic toxicant sampling data, provided voluntarily by the facility, indicated that several carcinogens have been recently detected in the effluent at levels exceeding allowable loads according to EPA criteria for these parameters. Limits are recommended for all such parameters (see TOXICS/METALS LIMITS and attached table). Quarterly monitoring of organic toxicants using EPA Method 624 is also recommended (see Special Instructions or Conditions section). The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic Bioassay Procedure - Revised *September 1989) or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is % (defined as treatment two in the North Carolina procedure document). The permit holder shall perform Quarterly monitoring using this procedure to establish compliance with the permit condition. Data collected: time -of -travel dye study, flow measurements, and chlorides. New Hope Creek - Durham Co. Durham Farrington WWTP August 1988 - A water quality study was done on New Hope Creek from the effluent channel of the Farrington WWTP to the New Hope arm of Jordan Lake. Data collected: field parameters, nutrients, solids, chlorophyll, BODIt, and flow measurements. New Hope Creek - Durham Co. Durham Farrington WWTP October 1988 - A time -of -travel dye study was done on a 2 mile reach of New Hope Creek from the end of the effluent channel to above the impoundment near SR 1107. Data collected: time -of travel dye study, and flow measurements. New Hope Creek - Durham Co. Durham Farrington WWTP December 1988 - Two time -of -travel dye studies were done on New Hope Creek, both dye studies were from SR 1107 to the mouth of the creek at Jordan Lake, a distance of 3.8 miles. Data collected: time -of -travel dye study. LAKES ASSESSMENT PROGRAM B. Everett Jordan Reservoir B. Everett Jordan Reservoir (Jordan Lake) was created by the United States Army Corps of Engineers for various purposes including flood control, fish and wildlife habitat, recreation, and water supply. The dam was completed in 1974, however initial filling of the lake did not occur until late 1981 as a result of legal and construction problems. Jordan Lake is used extensively for boating, swimming, fishing and other types of recreation. Several municipalities have approval to use water from the lake and are in the process of constructing water treatment facilities. Major inflows into Jordan Lake are the Haw River and New Hope and Morgan Creeks. The Haw River accounts for 70-90% of the annual flow of Jordan Lake with an average hydraulic retention time of five days. The New Hope arm of the lake has an average hydraulic retention time of 418 days. Maximum depth of Jordan Lake is approximately 66 feet (20 meters) with a mean depth of 16 feet (five meters) and a total volume of 265 x 106 m3. The surface area is approximately 14,300 acres (5,787 hectares). Jordan Lake is about five miles (eight kilometers) in length on the Haw River arm and 17 miles (27 kilometers) long on the New Hope Creek arm with a 150 mile (241 kilometer) shoreline. The watershed of Jordan Lake is approximately 1,700 mi2 (4,403 km2). Land uses in the watershed include forest, agriculture, and urban centers with much of the area undergoing development for industrial and residential purposes. Many point and nonpoint sources discharge into the tributaries of the lake. Monitoring and research on Jordan Lake has been performed extensively by state and university researchers since the lake was filled. Monitoring of the lake by DEM began in 1983. Elevated nutrient and chlorophyll a levels have frequently been found in the lake along with periodic blooms of blue-green algae. Jordan Lake has been found to be one of the most eutrophic lakes in North Carolina. Jordan Lake was most recently sampled on September 7, 1993. Mean dissolved oxygen ranged from 7.8 mg/1 at the surface to 4.0 mg/1 at the bottom. However, an elevated dissolved oxygen reading of 10.2 mg/I was recorded at the sampling site on the Morgan Creek arm of the lake. Mean water temperature ranged from 28.0°C at the surface to 25.9°C at the bottom. Mean surface pH was 7.9 s.u. and mean surface conductivity was 159 µmhos/cm, with the two highest readings (180 µmhos/cm and 271 µmhos/cm) observed on the Haw River arm of the lake. The second of these two measurements was the highest lake conductivity observed in the Cape Fear River basin. Nutrient levels were elevated with highest levels generally found in the upstream areas of the lake on the Morgan and New Hope Creek arms. Violations of the state chlorophyll a standard were found at CPF086C (48 µg/1) in the Morgan Creek arm, and at CPF081A1C (55 µg/1) in the New Hope Creek arm. At site CPF086F, the percent oxygen saturation was at 131%. Physical measurements indicated stratified conditions at the deeper stations with anoxic conditions found below six meters. All fecal coliform bacteria levels were below the DEM laboratory reporting limit of 10/100 ml. Total solids concentrations were highest at stations near the headwaters of the lake due to the proximity of point and nonpoint sources upstream. The NCTSI score in August 1993 was 3.7. This score is similar to past values and indicates that Jordan Lake is eutrophic. Jordan Lake is currently classified as WS-III, IV & B NSW CA and is considered Threatened for aquatic life, secondary contact and for overall use in the 1992-1993 305(b) Report due to elevated nutrients. Algal samples collected on September 7, 1993 in the Morgan Creek arm of the lake indicated bloom conditions of blue-green algae, Oscillatoria geminata and Anabaena species. Historically, summer phytoplankton populations on Jordan Lake have been dominated by these small, filamentous, blue-green algae. Historic monitoring data indicates that Lake Jordan has remained eutrophic since 1982 and that the NCTSI parameter values have remained consistent. From 1986 through 1989, chlorophyll a concentrations remained high in Jordan Lake. Algal populations consisted of a diversity of chlorophytes, bacillariophytes, cryptophytes, cyanophytes and euglenophytes, with cyanophytes primarily dominating the summer density estimates. The highest algal growth and chlorophyll a values have been found in the shallow, upper reaches of the New Hope River arm of Jordan Lake. Lowest overall phytoplankton densities and biovolumes, and resultant chlorophyll a values were found in the downstream station, CPF0880A. The near dam station (CPF055E), contained moderately low levels of algae, although not as low as CPF0880A, due to additional pulses of nutrients from the Haw River arm. Jordan Lake was also sampled to determine its capability to support algal growth via the Algal Growth Potential Test (AGPT) in 1989. Two sites were sampled, and results indicated that there were sufficient amounts of available nutrients to support algal growth rates in excess of levels equivalent to 57 µg/1 chlorophyll a at both sites. The control Maximum Standing Crop (MSC) at one sampling site was 17.56 mg/1. The MSC was 41.26 mg/1 with the addition of phosphorus and the MSC was 15.03 mg/1 with the addition of nitrogen. At the other sampling site, the Control Maximum Standing Crop (MSC) was 6.84 mg/l. The MSC was 7.46 mg/1 with the addition of phosphorus and the MSC was 24.12 mg/1 with the addition of nitrogen.
