Dear Mr. Temple and Mr. Stancil:
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Permit Application for the subject project on August 2, 2022. A review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
Do not include the surface water area as part of the Project Area/Low-Density Drainage
Area (Section IV, 10 of the Application, Line 2 on the Cover Page of the Supplement-EZ
Form, Lines 5 & 6 on the Drainage Area Page of the Supplement-EZ Form, & project
density calculation). You may also wish to verify the correctness of the total surface
water area used (11.95 acres) as it seems high for this project. NOTE: "Surface water" is
the area between the banks of a blue line stream as shown on the USGS topographic map
or the normal pool elevation of a pond as shown on the USGS topographic map.
2. Please ensure that the project density calculations are signed and sealed (15A NCAC
02H .1042(2)(f)).
3. The provided details of some of the vegetated conveyances show cross -slopes of 2:1
while the maximum allowable side slope is 3:1 (15A NCAC 02H .1003(2)(c)(i)). Steeper

side slopes are allowable if engineering calculations and an on -site soil investigation are
provided showing that the soils & vegetation will remain stable in perpetuity.
4. The provided deed restriction document and calculations indicate 12,000 sf of BUA per
lot while Section IV, 10 of the Application indicates 11,000 sf of BUA. Please revise as
needed.
5. The provided Application and Supplement-EZ Form shows the total amount of BUA for
this project as 1,093,170 sf while the calculations show a total BUA of 1,212,170 sf.
Please revise as needed. NOTE: The sum of the BUA as shown in the Application is
incorrect (11,000 sf/lot * 89 lots + 144,170 sf # 1,093,170 sf).
6. The provided flow rate calculations for Curb Outlet Swales 45-54 appear to be off. For
example, swale 53 is shown to have a rational coefficient, C, of 0.5, a drainage area of
3.8 ac, and an intensity of 7.2 in/hr. Using the Rational Method results in a flow rate of
approximately 13.7 cfs while the calculations show 0.8 cfs. Please revise as needed.
7. The provided velocity calculation for swale 44 appears to be off. Using the given
information for this swale (Q = 5.4 cfs, B = 4 ft, side slopes = 3:1, longitudinal slope =
7.49%, & n = 0.03) results in a depth of flow of approximately 2.9 in (a cross -sectional
area of approximately 1.139 sf, and a wetted perimeter of approximately 5.525 ft) which
results in a velocity of approximately 4.74 fps using Manning's Equation (3.50 fps is
shown). Please revise as needed.
8. Curb Outlet Swales 45, 47, 50, & 51 do not appear to meet the design requirements of a
curb outlet swale (15A NCAC 02H .1003(2)(d)). Swales 47, 50, & 51 have longitudinal
slopes in excess of 5% (maximum 5% slope per the rule, steeper slopes are allowed if
unavoidable & check dams are provided) and swales 45, 47, & 51 appear to have a length
of less than 100 ft (minimum 100 ft length per the rules). Please revise as needed.
NOTE: Curb outlet swales are only required if the project utilizes curb and gutters.
9. The plans show "New Swale `A"' for swales that appear to use the "Permanent Swale
`E"' detail. Please revise as needed.
10. The actual velocity for swales 7 & 8 (5.1 fps) exceeds the allowable velocity for these
swales (5.0 fps) (15A NCAC 02H .1003(2)(c)(ii)). Please revise as needed.
11. Please ensure that any vegetated conveyance discharging to a wetland area does so at a
non -erosive velocity (<= 2.0 fps for wetlands) (15A NCAC 02H .1003(2)(c)(ii)).
12. Please provide the additional pages of the O&M Agreement Form (the pages indicating
which O&M activities are to be provided and how often) as only the signed cover page
was provided (15A NCAC 02H .1042(2)0)).
13. Please correct the following issues with the Supplement-EZ Form:
a. Cover Page:
i. Line 2 — See earlier comment.
ii. Line 4 — See earlier comment.
iii. Lines 7 & 8 — Please complete these items (the vegetated setback is
provided from surface waters and more information can be found in 15A
NCAC 02H .1003(4) & .1017(10)).
b. Drainage Areas Page:
i. Lines 5 & 6 — See earlier comment.
ii. Line 8 — See earlier comment.
iii. Line 9 — This item should only include the BUA allocated to the
individual lots. It should correspond to the information shown on the
`Buildings/Lots line of the table in Section IV, 10 of the Application and
the information in the Deed Restriction Document.
iv. Line 10 — This item should only include the BUA located in the common
areas. This item is a sum of the items of Line 12.
v. Line 12 — These items should only include the BUA located in the
common areas, broken down by type.
vi. Line 18 — Recalculate if needed (see earlier comment).
vii. Line 19 — This item is not required.
c. Low -Density Page:
i. Line 4 — Please include this item. If there are difficulties with formatting
this cell, please either manually enter it or include this information in the
Additional Information Section (Line 15).
ii. Line 5 — See earlier comment.
iii. Lines 6-11 — See earlier comment. If curb outlet swales are proposed,
please indicate which swales are curb outlet swales in the Additional
Information Section.
iv. Please provide the swale design information for swales 31 — 54 (attach an
additional sheet as needed).
14. Provide PDFs of all revisions, 2 hardcopies of revised plan sheets, 1 hardcopy of other
documents, and a response to comments letter briefly describing how the comments have
been addressed.

sure that I (or someone else in my group) will be able to receive the
submission. Do not leave the package in the foyer with the
security guard.
NOTE: Hard copies should not be sent to a Regional Office. Doing so
will delay the review process and the submission package may be lost
while being sent from the Regional Office to me in the Central Office.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to November 24, 2022, or
the application will be returned as incomplete. The return of a project will necessitate
resubmittal of all required items, including the application fee. Please reference the State
assigned project number SW6220801 on all correspondence.
If you need additional time to submit the information, please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
