On September 16", 2021, the Governor signed Session Law 2021-158. As of January 1, 2022, Section 4(b) of
this law revokes all low density certifications and approvals issued prior to September 1, 1995 and considers the
built -upon area as existing development for the purposes of G.S. 143-214.7(al).
The Division has reviewed the file for this low density project, last approved on April 2, 1993 as a Certificate of
Compliance, and confirmed that this project meets the requirements to be revoked. Therefore, in accordance with
Session Law 2021-158, this permit has been revoked effective January 1, 2022 and the built -upon area associated
with this project will now be considered existing development. Any future development on the project or site
shall comply with the requirements of G.S. 143-214.7 and any recorded deed restrictions.

Our community of Ocean Side Place was turned over to the Property Owners Association by the
developer, Ocean Side Corporation, on or about March 22, 2006. Our understanding was that an
inspection by the State of North Carolina was to have taken place once the turnover took place to
ensure that the developer had met all of the storm water requirements. That inspection has not
occurred as of this date.
The property owners of Ocean Side Place are experiencing devastating deterioration of the roads
in the last phase of our development that began in late 2003 and completed with the purchase of
the last lot in late 2005. During the home building process in this last phase we began to see
major pavement distress and failure and discovered that plans that had been filed with County and
State agencies were not implemented as planned. An Engineering firm, hired by the POA, has
determined that those plans and specifications filed by the developer depicting "Grading, Erosion
Control and Storm Water Management" for our community have not been followed by the
developer; critical elements of the plan were omitted; design standards were not followed;
inferior materials were used; and, shoddy workmanship was uncovered.
Due to the developer not following the plans and implementing the accepted standards submitted
as filed with both our County and State agencies, our community is facing major road
deterioration, flooding and soil erosion that must be corrected at great cost to our community.
The property owners of Ocean Side Place are requesting that an inspection take place as soon as
possible to witness the failure by the developer to follow the Grading, Erosion Control and Storm
Water plans that were filed with the County and the State and hold the developer accountable for
the immediate correction of these problems.

I was requested by Ocean Side Corporation to respond to item 4(a) of your
October 12 inspection report.
As we discussed in our telephone conversation of November 5, I believe this
swale was constructed by the residents at some point after initial sitework construction
in phase I was complete. This project has been on -going for over ten years, with build
out of "Phase I" approximately complete. The swale provides additional drainage to the
area labeled "common area" on the plans.
We do not propose any additional action at this time. If you need additional
information or submittals, please inform Ms. McLamb at Ocean Side Corporation.

As promised, status of the items outlined in your October 12 letter regarding Ocean Side
Place follows:
(a) The project engineer, Joseph Hill & Associates, has been instructed to respond to
you on the addition of the swale between lots 221 and 222.
(b) We have reviewed the flumes at lots 70-71 and lots 46-47. Work on 70-71 is in
progress; 46-47 will be completed shortly. This should allow us to cancel the on -
site review I had requested for November 8.
(c) The banks of the pond on #82 are mowed regularly by the maintenance
contractor. Any trash in the pond is regularly removed by the maintenance
contractor.
(d) The swale at 211 will be cleaned as part of the clean-up and landscaping of the
house which is being constructed adjacent to the swale. The building contractor is
aware of the requirements.
(e) The swales at 46-47 and 26-27 have been mowed. All swales in the property are
mowed 2-4 times per summer. We do not mow them more often in order to avoid
disturbing the established vegetation.
(f) Ocean Side Place was developed by Ocean Side Corporation. They current
officers are Sheila K. McLamb, president; Teresa A. McLamb,
secretary/treasurer.

At our last Property Owners' meeting September 7, 2004 there was a strong concern voiced
about storm water management and flooding in our community. During the month of August the
flooding was so severe that the wet water detention pond was overflowing and flooding the streets.
Water was half -way up the home owners' driveways and construction debris such as porta. toilets
were floating down the streets. Brenda Poulton, a resident on Hampton Street recommended that
we form a storm water management committee. During that meeting several residents, including
myself, agreed to form a committee. Our goal is to identify problems and improve our storm water
management system to control flooding.
During our first meeting I agreed to chair this committee. I have lived in the state of the
Long Leaf Pine my entire adult life. I have been a resident of Brunswick County for over 10 years.
Essentially the residents of our committee have the same goals and dreams as Ocean Side
Corporation. We want to live in a residential community that reflects the relaxed lifestyle of
Southeastern North Carolina and evoke the feelings of fellowship.
In the short time our committee has been working together we feel we have identified some
of the problems with our storm water management system. We have met with or spoken to experts
in the field of storm water management at the federal, state, county, local and university levels. We
have determined that performing routine maintenance on swales and detention ponds along with
increasing the capacity and piping in the ponds would help control the flooding in Ocean Side
Place.
The storm water management committee has met with and discussed this issue with our
liaison representative. At our last meeting with the liaison representative present, the committee
suggested that either myself or Brenda Poulton meet with you to discuss this matter in more

Recommendations from Storm Water Management Committee
1. Perform maintenance on swale between lot 54 and 55.
2. Vegetation needed on bottom of swale at lot 221 and 222.
3. Perform maintenance and install flumes on swale between lot 70 and 71.

On July 30, 2003, personnel of this office inspected a project located off of SR 1300 in Brunswick
County, North Carolina. This inspection was performed to determine compliance with the North Carolina
Sedimentation Pollution Control Act of 1973. The inspection revealed a land -disturbing activity of
approximately 32.2 acres being conducted.
It is our understanding that you and/or your firm are responsible for this land -disturbing activity. The
purpose of this letter is to inform you that this activity was found to be in violation of the Act, NCGS 1 13A-50
to 66, and Title 15A, North Carolina Administrative Code, Chapter 4. If you feel that you are not responsible
for the following violations, please notify this office immediately.
The violations that were found are:
1. Failure to file an acceptable, revised plan after being notified of the need to do so. G.S. 113A-54.1(b)
and 15A NCAC 4B.0018 (a).
Work is proceeding despite the July 10, 2003 letter of disapproval.
To correct these violations, you must:
Address issues of the July 10, 2003, letter of disapproval by submitting a revised plan.
The in dal one day civil penalty could be an assessment of up to $5,000.00. A time period for
;mpliance is not required for this initial one day civil penalty pursuant to NCGS 113A-61.1 (c) and NCGS
3A-64(a)(1). An initial one day civil penalty is being considered for this project.

If the violations described in this Notice are not corrected within 20 days following your receipt of this
Notice, the Division of Land Resources may take additional appropriate legal action against you pursuant to
NCGS 113A-64. That action could be -the assessment of additional civil penalties and may result in the
initiation of other remedies as prescribed by the Act. If additional civil penalties are assessed for the violations,
the amount may be up to $5,000.00 per day for each day of the violation pursuant to NCGS 133A-64(a)(1).
If all violations are corrected within the time period specified for compliance, additional civil penalties or legal
remedies will not be pursued.
Any new land -disturbing activity associated with this project should not begin until the area presently
disturbed is brought into compliance with the Act. When corrective actions are complete, you should notify
this office so that the work can be inspected. You should not assume that the site is in compliance with the
Act until we have so notified you. In addition, once compliance has been achieved, all installed measures must
be satisfactorily maintained until development is complete and the site is fully stabilized to avoid further
violations of the Act.
We solicit your cooperation, and would like to avoid taking further enforcement action. At the same
time, it is your responsibility to understand and comply with the requirements of the Act. Copies of the
relevant statute and administrative rules may be examined at this office or will be sent to you upon request.

1. The approved street cross-section shows roadside swales. Those swales were not in place
at the time of the inspection. Without those swales, this project will need to be re -certified

velocity, revised plans, and an Operation and Maintenance plan for upkeep of the grassed
swales, if the roadside ditches are not constructed.
