This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated December 6,1983. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding. Please take notice this permit is not transferable. Part II, E.4. addresses the requirements to be followed in case of change in ownership or control of this discharge. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other Federal or Local governmental permit that may be required. Review of 1995-present DMRs indicate effluent temperature exceeded 20° C during July -Sept 1995 and June -Sept 1996. Ambient temperature of stream greater than 20° C up- and downstream of discharge during July and August 1995 and July 1996. Yet, these high temperatures were not a result of the discharge. Thus, recommend ambient temperature footnote language be modified to emphasize importance of protecting stream. This same modified version has been added to Smoketree Lodge and The Ponds. 2. The ammonia toxicity mass balance calculation using 7Q10 and permitted flows calculates an allowable concentration of 24.0 mg/1. Recommend renewal of this limit to protect against potential instream ammonia toxicity. 3. Recommend elimination of special condition E (not necessary). The treatment system consists of an exisitng 0.040 MGD package plant and a 0.100 MGD package plant with sludge basin and ultraviolet disinfection. The treatment system discharges to Watauga River (Class B-Trout HQW) in the Watauga River Basin. Compliance Summary Review of 1995-96 DMRs indicate effluent temperature exceeded 20° C July -Sept 1995 and June -Sept 1996. Ambient temperature of stream greater than 20° C up- and downstream of discharge July and August 1995 and July 1996. Yet, the high temperatures were not a result of the discharge. Thus, recommend ambient temperature footnote language be clarified. A few high oil and grease values, but none that exceeded limits. WLA Summary The ammonia toxicity mass balance calculation using 7Q10 and permitted flows calculates an allowable concentration of 24.0 mg/l. Recommend renewal of this limit to protect against ammonia toxicity. This is not a new or expanding dischargike and thus 02B. 0224 HQW limits do not apply.
