Avery County
In accordance with your application for discharge permit received on March 21, 1997 by the
Division, we are forwarding herewith the subject permit to discharge under the subject state - NPDES
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1
and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated December 6, 1983 and as subsequently amended.
Summarized changes to the permit are:
• The Supplement to Cover page description of treatment units was updated.
• Requirements for NH3, Temperature. and Total Residual Chlorine were changed per updated
.0500 regulations regarding minimum monitoring frequencies for all facilities throughout North
Carolina.
• A Total Residual Chlorine footnote was added to monitor for chlorine only if it is used.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is
made, this decision shall be final and binding.
Please take notice that this permit is not transferable except after notice to the Division of Water
Quality. Part II, E.4. addresses the requirements to be followed in case of change in ownership or
control of this discharge. The Division of Water Quality may require modification or revocation and
reissuance of the permit.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

is hereby authorized to discharge wastewater from a facility located at
Banner Elk WWTP
1/4 mile west of Highway 184
near Banner Elk
Avery County
to receiving waters designated as the Elk River in the Watauga River Basin
in accordance with effluent limitations, monitoring requirements, and other conditions set forth in
Parts I, II, III, and IV hereof.
This permit shall become effective November 1, 1997.
This permit and authorization to discharge shall expire at midnight on September 30, 2002.

SUPPLEMENT TO PERMIT COVER SHEET
Town of Banner Elk
is hereby authorized to:
1. Continue to operate an existing 0.60 MGD wastewater treatment facility consisting of an influent
bar screen, communitor, grit chamber, grit removal, flow equalization, two aeration basins, one
clarifier with return sludge, aerobic digester, UV disinfection, flow measuring and totalizing
equipment, standby power and sludge drying beds located at Banner E1k WWTP, 1/4 mile west
off Highway 184, on NCSR 1342 near Banner E1k, Avery County (See Part III of this
Permit), and
2. Discharge from said treatment works at the location specified on the attached map into the Elk
River which is classified Class C-Trout waters in the Watauga River Basin.

** The monthly average BOD5 and Total Suspended Residue concentrations shall not exceed 15% of the respective influent values (85%
removal).
*** Total Residual Chlorine monitoring is required only if chlorine is utilized in the treatment process.
The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units and shall be monitored three times per week at the effluent
by grab sample.
There shall be no discharge of floating solids or visible foam in other than trace amounts.
