Durham, North Carolina 27701 Subject: Issuance of Permit Modification NPDES Permit NCO026051 Durham County Triangle WWTP Durham County Dear Mr. Hill: Division staff have reviewed and approved your application for an NPDES permit modification. Accordingly, the Division is forwarding the subject modified pages. This permit modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). There were no comments received during the 30-day public comment period for this proposed modification. Therefore the permit modifications, effective immediately, are as follows: Change the effective date for annual mass limits for total nitrogen (100,452 lbs/yr) and total phosphorus (10,204 lbs/yr) from January 1, 2005 to May 1, 2005. As discussed in your letter dated 10/27/2003, this additional time is needed to complete the Phase II construction, which has been delayed several months due to wet weather and sludge removal problems. The Phase II construction will include the installation of the biological nutrient removal facility. The TN annual load limits were supposed to become effective 1 / 1 /2003 based on House Bill 515 requirements; therefore, this additional 4- month compliance period puts the total compliance schedule at 28 months. Please note that this facility must continue to comply with the current TP concentration limits of 0.5 mg/1 (summer) and 2 mg/1 (winter). Addition of weekly average ammonia limits to Effluent Sheets AM and A(2), in addition to the current monthly average limits. Both limits are necessary to comply with 40 CFR 122.45(d). The weekly average limits are based on a review of performance data for several municipalities, and a multiplier of 3 was used to derive the weekly average limit. All permits with monthly average ammonia limits are subject to this implementation policy. With the addition of these limits, Special Condition AV)- Ammonia Reopener- has been deleted. If any parts, measurement frequencies, or sampling requirements contained in this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon N. C. RP analysis showed the facility had RP to violate instream action levels total for copper and zinc. RP I NOV sent to facility dated 4/24/03. The sludge removal did take some additional time. Ken. As you are aware, the project has received A-T-C for the Phase I and Phase II improvements. The Phase I construction is currently substantially complete, and is approaching final completion. The Phase II contractor was issued a Notice to Proceed dated January 1, 2003 with a final completion date of January 5, 2005. However, there were difficulties associated with removing the sludge from the west lagoon that have impacted the schedule. These difficulties were encountered due to wet weather, the size of the lagoon (5 acres), and the consistency of the lowest layers of sludge. The sludge could not be pumped because it was too thick, and could not be pushed because it was too thin. While all of these issues were resolved and the sludge was removed, the completion date has been pushed back almost 4 months. As you consider this request, I would like to provide some information about the current level of progress on the project: 120 E. Parrish Street, Law Bldg., Ist Floor, Durham, N.C. 27701 (919) 560-0735 Fax (919) 560-0740 Equal Employment/Affttmative Action Employer The Phase I facilities (Influent Pump Station, Screening, Grit Removal, Flow Measurement, Effluent Pump Station, Ultraviolet Disinfection, and Post Aeration) are in service. These replacements of the older facilities provided the newer facilities for reliability, eliminated many flooding issues related to the elevations of the older structures, and eliminated the use of chlorine for disinfection that was contributing to VOC (Volatile Organic Compounds) violations of the NPDES permit. ■ The Phase II contract is well under way. The west lagoon is now filled and compacted to enable construction to proceed. The Influent RAS structure has been poured. Several slab and wall sections of the BNR facility have been poured. The Clarifier Distribution Box has been poured. Four of the five Sand Filter structures are in place. The lower slab of the RAS/WAS Pump Station is in place and the walls are being poured. Chemical Feed structures are standing. Durham County is committed to a successful completion of the project, and is expending significant time, effort, and financial resources to fulfill that commitment. We are confident that the delays that have occurred have been for reasons that are behind us and are not expected to happen again. We are comfortable with the request for the extension to May 1, 2005, and fully expect to bring the project to completion by that date.
