Dear Mr. Prewitt:
The Division has reviewed your request, prepared by JMM Operational
Services, for a permit modification dated March 27, 1997, as well as the
supplemental documentation submitted on April 9, 1997. After reviewing the
submitted materials, the Divison has decided to grant your request for a delay in
the implementation of volatile organic compound (VOC) limits in the subject
permit. This permit modification grants a four -month delay in implementation of
these limits. The VOC limits originally scheduled to take effect on April 1, 1997 will
be delayed until August 1, 1997.
This modification is granted with the following stipulations:
• The effluent sampling regime described in paragraph 4 of the April 9,
1997 letter to the Division will continue until definitive data on the impact
of chlorination on the effluent are generated. Sampling of the effluent
before and after chlorination is the most expedient way to determine the
impact of chlorination relative to the formation of VOCs in the Triangle
WWTP effluent.
• Data from the effluent samplings described above will be submitted to
the Division as part of a progress report on meeting the VOC limits. This
progress report will be submitted to the Division by June 1, 1997.
All other terms and conditions contained in the original permit remain
unchanged and in full effect. These permit modifications are issued pursuant to
the requirements of North Carolina General Statutes 143-215,1 and the
Memorandum of Agreement Between North Carolina and the U.S. Environmental
Protection Agency.

If any parts, measurement frequencies or sampling requirements contained
in this permit modification are unacceptable to you, you have the right to an
adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, an filed with the Office of
Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-
7447. Unless such demand is made this decision shall be final and binding.
