Dear Mr. Klimek:
Yesterday I received a copy of an e-mail from Teresa Rodriguez that contained the
County's renewed NPDES permit dated November 1, 2006, and a copy of a transmittal
letter dated September 18, 2006. I have enclosed a copy of this e-mail and its
attachments for your information. There are two issues I wanted to bring to your
attention regarding this permit.
The primary issue we have is that this permit was not received by Durham County last
September as the transmittal would indicate. I understand that this may have been due to
an administrative issue, and that we should receive a hard copy soon. It is also my
understanding that the-NCDENR Raleigh Regional Office did not receive a copy of the
new permit. With the absence of the updated permit, we have been continuing to operate
under the permit requirements contained in our current permit, dated July 1, 2002, and
modified with a letter dated February 13, 2004. In addition, I am requesting the
preservation of the right to an adjudicatory hearing within 30 days of receipt of the signed
permit; we expect to receive a signed copy via US mail in the next few days.
The other issue is that the transmittal included in the e-mail was addressed to Glen
Whisler. Glen Whisler is the County Engineer, and is my direct supervisor. I have
enclosed a copy of Page 2 of 22 of the Application for the renewal of this permit. Section
A.2. was completed to note that I am the contact person for this permit. Therefore, for
transmittal of documents related to the County's NPDES permit, please address
correspondence to my attention.

I am forwarding an e-mail from DWQ received earlier today. This
is the new NPDES permit for the TWWTP that was supposedly sent to us on September 18,
2006. We have been awaiting receipt of this permit and I learned earlier today from
Teresa Rodriguez at DWQ that neither Durham County or The Raleigh Regional Office received
a copy of this permit. I am requesting your review of this permit as soon as possible. I
am asking that Chuck immediately draft a response to DWQ letting them know that the permit
was not received in September 2006. That letter needs to be sent today if possible
A signed copy of the permit is forthcoming via US Mail. I would contend that we have 30
days from receipt of the hard copy to appeal the permit requirements. I will need to know
from County Utility staff and UW whether or not you recommend an appeal of any
requirements no later than March 30, 2007. This will allow adequate time to submit the
request to OAH.
