Subject: Metal Limits for the Triangle WWTP (NPDES No. NC0026051, Durham County)
Dear Mr. Cullinane:
At the September 25, 1990, meeting between yourself, Hazen & Sawyer, and
representatives of DEM, you indicated that the Durham Triangle WWTP would like the metals
limits contained in its NPDES permit to be changed from only daily maximum limits to weekly
average and daily maximum limits. Technical Support has evaluated this request and
determined the following limits are necessary to protect the North Carolina water quality
standards in Northeast Creek:
Weekly Daily
Average Maximum
Cadmium 2 ug/1 5 ug/1
Chromium 50 ug/1 200 ug/1
Nickel 88 ug/1 352 ug/1
Lead 25 ug/1 34 ug/1
Cyanide 5 ug/1 15 ug/1
Mercury 0.012 ug/1 0.048 ug/1
These limits will require daily effluent monitoring (i.e., Monday -Friday) for each
parameter, and the weekly average will be the arithmetic mean of the five daily samples. If the
weekly average limit is met by the first of the samples, the rest of the daily samples need not be
analyzed, but if the first sample is out of compliance with the weekly average limit, all five daily
samples should be reported. The weekly average limits are established to protect against
chronic toxicity instream, while the daily maximum limits are necessary to protect against acute
effects in the mixing zone. The lowest achievable analytical detection level for each of these
parameters will be required in the permit to assure the best results.

Dear Mr. Cullinane:
Thank you for meeting with staff members of the Division of Environmental Management on
September 25, 1990, to discuss the County's concerns regarding the NPDES Permit which was
issued on July 20, 1990.
As agreed, the County and their consulting firm, Hazen and Sawyer, will provide a plan for the
collection of sampling data and assimilation of pretreatment and engineering information for the
justification of a compliance schedule to be incorporated into the subject NPDES Permit. This
information is to be submitted to the Division on or before October 16, 1990.
Once these items have been reviewed by the Division of Environmental Management, we will
proceed to prepare the appropriate permit modification or an explanation of why we feel these
requirements are necessary. Another meeting can be scheduled after this review, if appropriate. If

Representatives of the County requested an explanation of the
effluent limitations that were added or revised in their recent
permit renewal. DEM staff explained that chemical specific
toxic limitations and monitoring requirements were based upon
meeting State water quality standards for toxic constituents
known to be present in the County's effluent. Changes in the
summer total phosphorus, BOD5, NH3N, and DO limits were
based upon documented instream water quality problems. Effluent
and instream data were summarized and compared with water
quality standards.
The County representatives requested a 24 month delay in
implementation of the new or revised limitations in order for
them to establish a better database and to improve their
internal controls on industrial sources. It was pointed out to
the County that they had been monitoring for these substances
for several years, and the data indicated very few violations
within the past twelve months. In addition, the new permit does
not go into effect until March 1, 1991. DEM staff asked for the
County to provide a more detailed description on why the County
would need additional time. It was acknowledged by DEM that
compliance with the revised summer TP limit should not be
required by the permit's effective date.
An inquiry was made regarding modification of the permit to
include weekly average as well as daily maximum toxic
limitations, so that the current daily maximum limits could be
slightly relaxed. Technical Support agreed to provide the
County with a speculative set of limits under this scenario for
their consideration.
The County will submit a plan to DEM within 2 weeks outlining
how they intend to gather the necessary information and make
decisions regarding the amount of time required for
implementation of the new requirements. DEM, in turn, will
review this information and determine whether to request the
office of General Counsel to pursue a continuation from the
administrative law judge to provide time for further settlement
discussions.
