This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983. The following changes were incorporated into this NPDES permit renewal: • Daily maximum limits for BOD5 and TSS were changed to weekly averages. • Limits for instream sample locations (U,D) were removed for DO and fecal coliform. • Monthly average limit for TRC was changed to a daily maximum limit. • Sample type for copper was changed from grab to composite, and sample frequency was changed from monthly to 2/month. • Addition of an effluent limit for mercury of 0.066 ug/I, effective December 1, 1999, if weekly monitoring data indicates a reasonable potential to exceed the water quality standard. • Remove effluent limit for cyanide, and change monitoring frequency from weekly to 2/month. • Change monitoring frequency from quarterly to 2/month for phenol and silver. • Change flow measurement frequency from weekly to instantaneous, and sample type from estimate to recorder. • Change stream class from WS-III to WS-1V. • Change permit expiration date to July 31, 2003. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. The mercury limit will become effective in one year (i.e., December 1, 1999) if weekly monitoring data indicates a reasonable potential for exceedance of the mercury water quality standard. The detection limit for mercury is 0.2 ug/I. If the measured levels of mercury are below the detection limit, then the measurement is considered to be zero for purposes of compliance evaluation and should be reported on the DMR as < 0.2 ug/I. 6, The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units. Effluent limits will need to be modified upon expansion of Forest City Water Treatment Plant above 8 MGD intake; see Special Condition A(3). There shall be no discharge of floating solids or foam in other than trace amounts, Permit No. NC0025984 SUPPLEMENT TO EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A (2). CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QUARTERL}7 The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised November 1995, or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is 18.0% (defined as treatment two in the procedure document). The permit holder shall perform quarterly monitoring using this procedure to establish compliance with the permit condition. The tests will be performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. WATER TREATMENT PLANT EXPANSION Upon expansion of the Forest City Water Treatment Plant above 8 MGD, Forest City shall request modification of NPDES permit number NC0025984 to incorporate new limits for conventional pollutants and toxicants. Permit expiration date Expiration date modified to reflect Broad River Basin Master Planning Schedule Summary This is a Major Class IV municipal facility with an approved pretreatment program (4 SIUs). Influent to WWTP is 70% industrial and 30% domestic. Average daily industrial flow equals 3.15 MGD, which includes textiles, food processing, and rubber processing. The Town of Alexander Mills (NC0020320) is tentatively scheduled to cease discharge and connect to the Forest City WWTP by October 1998, adding up to 0.2 MGD of primarily domestic wastewater. Sludge residuals are land -applied. A TRC limit (28 ug/l) was previously added when the facility expanded from 4.25 MGD to 4.95 MGD. DMR Data. Between 5/98 and 6/97, the facility reported permit limit violations for $OD (3 Daily Max ); TSS (11 Daily Max, 1 Monthly Average); and Fecal Coliforms (1 Monthly Average, 1 Weekly Average). The exceedance of BOD/TSS daily limits should be reduced in the future, since permit renewal will change the daily max limit to a weekly average per policy for municipal POTWs. High fecal coliform counts appear more frequently during wet weather. Forest City WWTP has consistently passed its quarterly chronic WET test since 1990. Passing scores were recorded for quarterly samples submitted in calendar years 1990, 91, 92, and 93. Review of recent data (1/96 — 4/98) indicates passing scores for 9 of 10 quarterly samples. WLA/Receiving Stream Data. A 1994 WLA evaluated the facility with an 8 MGD withdrawal by the upstream water treatment plant (WTP). This WLA predicted a DO minimum of 5.08 mg/1 occurring 1.6 miles below J.C. Cowan's outfall, and established WQ-based limits based on oxygen consumption for BOD5 (25.5 mg/1), NH3 (10 mg/1), and DO (6 mg/1). Although the 1994 toxicant analysis for NH3 recommended more stringent limits (3.5 mg/1 for summer and 6.87 mg/1 for winter), these toxicity limits were not applied in the current permit because Forest City has consistently passed its chronic toxicity test. The 1994 WLA also evaluated several future WTP withdrawal scenarios (8 MGD-current permit, 10 MGD, and 12 MGD ); the current permit has a reopener condition that requires Forest City to request a permit mod (for re-evaluation of permit limits) if and when the WTP withdraws greater than 8 MGD. Review of DMR instream data for 5/98-5/97 indicates minimal downstream impacts on dissolved oxygen (DO), with instream levels generally greater than 7 mg/1. Occasionally, some daily instream measurements show increased fecal coliform Page 2 Version: July 30, 1998 concentrations at the downstream station; however, upstream concentrations are also relatively elevated. Stream class verified as WS-IV (Classified 8/3/92; Index No. 9-41-(14.5)). Second Broad River is not listed in 1998 303(d) List. Reasonable Potential Analysis (RPA). LTMP data (1996-1998) was supplemented by tMR data for the same period to perform RPA when needed. Those parameters NOT requiring an RPA (or effluent limits/monitoring) were: Arsenic- detected in 1 /25 samples; "hit" of 5 ug/1 «WQS(50 ug/1) Cadmium- detected in 0/24 samples; DL<WQS(2 ug/1) Chromium- detected in 4/24 samples; 3 "hits" at DL of 5 ug/1«WQS(50 ug/1) Nickel- detected in 1/24 samples; "hit" of l0ug/1 at DL< WQS (25 ug/1, WS waters) Selenium -detected in 2/24 samples; "hits" near DL of 5 ug/1; WQS = 5 ug/1 Molybdenum- detected in 2/24 samples; "hits" at DL of 2 ug/1; no WQS or AL RPA using 7Q10 flow was conducted for lead, zinc, mercury, copper, cyanide, and silver; RPA using 30Q2 flow was conducted for phenol (aesthetic limit). Results are attached. Based on RPA results, an effluent limit was added for mercury, and removed for cyanide. Monitoring only was recommended for cyanide, copper, silver, and phenol. No monitoring was recommended for lead and zinc. According to Pretreatment Unit, mercury has been a problem in this area, with an unknown source; Pretreatment concurs with the addition of a mercury limit. Staff Report. A SR was prepared by Asheville RO on 5/6/98. The ARO recommends permit renewal, and a change in the BOD/TSS limits from daily max to weekly averages. ARO also recommends that the reopener condition (for future WTP expansion) be maintained in the permit renewal. In 1997, the facility received favorable ARO reviews for both the Pretreatment Compliance Inspection and the Compliance Sampling Inspection. The most important concern to thL1 Town is with the limit requirement for Mercury. cn In the past,1990 through 1994, Forest City was required to 3 perform an Annual Priority Pollutant Scan and in each.moni-N- toring event mercury was found to be less than detectable. •• Since then, through the Pretreatment Program and the Head- cd works Analysis of 1993 more monitoring of mercury has been completed. Most of the results were below detection which led Forest City to believe there was not a problem. Mr. Goodrich, Forest City respectfully requests that the Mercury limit not be imposed at this time and that time be given to intensify monitoring at the frequency you have suggested. Work has already begun to locate the source/ sources of mercury. Forest City is due a new Headworks Analysis this year which would already have been completed except that the Pretreat- ment Sections' Melanie Bryson and Forest City felt we should wait because the Town of Alexander Mills will be sending its' wastewater to Forest City on Oct. 1,1998 and should be included in the Headworks Analysis. Mr. Roger Edwards out of the Asheville Regional Office and Forest City have talked about mercury and we realize that much work lies ahead in locating the sources. Laboratories that perform mercury testing are also of concern and sample splitting must be done as a quality control check. In closing I simply ask that you give us time to monitor without imposing the mercury limit.
