Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This final permit includes no major changes from the revised draft sent to you on November 15, 2001. The Wastewater Management Plan required by Part I. A. 3. must be submitted by August 28, 2002. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. CHRONIC TOXICITY PERMIT LIMIT - Quarterly The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 0.74%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of February, May, August and November. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. CHRONIC TOXICITY PERMIT LIMIT - Quarterly (continued) All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A. (3.) WASTEWATER MANAGEMENT PLAN No later than 180 days after the effective date of this permit, the Permittee shall submit to the NC DENR Mooresville Regional Office a wastewater management plan. The plan shall include, at a minimum, the following elements: • Future flows. Provide estimates of wastewater flows and characteristics for the next 10-20 years and the basis for those estimates, including assumptions and calculations. • Alternatives analysis. Conduct a technical and economic evaluation of wastewater disposal alternatives, specifically including at least the following alternatives: • connection to the City of Gastonia wastewater collection system (or any other POTW) • connection to the Pharr Yarns WWTP • implementation of a reuse program • any combination of the above options The analysis and report should be consistent with the EAA guidance document provided by the Division. Describe deficiencies and operational difficulties in the existing collection and treatment systems which affect performance or permit compliance. Identify potential improvements to correct those deficiencies. At a minimum, evaluate the following considerations: • inflow and infiltration, • diversion of wasteloads during peak flows, • equipment repairs and preventative maintenance, • removal of accumulated solids, wastes, other debris • Optimization plan. Develop a plan for optimization, rehabilitation, expansion and/or replacement of the collection and treatment systems to achieve optimum performance. Identify specific measures and key tasks, including those in the above facilities assessment, and provide an estimated schedule for completion of each. • Communications plan. Describe a plan for informing utility customers of their potential impacts on treatment system performance and appropriate practices for minimizing those impacts, including a schedule for implementation of the plan. At a minimum, include the following elements: • oil and grease contributions to the collection and treatment system, • common practices that adversely affect the collection/treatment system • notification procedures in case of emergencies. There have been the following significant changes from the draft previously sent to you. ➢ The facility description was updated at the request of your ORC. ➢ Monitoring frequencies several parameters have been changed to 3/Week. The Mooresville Regional Office requested the changes and a re -rating of your facility from Class II to Class III. The 3/Week monitoring is required for all Class III facilities. Connection to Regional Sewer System: Although there is no nearby "regional" sewer collection system, there have been discussions between the Town and Pharr Yarns (PY) concerning the possibility of connecting the Town's collection system to the existing PY WWTP. The PY plant has lost a considerable amount of its hydraulic flow as a result of recent product line closures. Such being the case, additional capacity now exists at the PY WWTP, which has the capacity necessary to accept the wastewater currently treated by the Lowell WWTP. Unfortunately, negotiations have broken down between PY and the Town concerning this matter. If the Town does negotiate an agreement with PY to accept and treat the Town's wastewater, the agreement should include a stipulation that allows the Town to own and/or operate the PY WWTP should PY cease operation (shut down) at some point in the future. The facility was last permitted in 1996. During the period March 1994 — March 2000 there were no enforcement actions against the permittee. No violations were noted in a review of monitoring data from the period March 2000 — April 2001. Discharge flow during the period January 1999 through April 2001 averaged <50% of the permitted volume (0.6 MGD). ' Total Residual Chlorine (TRC) effluent concentrations are high. While the Division cannot implement a TRC limit immediately, the draft permit warns the permittee that the existing TRC concentrations are unacceptable and must be reduced. Currently, the Division has an "action level" for TRC in non -trout waters. Existing discharges may receive limits if whole effluent toxicity (WET) test results demonstrate toxicity caused by excessive TRC in the effluent. The Division is currently considering development of a TRC standard for non -trout waters; such a standard, once implemented, would impact the Lowell WWTP (and many other facilities). On June 27, 2001, the Mooresville Regional Office submitted a staff report recommending renewal of the permit. The staff report also recommended that the City pursue connection of this discharge to the existing Pharr Yarns plant (permit NC0004812). Pursuant to that recommendation, the draft permit requires the City to submit a Wastewater Management Plan within 180 days of the final permit effective date. The Plan should address connection to Pharr Yarns and other non -discharge alternatives, as well as optimization of the existing facilities. The receiving stream is not impaired. The sludge handling and disposal for this facility is as follows: We have four (4) drying beds that are used during the year and when the sludge dries on these beds rt is put into a BFI hopper and transported to the BF/CMS Landfill, 510 Morehead Rd, Harrisburg, NC 28075, (704) 782-2004 When the drying beds are full, we have the sludge pumped out of our digester and transported by tanker truck to the City of Charlotte, McAlpine Creek VWVTP This sludge is hauled by Oaks Liquid Waste, Inc., 8531 Old Dowd Rd., Charlotte, NC 28214.
