Mr. Beinenson,
Please see the attached correspondence regarding the Auctioneer Forest Mitigation Site, which is
part of the proposed Eco Terra Neuse 01 Umbrella Mitigation Bank. As you are aware, we have been
in the process of reviewing the modified Draft Mitigation Plan for the site, as well as seeking IRT
comment on the modification. The proposed changes to the site that were necessary to address
potential flooding of adjacent parcels resulted in a significant reduction of both the conservation
easement as well as the amount of wetlands to be restored on the site. This, in conjunction with
other serious concerns about the site, has led us to determine that the site no longer meets the
standard for projects that can be used to provide compensatory mitigation for impacts associated
with permit authorized by the District. As such, we are withdrawing the AFMS from further
consideration. Please note that this also leaves the proposed bank in question as there is no longer
a specific site to support development of the bank instrument. Please contact us within 30 days if
you plan to propose an additional site to support further review of the Neuse 01 Umbrella Bank.
