Box 457 Swannanoa, North Carolina 28778 Subject: NPDES Permit Modification Fletcher Warehousing Company NPDES Permit NC000094 Henderson County Dear Mr. Pott II: Division personnel have reviewed your request for revision of sampling requirements and increase in flow adjustment. We have reduced your sampling frequency for several parameters in accordance with state regulations (Administrative code section 15A NCAC 2B.0500). New sampling frequencies are presented in Attachment A(1.). However, we are unable to grant your request for increase in permitted flow. Analyses of Discharge Monitoring Reports for your facility indicated that since the conversion to Fletcher Warehousing Company during 2001 and 2002 flow has been recorded only in March of 2001. Since the beginning of 2003, flow has been recorded every month of the year and frequently exceeded the permitted flow of 0.01 MGD. The Division understands that you are in the process of modifying your stormwater conveyance systems to divert roof drains from the treatment system, which should alleviate existing problems. Stormwater can be discharged in accordance with Stormwater General Permit. Please contact Ken Pickle at 919-733-5083 (ext. 584) to obtain information on General Stormwater Permits. If any parts, measurement frequencies or sampling requirements contained in this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699- 6714). Unless such demand is rhade, this decision shall be final and binding. OCT 11 2003 DENR-WATER QUALITY POINT SOURCE BRANCH Re: NPDES Permit NC0000094 Dear Mr. Goodrich: Pursuant to your letter of July 3, 2003 regarding our May 8, 2003 request for a flow volume change we hereby include a check for the permit revision fee in the amount of $215 as requested. Additionally, as we have not received any response to our request of March 7, 2003 (copy enclosed) for a revision of sampling requirements we wish to incorporate that request into the flow volume request for a single permit modification, as set forth below. We had concerns when our pennit was originally being drafted as a change from the old Cranston Print Works permit levels about the very low flow volumes of the revised permit given historical peak rainfall levels in the area and that our roof drains for all buildings feed into the treatment system. Rainfall levels this spring have dramatically increased our documented flow levels and we wish to request an increase in our authorized flow volumes to .1MGB in recognition of this. The increase inflow is due solely to rainfall levels and not to any increased activity levels at the site. We also wish to request a modification in our above referenced permit for sampling requirements. Our permit covers a 4.0 MGD extended aeration wastewater treatment facility for an average flow of 0.01 MGD. The wastewater plant was originally configured for a textile finishing plant, but the property is currently utilized as a warehouse and distribution facility. Primary inflows to the system are roof drains and stormwater versus sanitary waste, although sanitary waste does flow into the system. The sampling requirements of our effluent are certainly reasonable if system flows were at the 4.0 MGD level, but are quite onerous since we are limited to 0.01 MGD average flow. I have been given to understand that the sampling requirements we are under are not standard for a facility with flows of 0.01 MGD. We are also investigating alternatives for handling the storm drain flows, but believe a permit revision in the interim will be necessary for us to remain in compliance. We have maintained contact with our regional representative, Mr. Roy Davis, about the status of our potential alternatives, and hope we can have the issue fully resolved before the end of this summer.
