Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the.
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US. Environmental Protection Agency dated May 9,1994 (or as subsequently amended).
This final permit includes no major changes from the draft permit sent to you on July 6, 2005.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filled with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which may be required bythe Division of Water Quality or permits required bythe Division of Land
Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that maybe

Fletcher

to receiving waters designated as the French Broad River in the French Broad River
Basin
in accordance with effluent limitations, monitoring requirements and other
conditions set forth in Parts I, II, III and IV hereof.
This permit shall become effective December 1, 2005.
This permit and authorization to discharge shall expire at midnight on November 30, 2010.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.
Fletcher Warehousing Company is hereby authorized to:
1. Continue to operate an existing (4.0 MGD) extended aeration wastewater
treatment facility at a monthly average flow not exceeding 0.01 MGD which
includes the following components:
➢ Influent lift station with manual trash screen
➢ Dual 3.75 MGD aeration basins with mechanical aerators
➢ Dual final clarifiers with sludge return
➢ Belt press for sludge
➢ Sludge dryer
➢ Settling ponds
➢ Effluent disinfection equipment
This facility is located at the former Cranston Print Works plant in Fletcher on
Route 25 in Henderson County, and
2. Discharge from said treatment works at the location specified on the attached map
into the French Broad River, classified WS-IV waters in the French Broad River
Basin.

Update
I spoke to Stan Littlejohn w/ Fletcher whse this morning and he is going back to the drawing board on
connecting to the municiple sewer. They want to get out of the wwtp business, completely and finally. That
said, ARO has no issue with the permit renewal. ARO will keep the heat on the permittee to correct their
issues and push for a permanent solution - connection to the sewer.

Since they are not able to repair the line and it also doesn't make economic sense to do it we have to
relocate discharge to Cane Creek. Unfortunately, it is likely to be a Major. Mod but we don't' have any
other option. If they agree to the proposed course action (surface sand filter), they would need to send us
a letter asking for a permit modification, and we will do a model to determine effluent limits. Thank you
for info about dischargers, but they are permitted and we would have to consider allocated assimilative
capacity even if they are not built.
Please keep me posted. Unfortunately, we can't keep permit on hold for a long time.

Remember the plant was designed for 4.0 mgd and is currently permitted for .010 mgd. The current
discharge outfall pipe is approximately 2 miles long, from the plant to the French Broad River and has
failed (due to hurricane flooding in September 2004). The current discharge pipe crosses under 2
major highways (Interstate 26 and US Hwy 25), under the only north -south railroad line in the area
(Norfolk Southern) and crosses 2 tribs to cane Creek in route to the French Broad. The line has failed
and the WWTP is currently discharging to Cane Creek and/or it's watershed. They cannot afford to
replace or repair the 18" line.
The WWTP serves the warehouse and 22 employees Cane Creek is adjacent to the plant and it
converges with the French Broad approximately 2 miles downstream. And we are proposing a surface
sand filter with less than .005 mgd discharge and maybe less than .002 mgd.
I have heard nothing from the owner in the last few weeks.
FYI- 3 of the 7 discharges have not been built and 2 may never be built.

I have received a NOW for Fletcher that was based on your inspection. I have noticed that you
suggested that company build surface sand filter, which we completely support. The one concern
we have is that you recommended discharge to a Cane Creek instead of French Broad River. The
relocation is possible but it would be lengthy and complicated process. In order to relocate
discharge to Cane Creek they would need to apply for a Major Permit Modification. After we
receive their application we would develop a water quality model to calculate new limits for your
permit. After limits are developed we would go to a Public Notice, if there are no objections by
private citizens, businesses, government organizations or environmental groups, we would modify
their permit to allow relocation of discharge point. Since they would be moving to a smaller
receiving stream it is likely that permit limits would be tighter. Cane Creek already has seven
dischargers and most of it's assimilative capacity has been allocated. Therefore, limits for a new
discharge would be tight to assure compliance with the water quality standards.
I think that they need to keep their discharge at the current location. Please let me know the latest
developments in your talks with them.

Enclosed please find a copy of the Inspection Report from the inspection conducted October 6, 2005.
Mr. Larry Frost and Mr. Keith Haynes of the Asheville Regional Office conducted the Compliance Evaluation
Inspection. The treatment facility was found to be in violation of Permit NC0000094 for the following:

Operation and Maintenance Failure to properly maintain.
Please refer to the enclosed Inspection Report for any additional observation and comments.
To prevent further action, carefully review this violation and respond in writing to this office within fifteen
(15) working day of receipt of this letter. You should address the causes of noncompliance and all. actions

The facility is in a state of decay. The plant is overgrown and a refuge for wildlife. The facility must
either be maintained or another treatment option found.

The warehouse has investigated the possiblity of installing traditional septic tank and nitrofication field;
and have been denied by Henderson County.
The warehouse is/has investigated connection to MSD and the Cane Creek Sanitary District and found the
prospects very expensive.
It is the recommendation of these inspectors, in consultation with the Regional Supervisor and the NPDES
Permitting Unit, that the;
- 1) current permit renewal process be put on hold
2) that the warehouse investigate the possibility of (utilizing the current permit, which will reduce
permitting time) permitting with the NPDES Permitting Unit a surface sand filter to handle the domestic
wastewater of its employees. In doing so the warehouse should request a discharge point in Cane Creek adjacent
to the warehouse.
- 3) the warehouse should begin investigating the ultimate disposal of sludge from this facility. Including
volume, which I understand may be minimal (from Mr. Roy Davis). They should contact class D land fills for
testing requirements and disposal requirements; or municipile wastewater treatment plants that may accept it
as septage.
- 4) the warehouse should also investigate their disposal needs for storm water as well. In order to utilize a
treatment option the stormwater will have to be discharged form the site.
The Asheville Regional Office looks forward to working with Fletcher Warehousing to resolve these issues.
