Dear Mr. Hennessey:
Please fmd enclosed seven copies of a PCN application from the North Carolina Department of
Transportation requesting Nationwide 14 authorization for a secondary road improvement project on SR
1971 (Old Field Rd.) in Duplin County. The scope of the project will be to widen, grade, drain and base the
1.6 miles of existing unpaved road to current NCDOT secondary road standards of 20 ft of travel lanes and 6
ft of earthen shoulders to improve roadway safety and stability.
IMPACTS TO WATERS OF THE UNITED STATES
This project is located in the Cape Fear River Basin within USGS hydrologic unit 03030007 (subbasin
030622). The proposed project will permanently impact 43 ft of perennial waters associated with the
replacement and extension of pipes P1 (Sta. 8+10), P4 (Sta. 30+75) and P6 (Sta. 46+00). These crossings
serve as conveyances for unnamed tributaries to Cypress Creek, which is classified as C Sw waters. There
will also be 6 ft of temporary stream impacts at site P2 for removal of the existing pipe that extends beyond
the proposed pipe as well as an additional 8 ft of temporary stream impacts at each crossing (24 ft total) for
BMP devices. Ken Averitte of your staff and Jennifer Frye (LTSACE) visited the site on August 23, 2007 to
confirm the determinations. No wetlands will be impacted by this project. Furthermore, there are no
permanent or temporary utility impacts proposed with this project.
COMPENSATORY MITIGATION
The Department has avoided and minimized impacts to jurisdictional resources to the greatest extent
possible. Side slope designs have been reduced to 3:1 to reduce impacts. Right of Way (R/W) was centered
with the existing alignment where possible to minimize new impacts. Construction limits were limited to the
existing roadbed (~30ft) between Sta. 7+00 and Sta. 15+00 LT to avoid 800 ft of perennial waters within the
R/W. Furthermore, an offsite detour will be utilized during the pipe replacements to avoid temporary

impacts for an onsite detour. Stream impacts associated with this project are less than 150 ft therefore in
accordance with 15A NCAC 2H.0506 (h); mitigation will be not required.
NATURAL AND HISTORIC RESOURCES
FEDERALLY FROTECTED SPECIES
Species with the federal classification of Endangered, Threatened, Proposed Endangered and Proposed
Threatened are protected under provisions of Section 7 and Section 9 of the Endangered Species Act of 1973
as amended (16 U.S.C. 1531 et seq.). The United States Fish and Wildlife Service lists three federally
protected species for Duplin County which include American alligator (Alligator mississippiensis), Red-
cockaded woodpecker (Picoides borealis) and American chaffseed (Schwalbea americana). A GIS and field
review has been conducted for these species and their habitat for this project and a determination of"No
Effect' for the listed species is recommended.
HISTORICAL RESOURCES
Pursuant to Section 106 of the National Historic Preservation Act and the Advisory Council on Historic
Preservations Regulations for Compliance with Section 106 codified at 296 CFR Part 800, this project has
been reviewed and cleared for effects on historical and archeological resources.
REGULATORY APPROVAL
Section 404 Permit: The Department of Transportation is requesting to proceed under Nationwide 14 in
accordance with 72 FR 11092, March 12, 2007. Through consultation with the U.S. Army Corps of
Engineers (L7SACE) it has been determined that this project can be authorized under Nationwide 14 and will
not require pre construction notification to the USACE.
Section 401 Permit: We are also requesting by copy of this letter issuance of the 401 Water Quality
Certification 3627 from the DWQ. We have provided a method of debiting $240 to be submitted to the
DWQ for processing the WQC permit request, as noted in the subject line of this application.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,

VII. Impact 3ustification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.

VIII. Mitigation
DWQ - In accordance with 1 SA NCAC 2H .OS00, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 1 SO linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Cazolina, available at
