Dear Sharon Bing:
The Division of Energy, Mineral and Land Resources (DEMLR) has reviewed your submittal of the No
Exposure Certification for Exclusion from NPDES Stormwater Permitting form, received on November
30th, 2022. The Division is unable to concur with your certification of no exposure.
Based on an inspection of your facility on December 7, 2022, Mooresville Regional Office staff observed
wood pallets at ground level in numerous locations exposed to precipitation events. Additionally, what
appeared to be scrap metal was found stored in cardboard boxes plus out -of -use equipment was exposed
to the elements. Finally, two compactors were observed with their waste -loading shoots open and exposed
to rainfall while full of waste. The Division cannot grant your requested exemption from permit coverage
when industrial activities or materials are exposed or have the potential to be exposed. Please fix the
reported issues and reapply for a No Exposure exclusion or apply for coverage under the appropriate
General Permit.
