The Division of Energy, Mineral and Land Resources (DEMLR) has reviewed your submittal of the No
Exposure Certification for Exclusion from NPDES Stonnwater Permitting form, received on October 27,
2022. The Division is unable to concur with your certification of no exposure.
Based on an inspection of your facility on November 18, 2022, Raleigh Regional Office staff found that
the outdoor fueling and the storage of oil and antifreeze products on your site remain and are exposed to
precipitation events. The Division cannot grant your requested exemption from permit coverage when
industrial activities or materials are exposed or have the potential to be exposed. Please apply for
coverage under General Permit NCG080000: Transit and Transportation within 60 days of this letter. You
