Just starting to look at this one. When are you anticipating having the revisions finalized? By the end of October?
Can you please provide/answer the following:

1. No modifications to stream or buffer impacts are requested, correct? Please provide a copy of the final stream
and buffer impact tables for verification. [15A NCAC 02H .0502(c)]
2. Can you please provide a revised Site Vicinity Exhibit with something to help call out where the new changes are
proposed in relation to the project as a whole? [15A NCAC 02H .0502(c)]
3. Am I understanding that the easements where modified impacts are occurring have not been obtained yet?

to some condemnation tracts.

I'm thinking it might make sense to put the revision you guys are currently reviewing on
hold for now, until we get this last one figured out, rather than us having to come back
and submit yet another revision and all that stuff further down the road?

Dear Colleen Cohn,
After review of the submitted permit application for the subject project, received
August 11, 2022, and NWP 12 corresponding WQC, dated December 18, 2020, it
appears that an individual 401 water quality certification (WQC) is required from the
NCDWR for the proposed activities. The ePCN received by our office provided the 9
required elements for an individual WQC. This permit application/ePCN, constitutes the
Corps initial receipt of the 401 WQC application. Unless NCDWR is granted a time review
extension, a waiver will be deemed to occur if the NCDWR fails to act on this request for
certification within 120 days from the date of the complete 401 request. The reasonable
period of time (RPOT) for you to act on this WQC request is 120 calendar days. The date
upon which the waiver will occur if you fail or refuse to act on the certification is
December 9, 2022.
Dear Joey Lawler: Please note, should we finalize our review prior to receiving the 401
WQC, you will receive a provisional general permit verification from the Corps. Once a

401 WQC is issued or waived by the DWR, the Corps will provide you with a final general
permit verification. Your proposed work shall not commence until after the 401 WQC
has been issued or waived AND until a final general permit verification has been
provided to you.
