Authorizing development in Dare County at Atlantic Ocean and NC 12, six miles south
of Oreeon Inlet Pea Tsland NWR , as requested in the permittee's application letter dated j/6/15, including the
attached workplan drawings (3) dated as received on 1/6/1.
This permit, issued on 1116115 _, is subject to compliance with the application (where consistent
with the perinit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, this minor modification and renewal authorizes the construction of
a protective sand dune approximately 370 feet in length along NC 12 north of the New Inlet
temporary bridge, as depicted on the attached workplan drawings.
2) Nothing in this permit authorizes any activity that has not received approval from the U.S. Fish and
Wildlife Service (USFWS) for work within the Pea Island National Wildlife Refuge.
3) In accordance with commitments made by the_permittee, all work shall take place between November
15`h and April I" to avoid any potential impact to protected species.
4) No vegetated wetlands shall be excavated or filled, without permit modification.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
April 30, 2017
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

The authorized dune maintenance activities shall not result in impacts to the existing dune systems that
would weaken the protective values of these dune systems.
6) All work shall be accomplished in such a manner that the damage to existing vegetation is minimized.
?) All sands used to strengthen the dune must be of the same general characteristics as the sand in the
existing dunes and ocean beach where it is to be placed.
4) The north end of the dune system undergoing maintenance shall be aligned to the greatest extent
possible with the existing adjacent dune ridge.
9) The permittee and /or his contractor shall contact the DCM Transportation Project Field Representative
in Elizabeth City at (252) 264 -3901 to request a preconstruction conference prior to project initiation.
10) This minor modification and renewal shall be attached to the original of Permit No. 104 -11, which was
issued on 9/2/11, as well as all subsequent modifications and refinements, and copies of all documents
shall be readily available on site when a Division representative inspects the project for compliance.
11) All conditions and stipulations of the active permit remain in force under this minor modification and
renewal unless altered herein.
NOTE: This minor modification and renewal does not eliminate the need to obtain any additional
permits, approvals or authorizations that may be required, including but not limited to any from
the U.S. Army Corps of Engineers.
NOTE: The N.C. Division of Water Resources (DWR) authorized the proposed project (DWR Project
No. 14 -1219 v.2) under General Water Quality Certification No. 3900.
