Page Two 9. PROJECT DESCRIPTION The project site is located at 191311917 Atlantic Drive, adjacent to the AIWW/ Middle Sound, in New Hanover County. According to the application, the parcels located at 19131 1917 Atlantic Drive have a maximum elevation of approximately 0' - 16' above normal high water (NHW). 1913 Atlantic Drive is approximately 0.69 acres and 1917 Atlantic Drive is approximately 0.70 acres. Both lots have existing single-family residences consisting primarily of ornamental landscaping and maintained lawn grasses. 1917 Atlantic Drive has an upland retaining wall landward of NHW. The total combined shoreline length for the properties is approximately 207' and are stabilized by natural vegetation. Waterward of the upland vegetation are Coastal Wetlands. The Coastal Wetlands are comprised primarily of Salt Marsh Cord Grass (Spartlna alfernaflora). There is an existing shared docking facility with an access pier that measures approximately 4' x 430' and terminates to an 8' x 12' fixed platform with two 12' x 12' gazebos on the north and south side of the platform. Each gazebo has a ramp that extends to an existing 6' x 16' floating dock (2). There is also an existing 12' x 12' boat lift (2) adjacent to each gazebo. The existing docking facility provides docking space for up to 4 vessels (see Drawing 1 of 4). The existing docking facility was permitted under Major Permit 163-04 in November 2004. We were unable to locate any additional permitting history for these properties. The New Hanover County Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Residential. The adjacent waters of the AIWW/ Middle Sound in the project area are classified SA-ORW by the Division of Water Resources and this area is NOT designated as Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. PROPOSED PROJECT The applicants propose to dredge waterward of the existing private docking facility and under the existing boat lifts and floating platforms to a maximum depth of -3' Normal Low Water (NLW) within the AIWW. The applicants propose to excavate an area incorporated by the existing docking facility and an area located waterward of the existing docking facility. An area measuring approximately 72' wide extends approximately 73' in length from the landward side of the existing boat lifts into the AIWW; as this area extends, the width narrows to approximately 50' wide. This area is proposed to be dredged to a depth of -2' NLW (see Drawing 3 and 4 of 4). The middle section of the existing fixed platform and the two gazebos are included in the 72' wide measurement, but no dredging is proposed under these structures. A second area measuring approximately 120' long x 50' wide extends waterward from the first area to connect to the 3' contour adjacent to the AIWW. This second area is proposed to be dredged to a depth of -3 NLW (see Drawing 3 and 4 of 4). According to the application, the existing water depths of the incorporated docking facility range from approximately -1.2' to -1.9'. DCM verified water depths on October 10, 2022 from 3:30 — 3:50 pm and observed water depths of the incorporated docking facility to be approximately -1.1' to -1.9'. DCM also took water depths waterward of the existing docking facility and was able to verify the 3' contour approximately 140' waterward of the structure. The proposed dredging footprint is located partially within a recognized submerged land claim owned by Broadfoot Limited PTNRP. The applicants have received a one-time authorization from Broadfoot Limited PTNRP for the proposed dredging of the submerged bottom. The approximately 10,200 ft2 area would produce approximately 380 cy of material, Bucket to barge method would be used for the proposed dredge work. The 380 cy of material would be placed on DA-228, outside of the USACE 1913/ 1917 Atlantic Drive, Faith & Claus Platt/ Pettersson Coastal, LLC. Page Three right-of-way along and adjacent to the existing dike. The Northeast New Hanover Conservancy has given a one-time authorization for the spoil to be placed on the upland property. The applicants have also stated that if needed, they understand that a consent agreement must be obtained prior to crossing the USACE right-of-way to place spoil material. No structural changes are proposed to the existing docking facility. 10. ANTICIPATED IMPACTS The proposed dredging would disturb approximately 10,200 ft2 of bottom substrate and would be excavated to the connecting depth of J NLW, The approximate 380 cy of spoil material will be placed on DA-228, outside of the USACE right-of-way along and adjacent to the existing dike. DCM MP-1 Section 6.0 Additional Information 3.1 Section 6. a. Project Narrative 3.1.1 Project Location and Existing Conditions The project is located on the Intracoastal Waterway at 1913 and 1917 Atlantic Drive in Wilmington, New Hanover County. The subject property is composed of two tax parcels: R04514-002-006-000 0.69 acres and R04514-002-007-000 0.70 acres. There is a single family residence located on each parcel and the site is currently vegetated with native trees, shrubs, and grasses. CAMA Major Permit 163-04 was issued to Richard & Ann Donaldson and Jan & Bruce Kirk on November 10, 2004 for construction of a shared access pier, covered gazebos, and docking facility. Normal High Water was interpreted through aerial photography and the shoreline is approximately 207'. Waters in the project area are classified as SA;ORW and are open to commercial shellfishing. There is no SAV located in or adjacent to the project area. DRG staff conducted a SAV survey on May 24, 2022 and did not locate any SAV in or adjacent to the proposed dredge area. DMF staff confirmed these findings at a site meeting on June 22, 2022. DCM Staff confirmed water depths on October 10, 2022. The area is not classified as PNA. 3.1.2 Proposed Action A sandbar to the north of the docking facility that runs north -south adjacent to the AIWW has continued to grow and migrate south since the construction of the docking facility. Due to this shoaling, access to the deeper waters of the AIWW are now restricted to periods around higher tides. To restore the historical water depths and access to deeper water, open water dredging is proposed to the original water depths that were present at the time of initial permitting. Originally, an approximate 76-foot wide by 34-foot long box cut to -2' NLW was proposed around the existing docking facility and an approximate 76-foot wide by 120-foot long box cut to -3' NLW was proposed as an access channel to the AIWW through the increasingly shallow sandbar. Based on preliminary comments from DMF and DWR staff, the -3' NLW access channel has been reduced to 50-feet wide by 120-feet long. This reduces the overall impact area and avoids the 2015 GIS mapped SAV habitat. As noted above, there is no SAV located in or adjacent to the project area. Dredging around the docking facility totals 4,200 s.f. and is proposed to -2' NLW. The proposed grade at time of dredging will connect to the equal existing grade adjacent to the AIWW channel. Bucket -to -barge excavation is proposed and approximately 380 c.y. of excavated material will be placed on DA- 228 outside of the USACE right-of-way along and adjacent to the existing dike. The dimensions of the spoil disposal area are approximately 200' x 100'. There are two accessways to the disposal area, one of which does not require USACE notification or approval. It is understood that if needed, a consent agreement must be obtained prior to crossing the USACE right-of-way to place spoil material. Typically, the landowner will coordinate this effort with the USACE prior to placement commencing. See Appendix A and C for details. The area is not classified as PNA. Due to shoaling in the project area, open water dredging is proposed to restore original water depths that were present at the time of initial permitting. An approximate 76-foot wide by 290-foot long box cut to -2' NLW to -6' NLW and will generate approximately 750 cubic yards of dredge spoil and will connect to the existing maintained channel grade. Bucket -to -barge excavation is proposed, and the excavated material will be placed on DA-248 outside of the USACE right-of-way along and adjacent to the existing dike. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 10) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 11) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. In reviewing your application, we have discovered that additional information is needed for a complete application. Please provide the following: Work Plats Per the water depths taken by the client on July 19, 2022, the NOAA water level data was 0.27ft or 0.83ft (depending on the which low tide was observed) above mean low water (MLW). This indicates that the area that is not being proposed to be dredged in front of the existing docking facility is shallower by approximately 2ft deep. This aligns with the water depths that were taken by Bryan Hall and I on October 10, 2022 on -site. Therefore, the proposed 34' x 76' basin to be dredged will not connect to deeper water. Per 7H.0208(b)(F), "any canal or boat basin shall be excavated no deeper than the depth of the connecting waters". Please update the proposed dredge footprint and excavation depths to meet this rule At this time NC DWR has expressed concerns regarding the proposed dredging in the ORW waters of the project site. At this time NC DMF has expressed concerns regarding the proposed dredging within the mapped SAV polygon from 2015. Submitted Submerged Lands Claim With the application materials you have submitted a Declaration of Final Resolution of Claim To Submerged Lands document under the name of Champ McDowell Davis. However, when I went to review the information, it appears that Winston Broadfoot is the name on the submerged lands claim. Please clarify the correct information.
