Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The Site is currently undeveloped and wooded. Several portions of the Property contain field pine and early successional weeds. Several dilapidated barns and structures are located in the southwestern portion of the Site. Piles of unused construction materials as well as trash are located along the western property line. A small pond (Pond 2) is located in the southern tip along Poole Road. Also, a stormwater detention basin is located to the east of Pond 2. This area appears to have been constructed in high ground for the purpose of stormwater treatment associated with the project Site as well as potentially the partially developed area to the east of the pond. The USACE concurred that this is a non -jurisdictional pond in high ground. The topography of the Site ranges from a high point in the northwestern corner of the Site of+/- 286 feet above mean sea level (msl), to a low point of +/- 246 feet msl along the pond at the southern boundary of the Site. 4b. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: * The project is to construct a residential development with necessary internal roads and stormwater devices. There is a stream and wetland complex on the northern side of the Site and a Pond with wetland on the southern edge of the Site. The stream and wetland to the north are completely avoided as is the pond to the south; however, there is some minor grading into the wetland area at the upper end of the Pond. Poole Road is required to be widened by the municipality and therefore, there are unavoidable, parallel buffer impacts proposed which will require compensatory mitigation ("Allowable with Mitigation upon Authorization" per the Neuse River Riparian Buffer rules). Additionally, there are proposed buffer impacts associated with the proposed SCM device which are "deemed allowable" per the Buffer Rules. The remaining jurisdictional resources on the Site are avoided. Utilities for the proposed project will connect to existing utility lines adjacent to the Site. Heavy equipment typically used for residential construction (e.g. backhoes, bulldozers, etc.) will be utilized. 5. Jurisdictional Determinations 5a. Lots were positioned to avoid fill in wetlands, streams, and buffers. Stormwater outfalls were designed to minimize impacts to riparian areas. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. Silt fencing will be installed to provide additional protection from stormwater runoff. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: General techniques include the use of construction fencing to define the construction corridor and prevent any accidental additional impacts. Equipment will be parked and cleaned in uplands away from jurisdictional areas. Work within jurisdictional areas will be conducted during periods when dry weather is predicted, and large bare areas of soil will be reseeded and protected as soon as practicable. Silt fencing and sediment basins will also be used to prevent sediment runoff into the stream and wetland areas. 2. Per the NC DWQ April 2004 Version 2.1 Cumulative Impacts policy, small scale residential development projects have a "low potential for cumulative impact" since the project already in a developed landscape (i.e. existing residences and development in the vicinity) and the area already contains the necessary infrastructure (i.e. sewer, water, electricity, etc.). The project drains to the Neuse River which is Class C; Nutrient Sensitive Waters (NSW), (i.e. not HQW or ORW). We anticipate the NCDWR will advise us if a qualitative or quantitative analysis is needed. 4. Sewage Disposal (DWR Requirement) 4a. In the NCNHP database report dated December 6, 2022, there are no threatened or endangered species on the Site. IPaC lists six T&E species, one Candidate species, one proposed species and the bald eagle as being potentially present on or near the Site. No habitat for Atlantic Pigtoe, Carolina madtom, or Dwarf Wedgemussel is present on the site due to the presence of pond dams on the Site and just north of the Site preventing aquatic life passage. Habitat for the monarch butterfly and Michaux's sumac is present on the Site. Suitable foraging habitat for bald eagle is present within 1.0 mile of the site; however, no evidence of bald eagles was present on the Site. 6. Essential Fish Habitat (Corps Requirement) 6a. The +/-26.84-acre tract is located at +/-1,200-feet west of the Hodge Road and Poole Road intersection in Knightdale, Wake County, NC. The coordinates of 35.7561 °N, 78.5218°W generally correspond to the center of the Site. Project Detail The proposed Project consists of the construction of a townhome & apartment development with associated driveways, utilities, and roads. Municipal sewer and water are available to the Site. Access to the Site will be provided via Poole Road to the south. Heavy equipment typically used for utility installation projects (e.g., backhoes, bulldozers, etc.) will be utilized. No federally threatened or endangered species are listed to occur on the Site according to the NC Natural Heritage Program (NCNHP) Database (dated December 6, 2022). The Site itself is not listed as a historic property. There are twenty-two historic properties located within 0.5 mile of the Site based on a query of the North Carolina State Historic Preservation Office (NCSHPO) database. Eighteen are designated as Surveyed Only Property, two are designated as "Surveyed Only Property - Gone, and two are designated as Blockface - Multiple Properties. Figure 4 depicts the locations of these properties in relation to the Site. Protect History The Site is currently undeveloped and wooded. Project Impacts Of the 0.45-acre of wetland on the Site, the proposed road crossing will result in 0.03 acre of permanent wetland impact and 0.023 acre of temporary wetland impact. Of the 425 liner feet of stream on the Site, there are no permanent stream or open water impacts proposed. Permanent riparian buffer impacts total 2,155 square feet in Zone 1 and 6,530 square feet in Zone 2 for the proposed road crossing and installation of drainage conveyances. No other impacts are proposed. Mitigation Permanent wetland impacts total 0.05 acre and no permanent stream impacts, therefore, no compensatory mitigation is required. Riparian buffer impacts are either "Deemed Allowable" or "Allowable Upon Authorization With Mitigation". 2,592 Zone 1 buffer mitigation is required for non -perpendicular impacts. 3,345 square feet of Zone 2 buffer mitigation is required for non -perpendicular impacts.
