The system consists of two inorganic solids settling ponds in series. The first settling pond is located directly below the flumes. The water in the first pond infiltrates into the ground or during heavy rainfall will overflow into the second settling pond. The second pond (larger of the two), has a freeboard marker. Freeboard was approximately 4 feet at the time of the inspection. There are no chemicals added to the water used in this system. Residuals removed from the settling basins are reincorporated in the saleable buckets along with mineral gem stone material. It is a condition of your permit and required by administrative code 15A NCAC 02T .0109 to request renewal of your permit at least 180 days prior to its expiration. I assume not. Also, are they all caught up with their fees? If not you could remind them that if their fees are not paid we could rescind the permit and then they would be required to resubmit an application and would likely no longer be grandfathered in as a recycle system. But they were never really recycle systems at all. They pull water from a nearby stream, wash sediment in a sluice then discharge to a pond or series of settling ponds where the water then infiltrates into the ground. The question is do we continue to inspect these facilities and call them compliant when they really do not recycle at all. It seems unfair to make these folks go back at this point and install a recycle system when they've been permitted this way all along. And is it worth it to go through a permit change (to maybe infiltration ponds?). 1 know this is small potatoes and I don't really think there is any environmental impact here just an administrative thing. Office Box 27687 Raleigh, N.C. 27611-7687 RE: Emerald Village Gern Mining Settling Basin Mitchell County APN009741/GW87120 Project No. 87162 Dear Mr. Reid: (70.4) 252-0537 In response to your letter to Ms. Scliabilin on June 26, 1987, we offer the following narrative and attached map to further clarify the operation at Emerald Village in answer to your request for additional information. The various features and components of Emerald Village are laid out approximately as shown on the attached map. Water enters the property through Hampton Branch and over a waterfall indicated as Item 1, into a pond at Mckinney Mine Number 2 indicated as Item 2. Water then flows through an open cut at point 3 located between the North Carolina Mining Museum, indicated as Item 4, and Mckinney Mine Number 2. The water then flows to the pond indicated at Mckinney Mine Number 1 at point 7. Water for flume indicated 6 is picked up in a pipe in the overflow behind "Main Street 1920's" Building indicated as item 5. This flume is only used periodically for special groups. Water in the pond at Mckinney Mine Number 1, indicated as item 8, then flows over a weir at point 9 through a corrugated metal culvert under Mckinney Mine Road, which is State Road 1100, through the pipe indicated number 10. Water is then.strained to remove any organic material before entering a junction box indicated number 11, excess water is allowed to run off_ under the driveway and out through the tailings area which has been its normal water course for sometime. This junction box is located directly in front of Discovery Mill indicated number 12, which includes the Museum of Musical Antiques, The Gem Stone Shop and Realty office. Water from junction box 11 is piped to .flumes indicated 12 and, 13 from which the water enters the silt basin in{,icated 14. William Reid July 21, 19:87 Page 2 basin is a deep pit which is cleaned approximately once per month depending on actual usage of the flumes. From there the water seeps underground and an over is provided for heavy rain to silt basin number 15 which is also a deep pit. From 15 the water seeps underground in such a manner that it appears again near the tailings pile number 16 in the draw at 17. The water then flows overland to Crabtree Creek passing under State Road 1102. The water at the bridge on State Road 1102 was clear and free flowing owing to the filtration of passing underground through the old mine tailings.. The material used in the Gem Mining operation is primarily made up from the tailings pile number 16 and mixed with mineral gem stone material and screenings from flumes 12 and 13 and remixed into ` saleable buckets at the building indicated as number 18, adjacent to flumes 12 and 13. There were no organics observed in the buckets at the time I visted the site. Silt basins 14 and 15 appeared to be functioning properly. Concerning the water supply for the various facilities: Water is supplied from a spring box on the side of the mountain indicated as number 20,. It is then piped to a hydropneumatic tank and pump indicated as number 21 between tailing pile. 16 and a borrow pit. Th.e water is supplied to buildings 12 and 4. The water system as supplemented by a well indicated as number 22, near the intersection of State Road 1100 and 1102, but the primary water supply is the spring box number .20. Sanitary facilities are provided at building 12 and 4. Buil,ding 12 is on an approved septic -tank and drain field. Building 4 has its waste' pumped to a remote drain field indicated as number 23 near the east end of the -new mine area. Ih reference to your question number 4, the old 'mining operation tailings were produced by an open pit and tunnel excavation for mining pegmatites and feldaspar. Emerald Village's gem mining operation is similiar to that carried on in areas around Franklin, North Carolina and as such should be permitted since the operation has no adverse effects on any of the area's ground water or surface water. GWJ:m1 / CC:. • Don Link Cyretha Irving Enclosure NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES RALEIGH RECYCLE SYSTEM PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Emerald Village, Inc. Mitchell County FOR THE continued operation of a wastewater recycle system consisting of two inorganic solids settling ponds in series to serve Emerald Village Gem Mine with no discharge of wastes to the surface waters, pursuant to the application received November 9, 2006, and subsequent additional information received by the Division, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a partof this permit. This permit shall be effective from the date of issuance until December 31, 2011, shall void Permit No. WQ0006406 issued February 6, 2002, and shall be subject to the following specified conditions and limitations: 1. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 2. The facilities shall be properly maintained and operated at all times. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality (Division) accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of the request will be considered on its merits and may or may not be approved. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those actions that may be required by this Division, such as the construction of additional or replacement treatment or disposal facilities. The residuals generated from these treatment facilities must be disposed in accordance with General Statute 143-215.1 and iri a manner approved by the Division. 6. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 8. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited. Freeboard in each settling, pond shall not be less than two feet at any time. 10. Any monitoring deemed necessary by the Division to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 11. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 12. The Pem-ittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall maintain an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available to the Division or other permitting authority, upon request. 13. Any duly authorized. officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the recycle system at any reasonable time for the purpose of determining compliance with this permit, may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. 14. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15A NCAC 2T .0105 (e)(3). 15. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143- 215.6C. 16. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, -rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 213.0200, erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCGO10000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 2H .0500. 17. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of this project. 18. Noncompliance Notification: The Permittee shall report by telephone to the Asheville Regional Office, telephone number (828) 296- 4500, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a basin or tank, the known passage of a slug of hazardous substance through the facility, or any other unusual circumstances; 2 b. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater treatment, such as mechanical or electrical failures of pumps, aerators, compressors, etc.; c: Any failure of a pumping station, sewer line, or treatment facility resulting, in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility; or d. Any time that self -monitoring information indicates that the facility is not in compliance with its permit limitations. Occurrences outside normal business hours may also be reported to,the Division's Emergency Management personnel at telephone number (800) 858-0368, or (919) 733-3300. Persons reporting such occurrences by telephone shall also file a written report in letter form within five'(5) days following'first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. 19. Upon classification of the wastewater. treatment and spray irrigation facilities by the Water Pollution Control System Operators Certification Commission (WPCSOCC), the Permittee shall designate and employ a certified operator to be in responsible charge (ORC) and one or more certified operator(s) to be back-up ORC(s) of the facilities in accordance with 15A NCAC 8G .0201. The ORC shall visit the facilities in accordance with 15A NCAC 8G .0204 or as specified in this permit and shall comply with all other conditions specified in these rules. 20. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension.
