D. Impact Justification and Mitigation
1. Avoidance and Minimization
la Specifically describe measures taken to avoid or minimize the proposed impacts in designing project
S &EC was hired by the current owner to delineate all wetlands, streams and buffers and obtain agency verifications The site plan was developed to
avoid all stream impacts, and minimize buffer impacts by utilizing an existing entrance drive location Wetland impacts were determined unavoidable
to provide the necessary outlet/outparcels for a viable project The wetland impacts are primarily to those within a drained pond bottom and relic
wetland channel, away from streams and buffers "W1" impact is to a non- junsdictional /isolated wetland /drained pond
lb Specifically describe measures taken to avoid or minimize the proposed Impacts through construction techniques
The limits of disturbance will be located in the field with temporary tree protection fencing A land disturbance /erosion control plan will be obtain from
the Town of Wake Forest, along with a post - construction stormwater management plan to include the Crystal Stream devices
2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State

All buffer impacts are either "exempt' or "allowable" The buffer impacts around the entrance drive from Rogers Road are less than
6h Comments 150 feet and 1/3 acre associated with the crossing This was accomplished by means of siting the crossing over the existing
entrance drive, the pipe does not need to be extended and as such new stream impacts are not required, but buffer impacts will be
necessary to obtain the required shoulders

2b Does this project require a Stormwater Management Plan?
❑X Yes ❑ No
2c If this project DOES NOT require a Stormwater Management Plan, explain why
2d If this protect DOES require a Stormwater Management Plan, then provide a brief, narrative description of the plan
The conceptual stormwater management plan (SMP) proposed for the project was presented to DWR in a pre - application meeting held on December
8, 2014 The plan includes the use of two Crystal Stream stormwater treatment devices that discharge to the floodplain well beyond any stream
buffers The Town of Wake Forest, a DWR Certified Local Goverment, has conceptually approved the SMP and will review and approve the final SMP
for the project A bypass pipe has been proposed to bypass existing offsite stormwater entering the property from Foundation Drive and maintain
hydrology to the retained wetland and stream All newly generated stormwater runoff from the project will be routed to the BMP devices for treatment
prior to discharge
