Hi Colleen, I have recently permitted a project in Cary where we received a 404/401 permit for a small development. The pond remaining onsite was determined to be a non-404 surface water by USACE early in the process and it was also reviewed by Cary and determined to be not subject to their buffer rules. As a non-404 surface water, the applicant wishes to obtain approval from the State to eliminate the pond. It is roughly .8 acre and I believe it would require submittal of an application to DWR to impact the surface water. Can you please confirm.
