Dear Mr. Slawter:
This letter is to inform you that the Division has finalized its review and the comment period is
now closed for NPDES permit NC0005312. A final copy of the permit is attached to this letter. This
permit is issued pursuant to the requirements of the North Carolina General Statute 143-215.1 and
the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency
dated December 6, 1983.
The following list has been included to outline the changes that were addressed in the draft
permit. These changes remain unchanged in the final permit.
➢ The permit expiration date has been changed. The permit renewal will expire on January 31,
2004. The expiration date has been revised so that an equal number of permit renewals will
come in at any one time. This change will allow the Division to issue permits more
efficiently.
➢ The owner's name has been changed from Chatham Manufacturing, a Division of CMI
Industries, Inc. to CMI Industries, Inc., Chatham Division. This change was made at the
request of CMI Industries.
➢ The language indicating the sample locations for upstream and downstream monitoring has
been deleted. The facility is not required to perform instream monitoring.
➢ The Division is no longer requiring facilities to perform Annual Pollutant Analysis
Monitoring (APAM) as outlined in your existing permit under Part III, Special Condition F.
The subject facility will be required to perform the 126 Priority Pollutant Analysis on an
annual basis as required by 40 CFR Part 423, Appendix A. This requirement applies to all
primary industries.

➢ The monitoring frequency for Total Nitrogen and Total Phosphorus has been changed from
monthly to weekly. The Division has included these monitoring requirements for all permit
holders in the Yadkin Basin that discharge > 0.5 MGD. The results of this additional
monitoring will be used in the development of a nutrient management strategy for the Yadkin
Basin.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such
demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The
Division may require modification or revocation and reissuance of the permit. In addition, this permit
does not affect the legal requirement to obtain other permits which may be required by the Division of
Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or
any other Federal or Local governmental permit that may be required.

SUPPLEMENT TO EFFLUENT LIMITATIONS
AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS
A.(2). Chronic Toxicity Pass/Fail Permit Limit (Qrtrly)
The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in
the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised November
1995, or subsequent versions.
The effluent concentration at which there may be no observable inhibition of reproduction or
significant mortality is 1.9% (defined as treatment two in the procedure document). The permit
holder shall perform quarterly monitoring using this procedure to establish compliance with the
permit condition. The tests will be performed during the months of February, May, August,
and November. Effluent sampling for this testing shall be performed at the NPDES permitted
final effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month in which it was performed, using the
parameter code TGP3B. Additionally, DWQ Form AT-1 (original) is to be sent to the following
address:

Test data shall be complete and accurate and include all supporting chemical/physical
measurements performed in association with the toxicity tests, as well as all dose/response data.
Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine
is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity
monitoring is required, the permittee will complete the information located at the top of the
aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county,
and the month/year of the report with the notation of "No Flow" in the comment area of the
form. The report shall be submitted to the Environmental Sciences Branch at the address cited
above.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly
monitoring will begin immediately until such time that a single test is passed. Upon passing, this
monthly test requirement will revert to quarterly in the months specified above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required,
then monthly monitoring will begin immediately until such time that a single test is passed.
Upon passing, this monthly test requirement will revert to quarterly in the months specified
above.

' Monitoring shall be performed utilizing an EPA approved method to a detection level of 1 ppb and shall coincide with whole effluent toxicity
monitoring.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

SPECIAL CONDITIONS
Should any test data from this monitoring requirement or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be
re -opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum
control organism survival, minimum control organism reproduction, and appropriate
environmental controls, shall constitute an invalid test and will require immediate follow-up
testing to be completed no later than the last day of the month following the month of the initial
monitoring.

Summary
➢ The Chatham manufacturing facility operations include
Continuous dyeing of cloth in which the material is placed in and then out of the dye
at a specific rate.
Exhaustion dyeing of fiber yarns and cloth in which the material is placed into a
container with dye until almost all of the dye is absorbed into the material.
Continuous washing and rinsing of cloth
> Facility is classified as a categorical industry. 40 CFR Part 410 "Textile Mills Point
Source" applies to the facility operations. The following subparts are applicable:
Subpart G " Stock and Yarn Finishing Subcategory" applies because the facility
operations include yarn dyeing and finishing.
Subpart D " Woven Fabric Finishing Subcategory" applies because the facility
operations include woven fabric finishing.
Subpart C "Low Water Use Processing Subcategory" applies to process wastewater
dischages resulting from yarn texturizing.

Monthly average limits were developed using 40CFR Part 410 "Textile Mills Point Source
Category" and facility specific production data. Facility operations include groundwater
remediation (remediated groundwater is discharged into their own treatment works). Monitoring for
the parameters found in the recovery wells were included in the last permit renewal. Instream
monitoring was recommended for temperature, DO, and fecal coliform. Instream monitoring was
not included in the last permit renewal. Region, please comment on this issue. Is instream
monitoring required based on the stream characteristics on the Yadkin River?

The following compliance evaluation inspection reports were prepared. The reports indicated that all
parameters on the self -monitoring forms were recorded and documented as per the requirements of
the permit. The following violations were noted:
September 4, 1998: Review of self monitoring data from July 1997 to June 1998 revealed one
daily maximum violation for TSS.

November 12, 1997: Review of self monitoring data from August 1996 to June 1997 revealed
one daily maximum violation for TSS and four daily maximum violations for BOD.
January 23, 1997: Review of self monitoring data from November 1995 to September 1996
revealed one daily maximum violation for TSS
Review of 1997 and 1998 DMR data indicated the following information (monthly average data):
Flow values ranged from 0.485 MGD to 2.4 MGD
BOD values ranged from 81.41b/day to 865.61b/day
DO values ranged from 3.33 mg/1 to 7.4 mg/1
COD values ranged from 227.91b/day to 8997.5 lb/day.
TSS values ranged from 135.71b/day to 1105.2 lb/day
Sulfide values ranged from 0.441b/day to 3.5 lb/day
Phenol values ranged from 0.291b/day to 3.61b/day
Chromium values ranged from 0.21b/day to 9.1 lb/day
Fecal values ranged from 1.4 #/100 ml to 9.0 #/100 ml
Toxicity tests appeared to be all Pass
DO levels reported in the following months are of immediate concern:
3.3 mg/1 on 12/98
3.4 mg/1 on 11/98
3.4 mg/1 on 10/98
3.3 mg/I on 8/98
3.5 mg/I on 7/98
3.8 mg/1 on 6/98
No instream data to review. Facility is currently not required to monitor instream.
