are correct, but the math associated with the Zone 2 required mitigation calculation is incorrect (1,882 times 1.5 does
not equal 1,884), which means that the total buffer mitigation required is also incorrect The buffer mitigation being

I apologize for the mathematical errors. Final impacts were calculated and the previously estimated impact totals were
changed in the application, but evidently the math /totals were not changed It was Christmas eve and the spiked egg
nog may or may not have been present. O

I hope that you are doing well I apologize for the confusion caused by the cover letter being incorrect My responses to
your questions are provided below.
1) Total permanent impacts are 0 079 acre and the temporary impacts are 0.029 acre. The quantification in the cover
letter is incorrect. -
2) Permanent impacts associated with W2 will occur from fill associated with the perimeter road. The temporary
impacts to W2 will occur from construction activities associated with the perimeter road The area of temporary impact
will be returned to original grade upon completion of construction A modified Figure 3 is attached that depicts the
areas of permanent versus temporary impacts to W2.
3) The PCN is correct and the cover letter is incorrect The cumulative permanent impacts for the T Z Osborne WRF to
date include 0 005 acre of permanent wetland impacts associated with Package 3 and 0 079 acre of permanent wetland
impact associated with Package 2. Therefore, the total permanent wetland impacts associated with the upgrade
activities at the T Z Osborne WRF to date are 0 084 acre

Thanks for your PCN and attached plans dated 12/22/2014, received 12/29/2014, for the above referenced project
have reviewed the information and offer the following comments to be addressed before your application can be
considered complete
1) The cover letter notes that impacts associated with the project include 0 096 acre of permanent impacts to wetlands
However, the PCN lists wetland impact 3 as a temporary impact, which would reduce the amount of total permanent
wetland impacts proposed to 0 079 acre. Which one is correct?
2) As described above, the PCN proposes 0.005 acre of permanent impacts to wetland 2, and 0 029 acre of temporary
impacts to wetland 2. However, the PCN doesn't clearly describe what activity will result in temporary wetland impacts
vs the permanent ones. Are the permanent impacts in wetland 2 related to perimeter road fill? If so, what will cause
the temporary wetland impacts? Also, neither Figure 3 nor the plan sheets clearly show the break between temporary
and permanent impacts to wetland 2.
3) Note that, if the PCN is correct and the use of Nationwide Permit 39 is verified for this project, than the total impacts
for the T Z Osborne single and complete project (Package 1 -3) would include 0 084 acre of permanent wetland impacts.
However, if, as the cover letter suggests all of the wetland impacts for Package 2 are permanent, then the total impacts
for the T.Z. Osborne single and complete project (Package 1 -3) would include 0 101 acre of permanent wetland impacts;
thus, per Nationwide Permit general condition 23(c), compensatory mitigation would be required in order to verify the
use of NWP 39.
Please provide the above information within 30 days of receipt of this Notification or we will consider your application
withdrawn and close the file If you have any questions please let me know

I was not involved with the stormwater permitting back in 2009, I'll work on tracking down the history of that and get
back to you.
As for the stormwater collection /conveyance system, there are three drop inlets to accept flow right around the
Secondary Clarifier 7 and 8 in the middle of the site shown on C7 and C8 in your package This is a very small portion of
the impervious area on site and is not expected to affect the time to peak or nutrient concentrations in that area by
significant amounts You are correct that the majority of the stormwater falling on the new construction will sheetflow
to the perimeter grassed swale and discharge to the farm pond.

I have Just a couple administrative clarifications /questions for this permit.
Under the stormwater questions I'm a little unclear on the master plan /grandfathering Who decided that the site was
grandfathered? Was this through the Phase II permitting process? Can you provide any documentation that is specific
to grandfathering any new BUA (roof, parking lot, new roads etc) at the plant? I Just need to be sure I've covered
everything adequately in my file
Am I correct in that the area being added for this phase does not include any stormwater collection /conveyance
system? All stormwater that hits the pad or the road will sheet flow across the area to the slopes along the edges and
that these will be vegetated. The only collection is the drainage swale that already exists and will be relocated to the
new edge of the pad?
Do you have a FONSi approval that is stamped or signed by state clearing house?

To update you on where this project stands; we have rerouted the storm drain system originally designed to outlet to a
new outfall on the northeast corner and now have it routed to combine at an existing structure, resulting in no new
storm drain outfall in the pond. We believe this decreases the original proposed impacts and I think /hope you'll like
it Now the only features outfalling to the buffer /pond is the proposed perimeter channel outletting to the same

Aaron — a plan was submitted to grandfather the site for the upcoming Phase 2 requirements, water quality The Phase 2
grandfathering process entailed a Stormwater Management Plan to be submitted and approved by December 31, 2009
Then a subsequent TRC site plan must be submitted by July 30, 2014 and approved by December 31, 2014. There was an
extension in the time from the NC Legislature for the TRC plan to be submitted The plan was 2009 -0737 titled TZ
Osborne Water Reclamation Facility SWMP. This plan was approved on July 28,2009 The subsequent TRC site plan 2013-
1054 TZ Osborne Water Reclamation Facility plan was submitted by July 30, 2014 and approved by TRC on May 8, 2014
The process was correctly done and the site was grandfathered for Phase 2 requirements

I apologize for the mathematical errors. Final impacts were calculated and the previously estimated impact totals were
changed in the application, but evidently the math /totals were not changed. It was Christmas eve and the spiked egg
nog may or may not have been present. O

Restoration Systems has reserved +/ -7,643 sqft of riparian buffer offset credits at a price of
$1.05 /sqft., making the total $8,025.15, from its Bass Mountain Mitigation Bank Parcel, DWR #09-
0622 to meet the requirements associated with permitting the project located within the Haw
River Sub - watershed of Jordan Lake, USGS HUC 03030002 of the Cape Fear River Basin. These
credits are reserved fora period of 60 days from the date of this letter, with the option to renew the
reservation upon payment of a deposit equal to 1/3 of the total dollar amount reserved
