In a -letter dated May 20, 2016, Troy Doby of: the Water Quality Permitting Section's Non - Discharge Permitting Unit. asked you to provide additional information (copy of letter attached). After review of the information provided, several points were not answered. For this reason, the permit package submitted is being returned. Specifically, the points inadequately addressed were: 1. No operational agreement was provided between West Point Place and the Brissons. (Point 1 of the Additional Information Request.) 2.. Thereis a statement that the property. on Sites 1,.2 and.3 do not in fact belong to Elizabethtown Power LLC (PIN 130200769935) as shown in the Bladen County tax records. This was checked on October 10, 2016 and this is still what is shown. A certified statement is inadequate to show ownership. If you re -submit, please provide a copy of the deed of theproperty that has been registered with the Bladen County Register of Deeds. (Point 2 of the Additional Information Request.) 3. A corrected Residuals Source Certification with the value for cresol was not provided. (Point 5 of the Additional Information Request.) Please be advised_that construction and/or operation of the subject facilities without a valid permit is a violation of North- Carolina General- Statute § 143=215.1 and may subject -the owner/operator to appropriate enforcement actions in accordance with North Carolina General Statute § 143-215.6A-6C. According to the Bladen County Tax Map,:the property on which the West Point Place, LLC facility sits is owned by Houston Nile Brisson, Jr. and Lynn S. Brisson (PIN 130200734771; DB:0728, Page 0652; Address: P. O. Box 844, Elizabethtown, NC 28337-0844). To renew the permit, please provide a copy of an agreement between West Point Place and Brisson for West Point Place to be the Permittee. Conversely, Brisson may be the Perlittee. Certification form indicating that Elizabethtown Power LLC is the owner of Sites 1, 2 and 3. A copy of this form is attached. 5. On page 2 of the Residuals Source Certification form RSC 11-13, in the table in II.3.b, no value for cresol was provided. Please provide this value (<0.025) and submit a corrected page. 6. Please note, that there was not a complete Operations & Maintenance (O&M) Plan submitted with the renewal application. Some elements of the O&M Plan were present, such as process flow diagram, sludge management plan, and sampling plan. WEST POINtPLACE, LLC Sludge Management Plan West Point Place, LLC owns but doesn't operate it's Elizabethtown, NC wastewater treatment plant. This plant was in place for treating a textile dying process and has been closed to production: since year 2000. The residualsaccumulation in the aeration basin,, clarifiers, and polishing pond will. requite, cleaning and disposal. This requirement is in place as part of the process for rescinding NPDES Permit NC0003522. The owner intends to remove residuals from these locations and surface apply them to the. existing land applicationsites while maintaining the allowable nutrient loading rates and vegetative cover crops. The land application public access controls will include posting of signs with a minimum area of 3 square feet. Each sign will indicate the activities conducted at each site, permit number and name and contact information. Application rates will be monitoredso as nqt to exceed agronomic:loadings. No residuals. will be land applied during iiicleinent weather or unti124 hours following a rainfall event of % inch or greater in 24 hours. All buffer zones, specifications •and restrictions required by NCDENR governing land application will be accomplished. The date, volumes, site location, pounds per acre, and weather conditions willbe recorded and incorporatedinto the annual report. This annual report will also include, though not, limited- to, yearly soil evaluations, all residuals analysis, loading records of residual constituents, and quantities of applications. Alamac Knit Fabrie'was acquired by West Point. Place, LLC on August2003. The wastewater treatment facility receives' stormwater only. Upon completion of removal and, disposal of residuals, permits WQ0004227 and NC0003522 will be requested for , rescission. A request could be made to the Division to exceed the annual dry tons for a one time application event; but detailed documentation on total PAN to be managed, along with proposed acreage and crop or crops to be planted to manage the nutrients would be 'needed. In looking at the field summary forms supplied in the attachment above; Site 2 and Site 3B (there isn't a 3A or 3B in the 2007 permit, only Site/Field 3 and the renewed permit will be the same) indicate the crop to be Bermuda. When was Bermuda established on these sites? Bermuda would be acceptable to land "apply to if it was already established for these two fields (as Site/Field/Tract 1 is) and WestPoint Place was planning to grow and have multiple harvest episodes during the growing year of the Bermuda. Also, if all material was to be land applied above the -'annual dry ton limit (but within the total PAN limit for soils and crop), several years of monitoring would be needed to assess carryover nitrogen management and crops planted (grain sorghum, rye, oats, corn, soybeans, etc. or multiple cropping's of Bermuda) prior to consideration of permit rescission. Also in looking at the information provided in the permit renewal document under the RESIDUALS SOURCE CERTIFICATION section, page 5 of 5; the Vector Attraction Reduction ("VAR) method indicated is Alternative 1 (38% Volatile Solids Reduction — Aerobic/Anaerobic Digestion). If_this method is to be utilized, a known volatile solids percentage on the sludge discharged to the lagoon (from 10/15/20 years ago) would be needed to be know if the 38%, reduction was met. -If would appear that Alternative 10 — Incorporation would be more appropriate given the circumstances. ADDITIONAL REGIONAL STAFF REVIEW ITEMS , The West Point Place (WPP) permit is being renewed to allow for the application of lagoon residuals/soils for the final closure of the NPDES permit for the facility. The wastewater system at WPP has been off-line since early 2000 • when WPP purchased the former textile facility from Alamac Knits (sister facility to the current Alamac Knits facility in Lumberton). WPP facility is currently being utilized by Houston's Peanut processing for warehouse space and some production of peanut products. The WPP is connected to the Town of Elizabethtown wastewater collection system with all wastewater flow going to the Elizabethtown wastewater treatment plant. The existing fields at the WPP facility should be adequate to manage the materials to be applied for the lagoon closure. Multiple years of application may be necessary due to the 60 dry. tons/year application rate in the current permit. Once the facility establishes the final volume of material to be land applied for the lagoon closure; WPP can request a permit modification to address the total volume of material to be land applied in 2016 or transfer that volume exceeding 60 dry tons to McGill Environmental in Sampson County. See attached maps for fields at the WPP facility. The predominant soil types for each Tract/Field should be as follows: Tract l:+.Norfolk (NoA); Tract 2: Norfolk (NoA); Tract 3: Wagram (WaB); Tract 4: Blanton (BnB); Tract Four acreage has been reduced slightly due to the construction of an equipment storage building and the 2.50 acre area depicted on the soils map is reasonably accurate based on field measurements taken with a range finder during the permit renewal site visit. Sludge Management Plan West Point Place, LLC owns but do not operate it's Elizabethtown, North Carolina wastewater treatment plant which was in place for treating a textile dying process that has been closed to production since year 2000. The residuals accumulation in the aeration basin, clarifiers, and polishing pond will require clean up and disposal to comply with rescinding NPDES permit number NC0003522. The new owner intends to remove residuals from these locations and surface apply. them to the existing land application sites maintaining cover crops of coastal Bermuda and loblolly pines. The land application sites will be clearly posted, LAND APPLICATION OF RESIDUALS, NO TRESPASSING. Application rates will be monitored so as not to exceed agronomic loadings. No residuals will be land applied during inclement weather or until 24 hours following a rainfall event of %: inch or greater in 24 hours. All buffer zones, specifications and restrictions required by NCDENR governing land application will be accomplished. The date, volumes, site location, pounds per acre, and weather conditions will be recorded and incorporated into the annual report. Alamac Knit •Fabrics was acquired by West Point Place, LLC on August 2003. The textile facility ceased operations and the building is being used as a warehouse. There are no regular employees at this site. The wastewater treatment plant receives stormwater and a minimal amount of domestic flow.
