WEST POINT PLACE, LLC
Sludge Management Plan
West Point Place, LLC owns but doesn't operate it's Elizabethtown, NC wastewater
treatment plant. This plant was in place for treating a textile dying process and has been
y closed to production since year 2000.
The residuals accumulation in the aeration basin, clarifiers, and polishing pond will
require cleaning and disposal. This requirement is in place as part of the process for
rescinding NPDES Permit NC0003522.
The owner intends to remove residuals from these locations and surface apply them to the
existing land application sites while maintaining the allowable nutrient loading rates and
vegetative cover crops.
�1 The land application public access controls will include posting of signs with a minimum
area of 3 square feet. Each sign will indicate the activities conducted at each site, permit
number and name and contact information.
Application rates will be monitored so as not to exceed agronomic loadings. No residuals
will be land applied during inclement weather or until 24 hours following a rainfall event
of %2 inch or greater in 24 hours. All buffer zones, specifications and restrictions required
by NCDENR governing land application will be accomplished.
The date, volumes, site location, pounds per acre, and weather conditions will be
recorded and incorporated into the annual report. This annual report will also include,
though not limited to, yearly soil evaluations, all residuals analysis, loading records of
residual constituents, and quantities of applications.
Alamac Knit Fabric was acquired by West Point Place, LLC on August 2003. The
wastewater treatment facility receives stormwater only. Upon completion of removal and
disposal of residuals, permits WQ0004227 and NC0003522 will be requested for
rescission.

General — This document is an agreement between the Applicant and land owner(s) of residualsreceiving sites for land application of
Class B residuals (may include water treatment plant or other type residuals) in accordance with l5A NCAC 02T .1100. Do not
submit this agreement for review without a corresponding application form (FORM: RLAP 06-16).
Unless otherwise noted, the Applicant shall submit one original and two copies of the application and supporting documentation listed
below.
A. Land Owner Agreement (FORM: LOA 06-16):
❑ Submit the completed and appropriately executedLand Application Site Certification (FORM: LASC 06-16) form. Please do
not make any unauthorized content changes to this form. If necessary for clarity or due to space restrictions, attachments to
the application may be made, as long as the attachments are numbered to correspond to the section and item to which they
refer.
❑ Prepare a separate agreement for each set of land application sites that are owned or operated by an entity other than the
Applicant.
❑ A copy of the completed and appropriately executed agreement must be provided to the landowner and the lessee/operator.

The landowner or his representative receives, in consideration, full use of the nutrient value of the applied residuals while the
Permittee receives, in consideration, the use of the land application site(s) described above for the disposal of the residuals.
This Agreement shall remain in effect for the length of the Division's permit for the residuals land application program and
shall be renewed each time this permit is renewed.
The undersigned landowner or his representative and the Permittee agree to abide with the following restrictions and
stipulations until such time as written notification, given 30 calendar days in advance, modifies or cancels this Agreement.

WHEREAS, during or about September 2000, Dyersburg Corporation, Dyersburg
Fabrics Limited Partnership I, Dyersburg Fabrics, Inc., United Knitting, Inc., United Knitting
Limited Partnership, I, IQUE, Inc., IQUE Limited Partnership, I, Alamac Knit Fabrics, Inc.,
AM, Inc.$ IQUEIC, Inc., UKIC, Inc., Alamac Enterprises Inc., and Alamac Knit Fabrics LLC
(collectively, "Debtors"), filed, in the District of Delaware ("Bankruptcy Court"), petitions for
relief under Chapter I 1 of the Bankruptcy Code styled In re Maniac Knit Fabrics, Inc., 00-3746
through 00-3759 ('Bankruptcy Cases").
WHEREAS, substantially all of the real property of the Debtors was encumbered by and
subject to a certain Pre -Petition Loan Agreement in favor of Fleet National Bank, as agent for
the benefit of Lenders who are parties thereto ("Fleet").

WHEREAS, pursuant to Financing Orders in the Bankruptcy Cases, Fleet, as collateral
agent for certain lenders, was granted a -first priority lien and security interest in all of the real
property in which the Debtors had any right, title, or interest.
WHEREAS, on September 19, 2002, the Bankruptcy Court converted the Bankruptcy
Cases from Chapter 11 to Chapter 7 and appointed as trustee, Montague Claybrook ("Trustee").
WHEREAS, as a result of defaults under the Loan Documents and after issuance of a
notice of default under the terms of the Financing Orders, Fleet filed a complaint ("Complaint")
against the Trustee in the United States District Court for Northern District of Georgia
("Receivership Court") seeking, among other things, the appointment of a receiver for the

property forming the collateral for obligations owed by the Debtors to Agents and Lenders,
including, without limitation, the Subject Property, which complaint was styled as Fleet National
Bank v. Montague Claybrook as the Chapter 7 Trustee, Case No. 1 03-CV-0116 (N.D.Ga. 2003)

("Receivership Case").
WHEREAS, after the filing of the Complaint and upon notice to the Trustee, pursuant to
the order entered on even date with the commencement of the Receivership Case ("Receivership
Order"), the Receivership Court appointed Kevin O'Halloran as the Receiver of the assets of the

Receiver Estates, which include all real property in which either the Trustee or Debtors have any
right, title, or interest.

WHEREAS, under the Receivership Order, Mr. Kevin O'Halloran was appointed
Receiver of the Subject Property.
WHEREAS, the Receivership Order provides the Receiver with the authority to sell and

dispose of the assets of the Receiver Estates, including the Subject Property, with the express
written consent of Fleet, as agent for the benefit of certain lenders.

WHEREAS, the Receiver and the Purchaser entered into a certain agreement, under
which the Purchaser agreed to purchase all of the right, title, and interest in the Subject Property

WHEREAS, by Order of the Receivership Court in the Receivership Case, entered on
July 3, 2003 ("Approval Order"), the Receiver was authorized to sell all such right, title, and

NOW THEREFORE, Receiver, as Grantor and pursuant to his power as Receiver and
acting by virtue of the power and authority contained and as set forth in the Receivership Order

Court, Northern District of Georgia, Atlanta Division in Civil Action No. 1:03 cv 116 — JTC,
entered on July 3, 2003, a copy of which is attached as EXHIBIT `B" hereto ("Approval

There are three forms of cresol: ortho-cresol (o-cresol), meta -cresol (m-cresol), and
para-cresol (p-cresol). These forms occur separately or as a mixture, which can also
be called cresol or more specifically, tricresol.
My laboratory (Microbac Laboratories, Inc.) verified that the TCLP Parameter
Cresol was reported as o-cresol, m-cresol, and p-cresol which would equal cresol.
I have amended the TCLP Parameter report to reflect a test result of <0.025 mg/1
for cresol.

5. The Fayetteville Regional Office, telephone number (910) 433-3.300, shall approve monitoring wells
MW-I, MW-2, MW-3, MW-4, MW-5, MW-6, MW-7, MW-8 and MW79 prior to installation, and the
monitoring wells shall be installed prior to beginning waste disposal operations. The regional office
shall be notified at least 48 hours prior to the construction of any monitoring well, and such notification
to the regional supervisor. shall be made from 8:00 a.m, until 5:00 p.m. on Monday through Friday,
excluding State Holidays. ,The monitoring wells shall be constructed such that the water level in the
well is never above or below the screened (open) portion of the well at any time during the year, and in
accordance with 15A NCAC 02C .0108. The general location and name for each monitoring- well is
marked on Figure I. [15A NCAC 02C .0108, 02T .01.08(b)(2)],
