Dear Mr. Bailey:
We are requesting a Section 404 Regional General Permit (RGP) 50 for work associated with the road
widening of SR 1007 (Randleman Road) between Glendale Drive and West Elmsley Drive in Guilford
County (See Attachment A). The project proposes to widen SR 1007 (Randleman Road) to two 11-foot
wide travel lanes in each direction and a continuous 11-foot wide center turn lane with curb and gutter.
Additionally, the project proposes the construction of contiguous 5-foot to 6-foot wide sidewalks on both
sides of the roadway. The project includes the construction of an approximately 200-foot long retaining
wall along the frontage of New Goshen United Methodist Church on the west side of SR 1007
(Randleman Road). The project also requires tie-ins at the intersections of Glendale Avenue, Shoffner
Court, and Nestleway Drive/W. Elmsley Drive. The tie-in at Nestleway Drive/W. Elmsley Drive will
extend approximately 250 feet west of the intersection on Nestleway Drive and will extend approximately
475 feet east of the intersection on W. Elmsley Drive. Additional improvements include tie-ins to eight
existing driveways along the project corridor. The project is located in the Jordan Lake watershed and is
classified as Water Supply V (WS-V) with a Nutrient Sensitive Waters (NSW) supplemental
classification and is subject to Jordan Lake Buffer Rules. Enhanced erosion control measures (known as
Design Standards in Sensitive Watersheds) have been implemented for the project. A delineation of
Waters of the U.S. was conducted on July 3, 2018 and verified by representatives from the USACE
(David Bailey) and NCDWR (April Norton) on February 26, 2019 (See Attachment B). As part of the
environmental review, a Minimum Criteria Determination Checklist was completed for the project (See
Attachment Q. The project is located outside of a FEMA regulated floodplain or floodway (See
Attachment D)
The project will temporarily impact 53 linear feet and permanently impact 29 linear feet of Stream B for
drainage improvements associated with the road widening. There will be 0.03 acre of temporary impacts
to Wetland A for hand clearing and 0.13 acre of temporary impacts to Wetland B for hand clearing within
an overhead utility easement. There will be 0.08 acre of permanent fill impacts to Wetland B for roadway
widening. There will be an additional 0.03 acre temporary impacts and less than 0.01 acre of permanent
fill impacts to Wetland B for drainage improvements along Stream B associated with the roadway
widening. There are 6,991 sq. ft. of mitigable riparian buffer impacts (including 6,339 sq. ft. in Zone 1

and 652 sq. ft. in Zone 2). There is 584 sq. ft. of wetland fill impacts which overlap with mitigable Zone
2 impacts which will be excluded from mitigation totals (See Attachment E).
Section 106
Section 106 of the National Historic Preservation Act of 1966 requires Federal agencies to take into
account the effects of their undertakings on historic properties. NCDOT Cultural Resource staff reviewed
the project for Historic Architectural and Archaeological Resources. A Historic Architecture and
Landscapes Assessment of Effects Form was provided by a NCDOT Architectural Historian on August
19, 2021. A No Archaeological Survey Required Form was provided by a NCDOT Archaeologist on
February 15, 2018 (See Attachment F).
Protected Species
The U.S. Fish and Wildlife Service's (USFWS) Information for Planning and Consultation (IPaQ
website lists Schweinitz's sunflower (Helianthus schweinitzii) as endangered, and small whorled pogonia
(Isotria medeoloides) as threatened within the study area. There is marginal habitat in the study area for
Schweinitz's sunflower and small whorled pogonia. No Schweinitz's sunflowers or small whorled
pogonia were found during field surveys of the study area conducted on July 3, 2018, and September 8,
2021. A search of the North Carolina Natural Heritage Program (NCNHP) database, accessed September
13, 2022, found no occurrences of Schweinitz's sunflower or small whorled pogonia within 1.0 mile of
the study area. Due to marginal habitat throughout the majority of the study area and based on the
findings of the literature review and completed survey conducted during the optimal survey window it is
determined that the project would have a biological conclusion of "No Effect" for Schweinitz's
sunflower. Due to protected species surveys for small whorled pogonia only being valid for one year a
biological conclusion of "Unresolved" was reached. NCDOT has committed to surveying for small
whorled pogonia before construction.
Bald eagles are protected under the Bald and Golden Eagle Protection Act. A desktop-GIS assessment of
the study area, as well as the area within a 1.13-mile radius (1.0 mile plus 660 feet) of the project limits
was performed. No water bodies large enough or sufficiently open to be considered potential feeding
sources were identified. Since there was no foraging habitat within the review area, a survey of the study
area and the area within 660 feet of the project limits was not conducted. Additionally, a review of the
NCNHP database on September 13, 2022, revealed no known occurrences of this species within 1.0 mile
of the study area. Due to no nests or eagles being identified during the survey, no known occurrences
within a mile, and minimal impact anticipated for this project, it has been determined that this project will
not affect bald eagles (See Attachment G).

Dear Mr. Parker:
On February 26, 2019, the North Carolina Division of Water Resources (NCDWR), along with the Army Corps of
Engineers (Corps), and consultants representing the North Carolina Department of Transportation conducted an onsite
determination to review drainage features described in Table 1 regarding applicability to mitigation and buffer
requirements.
NCDWR acknowledges the areas and boundaries identified as jurisdictional wetlands by the USACE. The attached
map(s) accurately depicts stream determinations conducted during the site visit.

Protect Description: The North Carolina Department of Transportation (NCDOT)
Division 7 plans to widen an approximately 0.4-mile section of SR 1007 (Randleman
Road) between Glendale Drive and W. Elmsley Drive.
The proposed project is included in NCDOT's 2020-2029 State Transportation
Improvement Program published in September 2021 as U-5850. The purpose of project is
to relieve traffic congestion.
SR 1007 (Randleman Road) is currently a three -lane roadway with two 12-foot through
lanes and a 12-foot center turn lane between Glendale Drive and West Elmsley Drive.
North of Glendale Drive, SR 1007 (Randleman Road) is five lanes with four 11-foot wide
through lanes and an 11-foot wide center turn lane. SR 1007 (Randleman Road) is
functionally classified as a minor arterial and had a 2020 Average Daily Traffic (ADT) of
15,600 vehicles -per -day (vpd). Existing sidewalks extend approximately 500 feet north of
the W. Elmsley Drive intersection and approximately 300 feet south of the Glendale Drive
intersection on the east side of SR 1007 (Randleman Road). The posted speed limit along
SR 1007 (Randleman Road) varies between 35 miles per hour (mph) and 45 mph within
the Project Study Area (PSA). Existing right-of-way width in the project corridor varies
between approximately 60 feet to 70 feet.
The project proposes to widen SR 1007 (Randleman Road) to two 11-foot wide travel lanes
in each direction and a continuous 11-foot wide center turn lane with curb and gutter.
Pending a municipal agreement with the City of Greensboro, the project proposes the
construction of contiguous 5-foot to 6-foot wide sidewalks on both sides of the roadway.
The project includes the construction of an approximately 200-foot long retaining wall
along the frontage of New Goshen United Methodist Church on the west side of SR 1007
(Randleman Road). The project also requires tie-ins at the intersections of Glendale
Avenue, Shoffner Court, and Nestleway Drive/W. Elmsley Drive. The tie-in at Nestleway
Drive/W. Elmsley Drive will extend approximately 250 feet west of the intersection on
Nestleway Drive and will extend approximately 475 feet east of the intersection on W.
Elmsley Drive. Additional improvements include tie-ins to eight existing driveways along
the project corridor; further coordination may be required with property owners to ensure
property access during the construction phase.
The project is located approximately 4.8 miles south of downtown Greensboro. Land use
within the PSA primarily consists of undeveloped lands and commercial, medium density

Rosenwald School (GFI I IS) historic property is located within the PSA on the west side
of SR 1007 (Randleman Road) across from Shoffner Court. NC SHPO determine this.
historic property to be eligible for listing on the National Register (NR) in August 2019.
Preliminary design plans anticipate construction easement and right-of-way impacts to the
historic property. Proposed improvements would require approximately 0.07 acres of right-
of-way acquisition and approximately 0.05 acres of temporary construction easement from
the property. Based on SHPO coordination, the project is expected to have No Adverse
Effect on the property.
Additionally, an unnamed tributary of Ryan Creek runs along the east side of SR 1007
(Randleman Road) within the PSA. It is anticipated that approximately 50 feet of stream
would be impacted by the proposed improvements.
Proposed right-of-way varies and is anticipated to be approximately 90 feet at its widest
point. Preliminary plans would require approximately 0.40 acres of proposed right-of-way
acquisition and approximately 1.27 acres of proposed construction and utility easements.
Residential and business relocations are not anticipated. The project is scheduled for right-
of-way in September 2022 and has a LET date of February 2023.
Purpose and Need: The purpose of the proposed project is to relieve traffic congestion
along SR 1007 (Randleman Road).
Anticipated Permit or Consultation Requirements:
A Nationwide Permit (NWP) No. 14 `Linear Transportation Projects' or a Regional
General Permit (RGP 50) may be applicable for the discharge of fill material into waters
of the U.S. associated with roadway construction activities such as road extensions, and/or
intersection improvements. The United States Army Corps of Engineers (USACE) holds
the final discretion as to what permit will be required to authorize project construction. If
a Section 404 NWP No. 14 is required, then a Section 401 Water Quality Certification
(WQC) 4088 Water Quality Certification (WQC) 4135 goes with the NW14 and the RGP
50 from the North Carolina Division of Water Resources (NCDWR) will be needed. If
impacts to waters exceed 300 linear feet, or 0.5 acre in area, an Individual Permit will be
required.
Two potential jurisdictional streams were identified in the study area. All jurisdictional
streams in the study area have been designated as warm water streams for the purposes of
stream mitigation. No streams within the study area have been designated as an
Outstanding Resource Water (ORW). There are no designated High -Quality Waters
(HQW) or water supply watersheds (WS-I or WS-II) within or within 1.0 mile downstream
of the study area. The North Carolina 2016 Final 303(d) list of impaired waters identifies
no waters within the study area as an impaired water. No other surface waters were
identified in the study area.
Cultural Resources: A No Archaeological Survey Required Form was provided by
NCDOT Archaeologist on February 15, 2018.

A Historic Architecture and Landscapes survey found that Area of Potential Effects
contains a number of properties over 50 years of age, including the Goshen School
(GF I IS 1) which has been determined eligible for National Register (NR) listing. These
findings resulted in a Survey Required Form from NCDOT Architectural Historian on
February 5, 2018. An Effects Assessment Required Form was provided by the NCDOT
Architectural Historian on April 23, 2019 due to the presence of the Goshen School
(National Register eligible) within the Area of Potential Effects. An Eligibility Report was
submitted to NC SHPO on June 29, 2019 to determine if the property remained eligible for
NR listing and if so, to draw an appropriate historic boundary. In a letter dated August 2,
2019, NC SHPO concurred with the recommendation that the New Goshen United
Methodist Church and Rosenwald School (GF I I IS) are eligible for NR listing.
On August 19, 2021, an Effects Meeting was held resulting in a No Adverse Effect ruling
with the Environmental Commitments. The Effects Meeting determined that 3-feet high
retaining wall will reduce the amount of right-of-way encroachment on the existing historic
property boundary. The utilities will remain in their current location. The planned retaining
wall will have a brick veneer to match the historic church and school buildings. Temporary
orange fencing will be erected around the church sign, historic marker, and trees during
construction.
Threatened and Endangered Species: As of October 5, 2018, the United States Fish
and Wildlife Service (USFWS) lists two federally protected plant species and two fish
species in Guilford County. ESA federally protected species listed for Guilford County
include Schweinitz's sunflower, Small whorled pogonia, Cape Fear shiner and Roanoke
logperch. The biological conclusion for Schweinitz's sunflower, Cape Fear shiner and
Roanoke logperch is "no effect." The biological conclusion for the Small whorled pogonia
is unresolved pending an updated field survey.
Suitable habitat for Schweinitz's sunflower is present in the study area along roadside
shoulders. Schweinitz's sunflower (Helianthus schweinitzii) was added to the Guilford
County list on October 5, 2018. A plant by plant survey was conducted on September 8,
2021. No individuals of Schweinitz's sunflower were observed and the field survey was
conducted during the flowering season. A review of NCNHP records on September 10,
2021 indicates no known occurrences within one mile of the study area and no effect to
Schweinitz's sunflower is anticipated.
Potential habitat for the Small whorled pogonia exists within limited areas of the forests of
the study area. Plant by plant surveys were conducted throughout areas of suitable habitat
on July 3, 2018 during the flowering season. No individuals of small whorled pogonia were
observed. There are records of small whorled pogonia being located in Guilford County,
but no records of small whorled pogonia being located in the study area USGS topographic
quadrangle. The NCNHP website was reviewed (September 10, 2021) to determine the
locations of the nearest populations of small whorled pogonia. The NCNHP determined
that no populations of small whorled pogonia were present within one mile of the study
area. Since field surveys for the small whorled pogonia are effective for one year, the
biological conclusion for the species is unresolved; an updated field survey will need to be

conducted during the flowering season to render a biological conclusion for the species
before construction begins. A project commitment to resolve the biological conclusion for
the small whorled pogonia is added to the Greensheet on the final page of the MCDC
document.
Potential habitat for the Cape Fear shiner does not exist in the project area streams. No
formal survey for Cape Fear shiner was performed. There are records of Cape Fear shiner
being located in Guilford County, but no records of Cape Fear shiner being located in the
study area. The NCNHP website does not list Cape Fear shiner and the USFWS IPaC has
determined that no populations of Cape Fear shiner were present within one mile of the
study area, so no effect to Cape Feat- shiner is anticipated.
Potential habitat for the Roanoke logperch does not exist in the project area streams. No
formal survey for Roanoke logperch was performed. There are records of Roanoke
logperch being located in Guilford County, but no records of Roanoke logperch being
located in the study area. The NCNHP website does not list Roanoke logperch and the
USFWS IPaC has determined that no populations of Roanoke logperch were present within
one mile of the study area, so no effect to Roanoke logperch is anticipated.
Guilford County added the Atlantic pigtoe (Fusconaia masoni) mussel as a newly listed
"threatened" species in late 2019. Although a small portion of Guilford County is within
the range by basin for Atlantic pigtoe, the USFWS has determined that the U-5850 project
site is not within the drainage basin range of the Atlantic pigtoe.
The US Fish and Wildlife Service (USFWS) has revised the previous programmatic
biological opinion (PBO) in conjunction with the Federal Highway Administration
(FHWA), the US Army Corps of Engineers (USACE), and NCDOT for the northern long-
eared bat (NLEB) (Myotis septentrionalis) in eastern North Carolina. The PBO covers the
entire NCDOT program in Divisions 1-8, including all NCDOT projects and activities.
Although this programmatic covers Divisions 1-8, NLEBs are currently only known in 22
counties, but may potentially occur in 8 additional counties within Divisions 1-8. NCDOT,
FHWA, and USACE have agreed to two conservation measures which will avoid/minimize
mortality of NLEBs. These conservation measures only apply to the 30-current
known/potential counties of the PBO at this time. The programmatic determination for
NLEB for the NCDOT program is May Affect, Likely to Adversely Affect. The PBO will
ensure compliance with Section 7 of the Endangered Species Act for ten years (effective
through December 31, 2030) for all NCDOT projects with a federal nexus in Divisions 1-
8, which includes Guilford County, where U-5850 is located.
Bald Eagle and Golden Eagle Protection Act: The bald eagle (Haliaeetus
leucocephalus) is protected under the Bald and Golden Eagle Protection Act, and enforced
by the USFWS. Habitat for the bald eagle primarily consists of mature forests in
proximity to large bodies of open water for foraging. Large dominant trees are utilized
for nesting sites, typically within 1.0 mile of open water.
A desktop-GIS assessment of the study area, as well as the area within a 1.0-mile radius

of the project limits, was performed on July 6, 2018 using NC OneMap color aerials. No
water bodies large enough or sufficiently open to be considered potential feeding sources
were identified. Since there was no foraging habitat within the review area, a survey of
the study area and the area within 660 feet of the project limits was not conducted.
Additionally, a review of the NHP database on July 6, 2018 revealed no known
occurrences of this species within 1.0 mile of the study area. Due to the lack of habitat,
known occurrences, and minimal impact anticipated for this project, it has been
determined that this project will not affect this species.

Design Exceptions: There are no anticipated design exceptions for this project.
Pedestrian and Bicycle Accommodations: Pending a municipal agreement with the City
of Greensboro, the project proposes the construction of contiguous 5-foot to 6-foot wide
sidewalk on both sides of the SR 1007 (Randleman Road) extending the entire length of
the project corridor. The proposed sidewalk will tie -into the existing sidewalks along the
project corridor. SR 1007 (Randleman Road) is not an NCDOT bike route.
Utility: Overhead transmission lines cross the project corridor; the transmission lines are
owned by Duke Energy. Coordination with Duke Energy has begun and will continue as
design progresses to address any utility impacts.
Alternatives Discussion:
No -Build Alternative: The No -Build Alternative would not address the need to relieve
traffic congestion along the project corridor, therefore it is not considered a viable option.
Build Alternative: The Build Alternative includes the following improvements:

Widen SR 1007 (Randleman Road) to include five 11-foot wide lanes consisting of
two travel lanes in each direction and a center turn lane with curb and gutter;
Construct contiguous 5-foot to 6-foot wide sidewalk on both sides of the roadway,
Construction of an approximately 200-foot long brick retaining wall along the
frontage of New Goshen United Methodist Church; and,
Construct tie-ins at the intersections of Glendale Avenue, Shoffner Court, and
Nestleway Drive/W. Elmsley Drive.
Other Agency Comments:
Start of Study Letters: Start of Study Letters were sent to agencies on 9/28/2018. Agency
input is summarized below.
NCDEQ — Division of Water Resources
DWR noted that Ryan Creek and an Unnamed Tributary to Ryan Creek are within the
Project Study Area. Ryan Creek and the Unnamed Tributary to Ryan Creek are classified
as water supply - five (WS-V); nutrient sensitive waters (NSW). The streams are not
classified as 303(d) waters of the state.
NCDWR is concerned with sediment and erosion impacts that could result from this
project. The NCDWR recommends protective sediment and erosion control Best
Management Practices (BMPs) be implemented to reduce further degradation to Ryan
Creek and tributaries. To meet the requirements ofNCDOT's National Pollutant Discharge
Elimination System (NPDES) permit NCS0000250, NCDWR requests that road design
plans provide stormwater runoff treatment through BMPs as detailed in the most recent
version of NCDWR Stormwater Best Management Practices. Additionally, the project is
located within the Jordan River Riparian Buffer Basin. Riparian buffer impacts should be
avoided and minimized to the greatest extent possible pursuant.
Response: Impacts to jurisdictional wetlands and potential jurisdictional streams are
anticipated to be minor. Roadway design plans were generated to minimize stream
impacts. All necessary mitigation efforts and agency coordination will be conducted by
NCDOT moving forward.
Roadway impacts to the stream buffers are likely unavoidable due to the location of the
existing roadway and the location of the Unnamed Tributary to Ryan Creek and Ryan
Creek. Roadway and utility easement uses within the stream buffers are existing and
ongoing and are therefore exempt fi^om the Jordan Lake water supply riparian buffer rules.
Proposed roadway improvements would require the project meet the diffuse flow
stormwater requirement of the Jordan Lake water supply riparian buffer rules.
U.S. Army Corps of Engineers (USACE)
The USACE specified that the construction of this project is likely to impact aquatic
resources within the work corridor, including two unnamed tributaries to Ryan Creek and
two wetland areas. They noted that much of the PSA is previously developed, although
areas in the southern and northeastern extents of the PSA contain landscape positions
typical of wetlands. Discharges of dredged or fill material into jurisdictional waters of the

United States are subject to USACE regulatory authority pursuant to Section 404 of the
Clean Water Act, and thus would require Department of the Army (DA) permit
authorization. The type of DA authorization required (i.e., general or individual permit)
will be determined by the location, type, and extent of jurisdictional area impacted by the
project, and by the project design and construction limits. One aspect of the project that
will require additional information for the Corps' single and complete project determination
will be justification of logical termini for the project. The USACE was unable to determine
permitting requirements because detailed delineation of the streams and/or wetlands had
not been undertaken when the Start of Study Letters were sent.
Response: Roadway design plans were generated to minimize impact to aquatic resources.
Minor stream and wetlands impacts are anticipated. A Nationwide Permit (NWP) No. 14
'Linear Transportation Projects' may be applicable for the discharge of fill material into
waters of the U.S. associated with roadway construction activities such as road extensions,
and/or intersection improvements.
The U.S. Fish and Wildlife Service, U.S. Forest Service, the NC Division of Parks and
Recreation, and the NC Wildlife Resource Commission provided no specific concerns
regarding the project.
U.S. Environmental Protection Agency, NCDOT Board of Transportation, Greensboro
Urban Area MPO, and Guilford County Transportation Department did not provide a
response to the start of study letters.
Local Input Forms: Local Input forms were sent to City of Greensboro Planning
Department, Guilford County Planning & Development Department, the Guilford County
School Director of Transportation and Guilford County Emergency Services Director.
Completed input forms were not received from Guilford County Planning & Development
Department.
The City of Greensboro Planning Director completed an input form on August 14, 2018
and indicated that the project will have a low impact on local planning objectives. The
Planning Director specified that the project corridor does not possess adequate pedestrian
and bicycle facilities and identified possible EJ and LEP populations in close proximity to
the project. Additional coordination with the City of Greensboro Planning Department was
conducted in preparation for the February 5, 2019 Public Meeting. The City of Greensboro
recommended having a Spanish -language interpreter available for the Public Meeting.
Response: Comment noted; a Spanish interpreter was made available at the Public
Information Meeting.
The Guilford County Schools Director of Transportation completed an input form on
August 15, 2018 and noted that at least 17 buses making at least 29 trips travel through the
project corridor daily. Guilford County Schools indicated that current school bus routes
could be re-routed around the project corridor and that the detour would be minimal and
therefore did not have any special concerns regarding the project. The Director of
Transportation recommended contacting Guilford County Schools Assistant Director of
Transportation to provide input regarding the project. The Assistant Director of

Transportation attended the Local Officials Informational Meeting held on January 22,
2019 and did not express any special concerns regarding the project.
Response: Comment noted.
The Guilford County Emergency Services Director did not submit a completed input form
for this project. Separate correspondence with the Guilford County EMS Director on July
9, 2019 indicated that the organization is supportive of the project and does not anticipate
any substantial impacts resulting from the project. The EMS Director also recommended
contacting the City of Greensboro Fire Department to provide feedback on the project.
Response: Comment noted; an input form was sent to the City of ' Greensboro Fire Chief
and a response was not received.
Public Involvement:
Landowner Notification Postcards were sent out to residents within the project corridor in
January 2018, to make them aware of the project and let them know representatives of
NCDOT would be working in the field to gather data. Approximately 40 postcards were
sent to landowners along the Project Study Area.
A Local Officials Informational Meeting was held on January 22, 2019 at Greensboro
Town Hall. A short presentation providing project information was given followed by an
opportunity for attendees to provide comments and feedback.
A Public Meeting was held on February 5, 2019 at the New Goshen United Methodist
Church. In addition to addressing comments at the meeting, members of the public had the
opportunity to provide comments through mail or email until February 19, 2019.

General Project Narrative:
(Description of Minimization of Water
Quality Impacts)
The project includes a proposed four travel lane section, with center turn lanes, medians, right turn lanes, sidewalk and curb and gutter. There are two storm water outfalls on
the east side of the road that carry roadway drainage from the project area and from offsite. The two existing drainage systems within the project limits will be modified to
account for the road widening and tie to the existing pipes of each system. The two drainage system outlets drain to the stream on the east side of the road (sheets 4 & 5).
Storm Water Treatment is not provided considering the potential impacts to existing utilities, adjacent properties, existing trees, and the existing stream banks. The existing
storm drainage outfalls appear stable at their current locations and the minor storm water flow increase is not anticipated to cause erosion. A proposed rip rap apron will be
installed at the moved outlet on sheet 5.

Project Description: NCDOT's Division 7 proposes to widen SR 1007 (Randleman Road) to multilanes
between Elmsley Drive and Glendale Drive in the City of Greensboro, Guilford County. The existing
cross-section consists of a three -lane facility with shoulders; the proposed cross-section will consist of a
five -lane facility curb -and -gutter section with a center turn -lane. Existing ROW is listed as 80 feet
whereas Proposed ROW is to be 120 feet. Project length is approximately 0.4 mile (2,112 feet). Since
Preliminary Design Plans have not been developed yet, a Study Area for the project has been generated in
order to facilitate environmental planning purposes at this stage. The Study Area will be centered along
the roadway corridor, incorporating extensions along major Y-lines (i.e. intersection roads). Overall, the
Study Area will encompass about 18 acres, inclusive of the existing roadways and any modern
development.
SUMMARY OF CULTURAL RESOURCES REVIEW
Brief description of review activities, results of review, and conclusions:
This project was accepted on Wednesday, January 24, 2018. A map review and site file search was
conducted at the Office of State Archaeology (OSA) on Thursday, January 25, and Friday, January 26,
2018. The southern portion of the Study Area falls within the corridor of the Northern Alternative for the
Greensboro Bypass (TIP# I-2402), which was archaeologically surveyed in 1990/1991 (Hargrove 1991
[OSA Biblio# 2924]). As a result of that survey, two (2) archaeological sites were recorded, the only two
(2) archaeological sites documented within one (1) mile of the project area. Digital copies of HPO's
maps (Greensboro Quadrangle) as well as the HPOWEB GIS Service (http://gis.ncdcr.gov/hpoweb/) were
last reviewed on Thursday, February 15, 2018. There are two (2) known historic architectural resources
(Hodgin-Stevenson Log House [GF1976] and Goshen School [GF1181]) located within or adjacent to the
Study Area; however, intact archaeological deposits associated with these resources would not be
anticipated within the footprint of the proposed project. In addition, topographic maps, historic maps
(NCMaps website), USDA soil survey maps, and aerial photographs were utilized and inspected to gauge
environmental factors that may have contributed to historic or prehistoric settlement within the project
limits, and to assess the level of modern, slope, agricultural, hydrological, and other erosive -type
disturbances within and surrounding the Study Area.

Brief Explanation of why the available information provides a reliable basis for reasonably predicting
that there are no unidentified historic properties in the APE:
Although this is a State -funded project, a Federal permit is necessary. A permanent/temporary easement
will also be necessary as well as additional ROW. The size and shape of the Study Area have been drawn
in a way to capture any possible impacts beyond the NCDOT's existing ROW along SR 1007
(Randleman Road). At this time, we are in compliance with NC GS 121-12a, since there are no eligible
(i.e. National Register -listed) archaeological resources located within the project's Study Area that would
require our attention. Based on the description of the proposed project, activities will take place beyond
the NCDOT's existing ROW. From an environmental perspective, the Study Area falls within a mixed
commercial and residential setting in the Piedmont physiographic region of North Carolina. The Study
Area consists of various soil types, most of which have been heavily disturbed, are considered to be
poorly drained, or have succumbed to varying degrees of erosion (e.g. Mecklenburg -Urban land complex,
2-10% slopes [MuB], Wehadkee silt loam [Wh], and Mecklenburg sandy clay loam, 2-6% slopes, eroded
[MhB2]). Based on the poor soil conditions and the level of development, the preservation of intact
archaeological resources would not be anticipated. The Office of State Archaeology (OSA) has reviewed
various projects within the vicinity of the Study Area for environmental compliance, most of which have
been residential in nature (ERs 87-7680, 88-7060, 88-8044, 90-7119, 95-0576, 98-0448, and 10-0514).
Stating a low probability for intact and significant archaeological sites to be present, OSA did not require
an archaeological survey for any of these housing projects. On the flip side, archaeological surveys were
recommended and conducted for the alternate corridors of the Greensboro Bypass (TIP# I-2402 [ER 91-
7969]). Asa result of that survey, two (2) archaeological sites (Sites 31GF295 and 31GF296**) were
documented along Kallamdale Road, both of which are located outside the current Study Area. Site
31GF295 was a small lithic scatter determined not eligible for the NRHP. Site 31GF296** consisted of
the remains of the Layton Farm, a late 19t'-century Piedmont farmstead (GF 1217), that was deemed
architecturally significant and eligible for the NRHP in 1991. Within five (5) miles of the Study Area,
NCDOT's Archaeology Group has reviewed fourteen (14) transportation -related projects for
environmental compliance under the Programmatic Agreement (PA) with the State Historic Preservation
Office (NC-HPO), none of which is located within one (1) mile of the proposed project. An
archaeological survey was not recommended for most of these projects, based on the presence of heavily
modified soils and/or poorly drained or eroded soil conditions. However, an archaeological survey was
recommended and conducted for the replacement of Bridge No. 121 on SR 4240 over South Buffalo
Creek (PA 16-01-0126 [TIP# B-5717]), because of the proximity of Site 31GF24, a possible village site
recorded by Joffre Coe in 1935. No archaeological remains were recorded as a result of that survey; the
village site is thought to have been "mismapped." Given the poor soil conditions and developed nature
within the Study Area and the results of previously reviewed and surveyed projects in the vicinity, there is
a low probability for significant prehistoric and/or historic archaeological materials to be present.
Therefore, it is believed that the current Study Area, as depicted, is unlikely to contain intact and
significant archaeological resources. No archaeological survey is required for this project. If design
plans change or are made available prior to construction, then additional consultation regarding
archaeology will be required. At this time, no further archaeological work is recommended. If
archaeological materials are uncovered during project activities, then such resources will be dealt with
according to the procedures set forth for "unanticipated discoveries," to include notification of NCDOT's
Archaeology Group.
A portion of the New Goshen Methodist Church Cemetery (1892-present) is located within the Study
Area. If any burials are to be impacted, then additional steps will need to be taken to relocate any
impacted burials in compliance with North Carolina statutes, including prior discussions with the State
Archaeologist and the Office of State Archaeology (OSA) in order to determine the manner by which any
impacted graves should be removed and relocated. Such discussions would also be held in conjunction
with the NCDOT's Archaeology Group.

SUMMARY OF HISTORIC ARCHITECTURE AND LANDSCAPES REVIEW
Description of review activities, results, and conclusions. -
Review of HPO quad maps, relevant background reports, historic designations roster, and
indexes was undertaken on February 5, 2018. The Goshen School (GF 1 181), a Determine
Eligible resource is located within the Area of Potential Effects (APE). No National Register
boundary was every recorded; therefore, NCDOT commissioned a new Eligibility Report to
determine if the property remained eligible and if so, draw an appropriate boundary. In a letter
dated August 2, 2019, HPO concurred with the recommendation that the New Goshen United
Methodist Church and Rosenwald School (GF1118) are eligible for NR listing. On August 19,
2021, an Effects Meeting was held resulting in a No Adverse Effect with Environmental
Commitments.

Explanation of Effects Determination:
The project will require 0.72 acres of new right-of-way. The lanes will be 11-feet wide with 6-
feet wide sidewalks which will start at the back -of -curb. A 3-feet high retaining wall will reduce
the amount of ROW. The utilities will remain in their current location.
List of Environmental Commitments:
Temporary orange fencing will be erected around the church sign, historic marker, and trees
during construction. The brick retaining wall will have a brick veneer to match the church and
school buildings.

Threatened & Endangered Species and Critical Habitat

STV Engineers, Inc. (STV) conducted field reviews of an approximate 10-acre study area on July
3, 2018, October 12, 2018, and September 8, 2021. Prior to the field reviews, STV reviewed U.S.
Fish and Wildlife Service (USFWS) and North Carolina Natural Heritage Program (NCNHP)
online databases for information related to the occurrence of federal and state protected (threatened
or endangered) species in the study area. The USFWS IPaC protected species database reviewed
September 13, 2022, lists two federally protected species as occurring or having the potential to
occur in the study area (Table 1). Additionally, the bald eagle (Haliaeetus leucocephalus) which
is protected under the Bald and Golden Eagle Protection Act is discussed. As of September 13,
2022, the NCNHP lists no occurrences of federally protected species within one mile of the study
area. A brief description of each species, including habitat requirements and physical
characteristics, and biological conclusion rendered based on surveys of the study area follow.
Habitat requirements for each species are based on current available literature and/or the USFWS.

USFWS optimal survey window: Late August - October
Schweinitz's sunflower is a perennial herbaceous plant species limited to the Piedmont regions
and counties of North and South Carolina. The plant grows from one to two meters tall originating
from a cluster of tuberous roots. The plant's flower consists of yellow disk and ray flowers formed
on small heads less than 1.5 centimeter (cm) in diameter. The petals, or modified leaves, are two
to three cm long. The lanceolate leaves are arranged in an opposite pattern within the lower two-
thirds of the stem transitioning to alternate within the upper third. The typical habitat for
Schweinitz's sunflower includes periodically maintained roadsides and utility line rights -of -way
(R/Ws), old pastures, edges of upland woods, and other disturbed open areas. Soils associated
with suitable Schweinitz's sunflower habitat generally include thin upland soils clayey in texture
(and often with substantial rock fragments) which have a high shrink -swell capacity. Flowering
occurs from August to the first frost of the year.
STV Environmental Scientist Joshua Kotheimer, PWS conducted plant by plant field surveys for
the presence of Schweinitz's sunflowers on October 12, 2018, September 8, 2021 during the
flowering season and USFWS-designated optimal survey window. Suitable habitat was found
along the SR 1007 roadside and woodland edges, but no sunflowers were observed. Review of
the NCNHP records on September 13, 2022, revealed no documented occurrences or populations
of Schweinitz's sunflower in the study area or within one mile of the study area. Based on the

literature review and field survey conducted during the flowering season, it is determined that the
project would have `No Effect' on Schweinitz's sunflower.
Biological Conclusion: No Effect
Small whorled pogonia
USFWS Recommended Survey Window: Mid -May through early July
Small whorled pogonia occurs in young as well as maturing (second to third successional growth)
mixed -deciduous or mixed-deciduous/coniferous forests. It does not appear to exhibit strong
affinities for a particular aspect, soil type, or underlying geologic substrate. In North Carolina, the
perennial orchid is typically found in open, dry deciduous woods and is often associated with white
pine and rhododendron. The species may also be found on dry, rocky, wooded slopes; moist slopes;
ravines lacking stream channels; or slope bases near braided channels of vernal streams. The
orchid, often limited by shade, requires small light gaps or canopy breaks, and typically grows
under canopies that are relatively open or near features like logging roads or streams that create
long -persisting breaks in the forest canopy.
Potential habitat exists within limited areas of the forests of the study area. Plant by plant surveys
were conducted by STV Environmental Scientist Joshua Kotheimer, PWS, throughout areas of
suitable habitat on July 3, 2018. No individuals of small whorled pogonia were observed and the
July survey was conducted during the flowering season. The NCNHP website was reviewed on
September 13, 2022, to determine the locations of the nearest populations of small whorled
pogonia. The NCNHP determined that no populations of small whorled pogonia were present
within one mile of the study area. Since field surveys for small whorled pogonia are effective for
one year, the biological conclusion is unresolved; an updated field survey will need to be conducted
during the optimal survey window to render a biological conclusion for the species. The NCDOT
has a project commitment to survey the project area for small whorled pogonia and render a
biological conclusion before construction begins.
Biological Conclusion: Unresolved
Bald and Golden Eagle Protection Act
The bald eagle is protected under the Bald and Golden Eagle Protection Act as regulated by the
USFWS. Habitat for the bald eagle primarily consists of mature forests found in association with
rivers and other large bodies of open water utilized for foraging. Large dominant trees, typically
located within one mile of these waters, are used as nesting sites. Prior to conducting field reviews,
a desktop-GIS assessment of the study area and an area within a one -mile radius of the project
limits was performed. Specifically, aerial photographs were reviewed to identify any areas of
potential foraging habitat. No water bodies large enough to be considered potential foraging
habitat for the bald eagle were identified within the study area or one -mile radius; therefore, it has
been determined that no field surveys for the species are necessary. Additionally, a review of the
NCNHP database on September 13, 2022, revealed no known occurrences of this species within
1.0 mile of the study area. Due to no nests or eagles being identified during the survey, no known
occurrences within a mile, and minimal impact anticipated for this project, it has been determined
that this project will not affect bald eagles.
