Dear Ms. Perez:
Per the Notice of Violation for Peppertree Resort dated December 5, 2022 (copy
enclosed), We would like to respond to the items per the description of Violation.
Item 1: BOD exceeded monthly average 09130122 reported: 18 Limit: 10
We have been struggling with the BOD due to a blower having issues. One
blower is vibrating hard (eating up the belts) and tripping. We have been constantly replacing
the belts. A blower has been ordered for it over a month ago. We have been informed that the
blower will not be delivered til somtime March of 2023 at this time. Doing what we can to
keep the plant compliant.
BOD also exceeded on the October 2022 NDMR and we noted the problem on the
report (copy enclosed) with surge protector strip tripped and the breaker on blower tripped.
The November lab samples(copy enclosed) however were great. BOD on 111212022 sample
was 2.2 and compliant
Item 2: TSS exceeded the monthly average 09/30/22 reported: 21 Limit 20
We explained on the NDMR report far September 2022 (copy enclosed), that the
spin filters needed cleaning and was done. On the October 2022 report, TSS was 5.9and
compliant (copy enclosed). Also, the TSS lab sample in Nov. 2022 was compliant with a result
of 5.3 (copy enclosed) We will continue to monitor.
We feel once the blower is replaced that will help in resolving the issue controlling
BOD. We will continue to monitor and do what we canto stay compliant.

Statute (G.S.) 143-215.1 and the facility's Non -discharge Permit. Pursuant to G.S. 143-215.6A, a civil penalty of
not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or
fails to act in accordance with the terms, conditions, or requirements of any permit Issued pursuant to G.S.
143-215.1.

discuss overall compliance please respond in writing within ten (10) business days after receipt of this Notice. A
review of your response will be considered along with any Information provided on the,submitted Monitoring
Report(s). You will then be notified of any civil penalties that may be assessed regarding the violations. If no
response is received in this Office within the 10-day period, a civil penalty assessment may be
prepared.
Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems,
and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by
Consent.
