As the proposed project is a bridge-to-bridge replacement with proposed permanent and temporary stream impacts, the NC DOT is requesting written concurrence from the US Army Corps of Engineers (USACE) and the N.C. Division of Water Quality (DWQ) that the activities proposed below may proceed under Nationwide Permit (NWP) 14 and General Water Quality Certification (GC) 3886. Additionally, the project is within the Neuse River Basin and there are minor riparian buffer impacts proposed in order to complete this project. Therefore, NC DOT is also requesting a Neuse River Riparian Buffer Authorization Certificate for this bridge replacement. Total buffer impacts 3,752 2,817 6i. Comments: The bridge replacement necessitates the widening of existing fill slopes beyond their current location. Rays Creek is immediately adjacent and parallel to the existing road. While Rays Creek is not impacted with this project, the associated riparian buffers are. These unavoidable impacts will be mitigated for as required within Neuse River Riparian Buffer Rules (see attached EEP acceptance letter). Page 5 of 10 D. Impact Justification and Mitigation 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The current bridge over South Fork Little River is a timber deck bridge on timber piers which needs replacement based upon its current age and associated deterioration of the structure. The existing bridge is functionally obsolete and structurally insufficient. NC DOT proposes to replace the bridge with a 55-foot spanning structure which will span the entire stream. Rip rap is proposed to be keyed into the channel bank below the Ordinary High Water Mark (OHWM) which will result in permanent stream impacts; however, it is important to note that the rip rap is on the banks only and is not proposed within fhe thalweg of the channel and therefore, will not impede flow or aquatic life passage. The existing bridge has deck drains which discharge storm runoff directly into the stream channel. The new proposed bridge deck will capture and convey the stormwater into an existing 2' base ditch where it will discharge outside the riparian buffer zone. Ditch dimensions and drainage area are not changing and the natural drainage patterns are not being disturbed or modified. Roadway approach work is minimized as much as is practicai to reduce the overall project footprint. Impacts to the associated protected riparian buffers have also been reduced by out-letting drainage pipes outside the riparian buffer (where possible) and proposing rip rap aprons to reduce the flow to non-erosive velocities, as well as providing grass shoulders to increase surface infiltration. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Impacts will be minimized by strict enforcement of Best Management Practices for the protection of surface waters, restrictions against the staging of equipment in or adjacent to waters of the US and coordination (including a pre- construction meeting) with the Division Environmental Supervisor. 2. Per the NC DWQ April 10, 2004 Version 2.1 Cumulative Impacts policy, small scale public transportation projects — such as widening projects, bridge replacements and intersection improvements — have a"low potential for cumulative impact since little (if any) new impervious surface is added and the projects are usually in already developed locales." This proposed project is within a somewhat developed landscape (i.e. existing residential homes in the vicinity), and while it drains to South Fork Little Creek which is Water Supply (WS) II; Nutrient Sensitive Waters (NSW), High Quality Waters (HQW), this is not a road on a new location (i.e. there is an existing road and bridge structure and thus, the area already contains impervious surfaces). We anticipate the NC DWQ will advise us if a qualitative or quantitative analysis is needed. 4. Sewage Disposal (DWQ Requirement) 4a. Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. Further, NCDOT Staff conducted surveys in August 2012 for Michaux's sumac and Smooth Coneflower. While habitat was found, no species were observed. Therefore, the biological conclusion is No Effect for both flora species. Additionaily, there was no habitat present for neither the Red- cockaded Woodpecker nor the Bald Eagle. No deck drains will be required. There is a slight increase in the impervious area of the project, however, there is no real increase in drainage due to the increased impervious area. Runoff from the bridge will be captured and discharged into a rip rap pad in a relocated existing 2' base ditch outside of Buffer Zone 2. The discharge velocity from the rip rap pad is non-erosive at 1.5 fps. A temporary work pad will be utilized to remove the interior bent with concrete footing.
