On August 15, 2014, the Division of Water Resources (Division) received an application requesting
a 401 Water Quality Certification and Catawba Buffer Authorization from the Division for the
subject project. On August 22, 2014, the Division sent a letter requesting additional information.
The Division has not received any additional information regarding this request. On January 7,
2015, the Division received an email response from the agent, Michael Miller, confirming that the
Division should return the application.
Pursuant to Title 15A NCAC 02H .0506, the Division is unable to process your application. For
the reasons listed above, your application is hereby returned. Once you have addressed the
problems and /or inadequacies with your application as it was submitted, you will need to reapply
to the Division for approval including a complete application package and the appropriate fee.
Please submit 3 copies of the Pre - Construction Notification Application form which can be found
at: http: / /Portal.ncdenr.org/ web /wq /swp /ws/ 401 /certsandpermits /apply /forms.
Please be aware that you have no authorization under Section 401 of the Clean Water Act or the
Catawba Buffer Rules for this activity and any work done within waters of the state may be a
violation of North Carolina General Statutes and Administrative Code.
