Mr. Tankard,

Thank you for allowing the Eagle Creek WWTP the opportunity to respond to the following Notice of
Violation issued November 2, 2022; received on November 18, 2022. Below is our response to the
limit exceedance violation(s) that occurred during the February 2022 monitoring period, for a total
suspended solids monthly average exceedance violation.
The high TSS values reported for the February monitoring period are attributable to the corrective
measures undertaken during the month of January (underscored below), when repeat occurrences
of high TSS first began to occur at the Eagle Creek WWTP. The high TSS results were due to
insufficient wasting, causing the biosolids to increase above the standard. The operator was trained
in the proper wasting procedures, as well as the correct MLSS standards for the facility. The
procedures and appropriate schedule for the wasting were corrected and the plant returned to
compliance as of March 2022.
It is always our goal to remain in compliance with regulations set forth by the Division of Water
Resources. It is our request that our cooperation and action in these matters be taken into account
by the Division when proceeding with enforcement.
