on November 18, 2021. The request was denied on March 8 2022 because the mine permit was still

On November 18, 2021, the Division of Energy, Mineral and Land Resources received your request
to rescind your coverage under Certificate of Coverage Number NCG020318.
Based on our review of your request and the recommendation of our Mooresville Regional Office,
your request for rescission has been denied. Your request was denied because there is sparse
permanent groundcover on site, particularly on the edge of the stream bank and the stream bank
itself. This also prevents the release of the related mining permit. Once this issue is fixed, please
submit a new rescission request so a rescission can be granted. Your Certificate of Coverage
Number NCG020318 will remain in effect, and you must continue to comply with your NPDES
stormwater permit.

An inspection was made of the above mine on July 14, 2022, in accordance with N.C.G.S. §74-56 of the
Mining Act of 1971.
The mine was found to be satisfactorily reclaimed. Therefore, your company is released from further
reclamation responsibility for this site with respect to the Mining Act of 1971.
Your company currently has a $40,400.00 surety bond on file. As such, you may wish to reduce this surety bond
to the new required amount of $12,100.00.

This Stormwater annual fee is required by the North Carolina Administrative Code 143-215.D(a). It covers the administrat
costs associated with your permit. It is required of any person holding a permit for any time during the annual fee period,
regardless of the facility's operating status. Failure to pay the fee by the due date will subject the permit to revocation.
Operating without a valid permit is a violation and is subject to a $10,000 per day fine. If the permit is revoked and you let
decide a permit is needed, you must reapply, with the understanding the permit request may be denied due to changes it
environmental, regulatory, or modeling conditions.
