A preliminary jurisdictional determination was submitted on November 28, 2022 under Action ID number SAW-2022-00318. Approval is being requested for a total of five unavoidable impacts to aquatic resources including two permanent culverts for road crossings, one temporary impact for a water line installation, one permanent wetland impact for parking a grading, and one permanent impact for stream restoration. Impacts S1 (87 LF, 0.007 Ac) and S2 (74 LF, 0.007 Ac) are to intermittent channel CH 400 for the construction of two driveway/road crossings for access between buildings A and B1. At both crossings headwalls are being used at the upstream and downstream extents to minimize impacts. Impact S3 is for the restoration of stream channel through the bottom of Pond 1. The proposed stream restoration is 600 LF and approximately 0.083 acres. The restoration will reestablish aquatic connectivity and riparian habitat between channels CH 600 and CH 700. Impact S4 is temporary excavation for the installation of a water line across channel CH 100. Lastly, impact W1 is a permanent fill to wetland WL 1000 for road access and grading necessary for access around Building A. Initial conceptual designs for the project would have required an individual permit. The proposed site plan has been designed and engineered to avoid and minimize impacts to the greatest extent possible. A retaining wall is being constructed along the Western edge of Building A which is avoiding all impacts to channel CH 500. Headwalls are being used at impacts S1 and S2 which are minimizing impacts at both crossings. The proposed site plan does not require mitigation as permanent impacts under NWP 39 total 0.014 acre of stream and 0.019 acre of wetland. Since consultation with the Fish and Wildlife service Atlas Environmental staff conducted an additional field assessment at the review area on September 19, 2022 to assess potential ATLAS Environmental, Inc. 338 S. We submit the following comments in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e); the National Environmental Policy Act (42 U.S.C. §4321 et seq.); and section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). Project Description According to the information provided, the Applicant proposes to construct an industrial development and appurtenances on approximately 110 partially forested acres in Charlotte, North Carolina. The information provided suggests that the proposed project will require authorization from the U.S. Army Corps of Engineers for impacts to Waters of the United States. Federally Listed Endangered and Threatened Species According to Service records, suitable summer roosting habitat may be present in the action area (50CFR 402.02) for the federally threatened northern long-eared bat (Myotis septentrionalis). However, the final 4(d) rule, (effective as of February 16, 2016) exempts incidental take of northern long-eared bat associated with activities that occur greater than 0.25 miles from a known hibernation site, and greater than 150 feet from a known, occupied maternity roost during the pup season (June 1 — July 31). Based on the information provided, the project would occur at a location where any incidental take that may result from associated activities is exempt under the 4(d) rule for this species. Although not required at this time, we encourage the Applicant to avoid any associated tree clearing activities during this animal's pup season, maternity roosting season (May 15 — August 15) and/or active season (April 1 — October 15). If adhered to, a tree clearing moratorium would also support our concurrence with a "may affect, not likely to adversely affect" determination from the action agency for this animal. Please note that on March 23, 2022, the Service published a proposal to reclassify the northern long-eared bat (NLEB) as endangered under the Act. The U.S. District Court for the District of Columbia has ordered the Service to complete a new final listing determination for the NLEB by November 2022 (Case 1:15-cv-00477, March 1, 2021). The bat, currently listed as threatened, faces extinction due to the range -wide impacts of white -nose syndrome (WNS), a deadly fungal disease affecting cave -dwelling bats across the continent. The proposed reclassification, if finalized, would remove the current 4(d) rule for the NLEB, as these rules may be applied only to threatened species. Depending on the type of effects a project has on NLEB, the change in the species' status may trigger the need to re -initiate consultation for any actions that are not completed and for which the Federal action agency retains discretion once the new listing determination becomes effective (anticipated to occur by December 30, 2022). If your project may result in incidental take of NLEB after the new listing goes into effect this will need to be addressed in an updated consultation that includes an Incidental Take Statement. If your project may require re -initiation of consultation, please contact our office for additional guidance. Additional information about this animal including its proposed reclassification can be found here: https://www.fws.gov/species/northern-long-eared-bat-myotis-septentrionalis The information provided indicates that suitable habitat is not present within the action area for the federally endangered Schweinitz's sunflower (Helianthus schweinitzii), smooth coneflower (Echinacea laevigata), and Michaux's sumac (Rhus michauxii) and targeted botanical surveys during the appropriate timeframes were not conducted for these species. Suitable habitats for these plants include maintained roadsides, utility rights of way, open woodlands, disturbed or maintained open areas, cedar barrens, and/or transitional habitats. These plants typically occur in areas where natural disturbance or management regime reduces competition from other plant species and these plants do not typically occur where dense understory vegetation is established (especially exotic or invasive plant species). If suitable habitat is not present within the action area for these species, we would not object to a "no effect" determination from the action agency. Based on the information provided, suitable habitats do not occur onsite for any other federally protected species, and we require no further information at this time. Please be aware that obligations under section 7 of the Endangered Species Act must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2) this action is subsequently modified in a manner that was not considered in this review, or (3) a new species is listed or critical habitat is determined that may be affected by the identified action. Erosion and Sediment Control Measures to control sediment and erosion should be installed before any ground -disturbing activities occur. Grading and backfilling should be minimized, and existing native vegetation should be retained (if possible) to maintain riparian cover for fish and wildlife. Disturbed areas should be revegetated with native vegetation as soon as the project is completed. Ground disturbance should be limited to what will be stabilized quickly, preferably by the end of the workday. Natural fiber matting (coir) should be used for erosion control as synthetic netting can trap animals and persist in the environment beyond its intended purpose. Impervious Surfaces and Low -Impact Development Increased storm -water runoff also degrades aquatic and riparian habitat, causing stream -bank and stream -channel scouring. Impervious surfaces reduce groundwater recharge, resulting in even lower than expected stream flows during drought periods, which can induce potentially 2 catastrophic effects for fish, mussels, and other aquatic life. Accordingly, we recommend that all new development, regardless of the percentage of impervious surface area they will create, implement storm -water -retention and -treatment measures designed to replicate and maintain the hydrograph at the preconstruction condition to avoid any additional impacts to habitat quality within the watershed. We recommend the use of low -impact -development techniques, such as reduced road widths, grassed swales in place of curb and gutter, rain gardens, and wetland retention areas, for retaining and treating storm -water runoff rather than the more traditional measures, such as large retention ponds, etc. These designs often cost less to install and significantly reduce environmental impacts from residential development. Where detention ponds are used, storm -water outlets should drain through a vegetated area prior to reaching any natural stream or wetland area. Detention structures should be designed to allow for the slow discharge of storm water, attenuating the potential adverse effects of storm -water surges; thermal spikes; and sediment, nutrient, and chemical discharges. Also, because the purpose of storm -water -control measures is to protect streams and wetlands, no storm -water -control measures or best management practices should be installed within any stream (perennial or intermittent) or wetland. We recommend a slow drawdown of the pond, preferably outside the brumation period for turtles (i.e., summer). Fish should not be released from the pond and fish cannot be relocated to another pond. A pond/lake management company can be contacted to remove the fish appropriately. Non-native wildlife and plant species are not released into the watershed. 2. Once the stream is restored, we recommend monitoring to ensure successful channel and bank stabilization and vegetation growth. Invasive species control should occur regularly, including prior to construction if present. Invasive species outcompete native plants and provide minimal benefit to wildlife. Monitoring the site should occur once per year during the growing season for three years or three bankfull events. 3. Consider using state-of-the-art natural channel design and restoration techniques. Native vegetation and bioengineered structures should be used for stream stabilization where possible. Riprap used for stream bank stabilization should be limited to the stream bank below the high-water mark, and vegetation should be used for stabilization above the high-water mark. Long-term stabilization can be accomplished using native plants such as red maple, black willow, sycamore, river birch, silky dogwood, and other native woody species. Riprap should not be placed in the stream bed. 4. Non-native plants should not be used for seeding disturbed areas. Specifically, avoid using Bermudagrass, redtop, tall fescue, and lespedeza, which are invasive and/or non-native. A list of alternatives to non-native species has been attached. Alternatively, use a grain, such as oats, wheat, or rye for temporary cover and native seed mixes for permeant seeding. We recommend planting native, wildflower seed mixes that will create pollinator habitat within the project boundary and plant native trees and shrubs for landscaping rather than using turf grass. Native plants, including those used for the stream restoration, should naturally occur in Mecklenburg County (https://authl.dpr.ncparks.gov/flora/species account.php). Installation shall be at the location and to the lines and grades of the plan. SITE PREPARATION The treatment areas shall be stable and/or shaped prior to installation of the live stakes to the lines and grades as shown on the construction drawings. MATERIALS The live stakes shall be from native woody plant materials or woody plant materials adapted to the site. The plant species and dimensions are shown on the drawings. The plant material shall be free from disease and harmful insects. The plant materials shall be installed within 48 hours after initial preparation unless refrigerated. Remove leaves and side branches from cuttings and do not use the first year growth. The basal ends should be cut at an angle and the top cut square. Cuttings must not be allowed to dry out and must be kept covered and moist during transport and storage. INSTALLATION Installation of the live stakes shall be made by one of the following methods: a. Use a steel bar to make a pilot hole to the specified planting depth. b. In soft ground where the live stake will not be injured, a dead blow hammer may be used to drive the live stake to the planting depth. The live stakes shall be trimmed to remove damage sections. At least two lateral buds shall be exposed above the soil surface. The soil shall be tamped and the planting shall be watered within 24 hours after planting.
