Basically a multiple section 401 where none of the sections have final design numbers and no authority to construct. The impacts will be based on slope stake to slope stake widths plus 40 feet on each side beyond the stakes. As their design build teams (different teams for each section) complete the final designs they will apply for a mod with the final #s. The Corps has tentatively approved this but no final decision has been made. NCTA did not include us in the conversation. We have some concerns. 1) we feel like NCTA is somehow trying to game the system. I'm not sure why they want to do this or what they will gain by getting a 401 without authority to construct. 2) It becomes a workload issue. We will have to review the original application for the corridor and then all the subsequent modificaiton requests as the final design numbers are completed. It seems like unnecessary work to review an application and issue a 401 without final design numbers. 3) To my knowledge, we have never issued a 401 with no final design numbers at all. It is precedent I do not want to set. If the Corps decides to deny the request, there's no problem. If the Corps allows the application for a corridor 404/401, I propose we tell NCTA not to submit a 401 application until the final design numbers are in for at least one section of the project. If NCTA submits an application anyway, I think we should return it until they do get final #s. Sorry forthe long email. NCTA is proposing to submit the application at the end of July, so I wanted to try and get out in front of this. let me know what you think. Thanks.
