Dear Mr. Pitner:
The City of Shelby received the above referenced Notice of Violation regarding the sanitary sewer
overflow that occurred on October 10, 2022, at 401 Robinwood Dr.
This overflow was brought to our attention by the homeowner's son at 8:30am and the City of Shelby's
Collections ORC was on -site at 8:45am. The overflow was corrected at 11:30am and was determined
that 900 gallons reached the un-named tributary to Hickory Creek. This spill was caused by erosion along
the creek bank that ultimately eroded away the base of a tree causing it to fall. When the tree fell the
massive root ball broke away a section of sewer pipe.
To correct this spill, and to prevent future similar spills, a contractor was brought out the same day and
work was begun to move and install 172 feet of sewer line and install a new manhole. The sewer line
was shifted to the back of the easement to place it as far from the creek bank as possible. Dirt, matting
and rip rap was laid down on roughly 75 feet of creek bank to prevent further erosion near the sewer
line. The City of Shelby spent $28,000 to repair and remediate this site. Work was completed on the
project the next day and the new line was put into service.
Our track record shows a significant decline in the number of sanitary sewer overflows over the last
twelve years, and we continue to make substantial capital investments to prevent sewer overflows from
occurring. We are currently in the process of major outfall improvements along the Hickory Creek
Outfall which may total more than $3.8 million dollars by the time the project is complete. We recognize
the requirements of our wastewater collection system permit and the importance to the environment
and public health in the prevention of sanitary sewer overflows and will continue to make
improvements to prevent future spills.
