DCM has determined that no substantial development has occurred since the last permit action,
therefore, this project does not qualify for a renewal under CRC rule 15A NCAC 07J.0404(b). However,
subsection (c) allows the Division of Coastal Management to circulate the request to the state agencies to
determine if any changes in circumstances or in development standards warrant a new application
and CAMA major permit review. DCM is not aware of any proposed changes to the previously
authorized project.

This permit, issued on December 17, 2015 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Marina
1) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage
disposal facility shall be installed in an .easily accessible Location, and a representative of the Division
of Coastal Management shall meet on -site with the permittee to ensure that the required pumpout
facility is in place and operable. The pumpout facility shall be operable and maintained for the life of
the marina.
2) The marina shall display a sign showing the location of the on -site pumpout facility, including other
appropriate waste disposal information, at the entrance and exit from each of the main piers.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.

No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the
permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence
of the permitted structure.
The permittee shall provide a Spill Prevention Control and Countermeasure plan to the Division of
Water Resources before fueling facilities are constructed and shall supply a copy of the plan to the
Division of Coastal Management.
Unless specifically altered herein, this permit authorizes only the docks, piers, and other structures and
uses located in or over the water that are expressly and specifically set forth in the permit application.
No other structure, whether floating or stationary, shall become a permanent part of this marina facility
without permit modification. No non-waterdependent uses of structures shall be conducted on, in or
over public trust waters without permit modification.
In accordance with the CRC Variance granted on 11/17/15, all portions of the access pier/walkway built
over Coastal Wetlands shall not exceed a width of eight (8) feet and shall be elevated a minimum of five
(5) feet over the marsh substrate as measured from the bottom of the decking.
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee shall not be relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
that may be caused from existing or future operations undertaken by the United States in the public
interest.
10) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
11) This permit authorizes a maximum of 66 docking spaces. At no time shall more than 66 vessels be
moored or docked at the marina facility.
Easement
12) The permittee may be required to apply for a submerged lands lease from the Department of
Administration's State Property Office. Contact the Department of Administration's State Property
Office directly at (919) 807-4650 for this determination. Should it be determined that an Easement is
required, the permittee shall supply a copy of the easement to the Division within 30 days of issuance of
the Easement.

13) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including the campsites, bathroom
facilities, laundry mat, store, reception venue, pond modification with associated bulkhead, and required
access infrastructure, all as expressly and specifically set forth in the attached permit application and
workplan drawings. Contact a Division of Coastal Management representative at (252) 946-6481 for this
determination.
Sedimentation and Erosion Control
14) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales-or berms, etc.)

General
The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the State of North Carolina. No claim shall be
made against the United States or the State of North Carolina on account of any such removal or
alteration.
16) No Coastal Wetlands shall be excavated or filled, even temporarily.
17) This permittee and/or his contractor shall meet with a representative of the Division prior to project
initiation in order to discuss the conditions set forth in this permit.
18) No open water areas shall be excavated or filled, even temporarily.
19) This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals
or authorizations that may be required, including any authorizations from the NC DEMLR Stormwater
Section.

NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division of Costal Management at (252) 808-2808 prior to the
commencement of any such activity for this determination. The permittee is further advised that,
in accordance with the rules of the Environmental Management Commission, many non -water
dependent activities are not authorized within 50 feet of the normal water level or landward edge
of any coastal wetlands, whichever is more restrictive. Contact the Division of Water Resources
at (252) 946-6481 for project specific clarification.
NOTE: The N.C. Division of Water Resources has authorized the proposed project under General Water
Quality Certification No. 3900 (DWR Project No. 14-0275 V2), which was issued on 7/8/15.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-12I.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if

On October 2, 2015, Petitioner TJ's Land development, LLC submitted its request
seeking a variance from 15A NCAC 07H .0208 to allow construction of an 8-foot wide dock
over the wetlands adjacent to Pungo Creek near Bath in Beaufort County, North Carolina. This
matter was heard on oral arguments and stipulated facts at the regularly scheduled meeting of the
North Carolina Coastal Resources Commission (hereinafter Commission) on November 17, 2015
in Atlantic Beach, North Carolina pursuant to N.C. Gen. Stat. § 113A-120.1 and 15A NCAC 7J
.0700, et seq. Assistant Attorney General Shawn Maier and Christine A. Goebel, Esq. appeared
for the Department of Environmental Quality, Division of Coastal Management (DCM) and
Franz Holscher, Esq., of Rodman, Holscher, Peck & Edwards, P.A. appeared on behalf of
Petitioner.
Upon consideration of the stipulated facts and stipulated exhibits which together
comprise the record documents in this case and the arguments of the parties, the Commission
adopts the following:
FINDINGS OF FACTS
1. The Petitioner in this case is TJ's Land Development, LLC ("Petitioner").
2. Petitioner is a North Carolina limited liability company. Tobin J. Tetterton, Sr., is
the Registered Agent and sole member and manager of the company. (Stipulated Exhibit 1)

3. The property subject to this variance is owned by Petitioner, is located off of SR
1718 near Belhaven in Beaufort County, North Carolina, and has a physical address of 1711
Yeatesville Road, Bath, North Carolina 27808 ("Site"). Petitioner acquired this property in 2013
from John Tankard Jones and wife, Mary Etta Jones, through a deed recorded at Book 1809,
Page 753 of the Beaufort County Registry. (Stipulated Exhibit 2)
4. The Site is adjacent to Pungo Creek. At this Site, the waters of Pungo Creek are
classified by the Environmental Management Commission as SC NSW waters. These waters are
Inland Waters regulated by the North Carolina Wildlife Resource Commission and are closed to
shell fishing.
5. The Site has coastal wetlands, public trust, and public trust shoreline Areas of
Environmental Concern ("AEC"). Pursuant to the North Carolina Coastal Area Management Act
of 1974 ("CAMA"), any "development" proposed for these AEC requires authorization under
CAMA and the North Carolina Dredge & Fill Law. N.C. Gen. Stat. § 113A-118 and §113-229.
6. Currently, the Site is undeveloped. As seen in photographs, the Site consists of a
mix of cleared agricultural land, wooded 404 scrub shrub wetlands and coastal wetlands marsh.
The total acreage of the property is 46.5 acres, which includes approximately 854 linear feet of
coastal wetlands shoreline along Pungo Creek. The coastal wetlands are approximately 240 feet
wide between the normal high water level of Pungo Creek and the waterward extent of the
wetlands, and are vegetated with black needlerush (Juncus roemerianus), sawgrass (Cladium
jamaicense), and giant cordgrass (Spartina cynosuroides). (Stipulated Exhibits 3, 5, and 7)
7. On May 20, 2015, DCM received a complete CAMA major permit application
from Petitioner, through its authorized agent Hood Richardson requesting permission to

construct a 66-slip marina and accessway, the infrastructure for a 106-lot RV camping ground
with associated septic systems, a community building (housing showers, laundry, a provisions
store, and reception facilities), an upland pond (with bulkhead and pier), parking, and fuel and
pump -out facilities. The marina is designed to provide dockage for the general public who desire
to rent a slip, including patrons of the RV camping ground. (Stipulated Exhibit 6)
8. Petitioner proposed that the 66-slip T-head marina would be accessed by an 8-foot
wide access dock of which approximately 50 feet is located over high ground, approximately 300
feet is located over wooded 404 wetlands, approximately 240 feet is located over coastal
wetlands and approximately 140 feet is located over open water. Petitioner proposed the entire
eight foot -wide dock be constructed five feet high, including the middle section over the coastal
wetlands substrate. This is two feet higher than the three foot height required by the
Commission's rules.
9. The access dock is designed to be eight feet wide by 586 feet long ending in a T-
shaped dock with 66-slips. The dock will have a thirty foot square, roofed platform at the
intersection with the access dock. This platform will support the fueling area and the marine
pump -out. Two 15 by 30-foot slips will be used by boats fueling or pumping out onboard
holding tanks. The dock will have two 25 foot square roofed platforms at each end of the dock,
along with twenty-four I 8-foot by 40-foot slips with a "stern to" orientation on the offshore side
of the dock accessed by fourteen finger piers. The inshore side of the dock will have forty 10 feet
by 10 feet boat lifts accessed by twenty-two finger piers. (Stipulated Exhibit (6)
10. As part of the CAMA major permit process, notice was sent to the two riparian
owners adjacent to the Site: JHG Farms, LLC and WMT Holding, LLC. These owners executed

an Adjacent Riparian Property Owners Statement indicating that they had no objection to the
proposed development and JHG Farms, LLC agreed to waive the 15 foot pier setback.
(Stipulated Exhibit 4) DCM received no additional feedback from these adjacent owners.
1 1. Also as part of the CAMA major permit process, notice was posted on Site and
was published in the Washington, Daily News. DCM received no comments related to this
proposed project.
12. Also as part of the CAMA major permit process, information about the proposed
development, including the DCM Field Investigation Report (Stipulated Exhibit 5) was sent to
state and federal resource agencies for comment. No adverse comments were received by DCM.
The Division of Water Resources issued a 401 Certification for the project on June 8, 2015,
13. On August 4, 2015, DCM issued CAMA major permit 79-15 (the "Permit")
(Stipulated Exhibit 6) authorizing construction of the 66-slip marina. However, Condition 6 of
the Permit limited the proposed access dock to a maximum width of 6 feet in the middle section
over approximately 240 feet of coastal wetlands as required by the Commission's rule found at
15A NCAC 7H .0205(b)(6)(C).
14. The Commission's rules generally prohibit development in the Coastal Wetlands
AEC, but allow development for water dependent uses per 7H .0208(a)(1). The Commission's
rule 7H .0208(b)(6)(A) requires piers located in AECs other than Coastal Wetlands to be six feet
wide, but allows greater width " if the greater width is necessary for safe use, to improve public
access, or to support a water dependent use that cannot otherwise occur." However, for the
Coastal Wetlands AEC, the Commission's rule at 7H .0208(b)(6)(C) limits the pier width to six
feet wide without exception. Given these rules, DCM permitted that portion of the access dock

located over the 404 wetlands and open water to be eight feet wide, but Iimited the width of that
portion of the pier located over coastal wetlands to six feet as required by 7H .0208(b)(6)(C).
15. On October 2, 2015, DCM received Petitioner's variance petition seeking a
variance from Condition No. 6 on the Permit in order to construct an 8 foot wide pier over the
approximately 240 foot long middle section of the access dock located over the coastal wetlands.
16. The access dock currently permitted by DCM will shade approximately 1,440
square feet of coastal wetlands. If the variance is granted, the addition of two feet in width would
shade approximately 480 additional square feet for a total of approximately 1,920 square feet
shaded Coastal Wetlands AEC.
17. As part of its petition, Petitioner stipulated that constructing a pier eight feet wide
over the coastal wetlands would not be consistent with 15A NCAC 7H .1205(d).
18. Aerial and ground -level photographs of the Site were provided to the Commission
in DCM's PowerPoint presentation. (Stipulated Exhibit 7)
STIPULATED EXHIBITS
Included with the Petition and the Staff Recommendation for the Commission's review
were the following Stipulated Exhibits:
1. TJ's Land Clearing, LLC Secretary of State filing;
2. Deed recorded at Book 1809, Page 753 of the Beaufort County Registry;
3. CAMA Major Permit application including the site plan;
4. Notice to Adjacent Riparian Owners;
5. DCM Field Investigation Report;
6. CAMA Major Permit No. 79-15, issued August 4, 2015;
7. Powerpoint Presentation with -aerial and ground -level photos of the Site, including
google earth images from Petitioner.

CONCLUSIONS OF LAW
1. The Commission has jurisdiction over the parties and the subject matter.
2. All notices for the proceeding were adequate and proper.
3. Petitioner has met the requirements in N.C.G.S. § 113A-120. I (a) and 15 NCAC
07J .0703(f) which must be found before a variance can be granted as set forth below.
A. • Strict application of the Commission's Rule limiting the width of the access
dock will cause unnecessary hardships.
The Commission affirmatively finds that strict application of Rule 15A NCAC 7H
.0208(b)(6)(c) would cause Petitioner unnecessary hardship. Without the variance, the width of
the access dock would be limited to six feet. Given the length of the proposed access dock and
the extent of the marina traffic association with the proposed 66-slip facility, limiting the width
of the dock would cause Petitioner unnecessary hardship and make it difficult to provide safe
passageway to the marina. In addition, given Petitioner's voluntary elevation of the access dock
to five feet above the coastal wetlands substrate, even though only a three foot elevation is
required by rule, the impacts of the proposed design will be limited. For these reasons, the
Commission affirmatively finds that Petitioner has met the first factor without which a variance
cannot be granted.
b. Petitioner has demonstrated that the hardship results from conditions
peculiar to the property.
The 46.5 acre Site has approximately 854 linear feet of coastal wetlands shoreline along
Pungo Creek. In its Recommendation, DCM agrees that there was no other location on the Site to
locate the access dock which would reduce the impact on the coastal wetlands. Additionally, the
depth of the marsh and coastal wetlands extending landward from Pungo Creek requires a long

access pier of approximately 630 linear feet.to reach open water of sufficient depth to
accommodate the marina. The access dock progresses from high ground over wooded 404
wetlands and coastal wetlands to the open water. Approximately 240 linear feet of the access
dock is located over the coastal wetlands. Petitioner argues that the hardship is caused by
conditions peculiar to the property such as the size of the property, the depth of the coastal
wetlands, and the length of the pier required to bridge the coastal wetlands.
Moreover, Petitioner argues that given the size of the property, it could be subdivided and
applications submitted for additional access docks over the coastal wetlands. Petitioner
represents that by requesting permission to build just one eight -foot wide dock over the coastal
wetlandsinstead of two six-foot wide access docks, the impact to the coastal wetlands will be
minimized.
For the reasons set forth above, the Commission affirmatively finds that Petitioner has
demonstrated that the hardship results from conditions peculiar to the property. Therefore,
Petitioner has met the second factor required to grant its request for a variance.
c. Petitioner has demonstrated that the hardship does not result from actions
taken by Petitioner.
The Commission affirmatively finds that Petitioner has demonstrated that the hardship
does not result from actions taken by the Petitioner. Specifically, the shoreline at this Site are
covered with coastal wetlands and there is no other location on the Site which could be used for
the access dock that would significantly reduce the impact to the coastal wetlands. In addition,
Petitioner has voluntarily proposed elevating the decking by two feet more than the minimum
height required by the rules. The increased height of the access dock will reduce the impact of
shading on the coastal wetlands.

For these reasons, the Commission affirmatively finds that Petitioner has taken steps to
reduce the hardship while exercising its riparian rights. In this way, Petitioner has demonstrated
that the hardships do not result from its action. Accordingly, Petitioner has met the third factor
required for a variance.
d. Petitioner has demonstrated that the requested variance is consistent with
the spirit, purpose and intent of the Commission's rules, will secure public
safety and welfare, and will preserve substantial justice.
The Petitioner has demonstrated that the requested variance (a) is consistent with the
spirit, purpose and intent of the Commission's rules, (b) will secure public safety and welfare,
and (c) will preserve substantial justice. The principal purpose of the Rule limiting the width of
piers located in coastal wetlands AECs is to minimize impacts to the coastal wetlands. 15A
NCAC 7H .0208(b)(6)(c). However, the proposed expansion of this access dock would have
minimal impacts to the coastal wetlands. As designed the eight foot wide dock would add shade
approximately 480 additional square feet of coastal wetlands (based on an additional two feet in
width for 240 linear feet over the coastal wetlands). Additionally, the design for the proposed
development will elevate the access dock by two feet and in this way reduce shading impacts.
For these reasons, the Commission affirmatively finds that Petitioner's proposed pier design is
consistent with the spirit, purpose, and intent of the Commission's rule limiting the width of
piers over coastal wetlands.
The second assessment to be made is whether the variance proposed by the Petitioner will
impact public safety and welfare. Petitioner argues and the Commission agrees that increasing
the width of the access pier from six feet to eight feet will improve the safety and, welfare of
persons using the marina by making it easier for people and carts to pass on the long narrow

access dock. In addition, the increased width will secure public safety and welfare by allowing
the safe passage of golf carts in urgent/emergency situations, with limited impacts on the
important Coastal Wetlands resources. For these reasons, the Commission agrees that the
proposed development, if granted a variance, will have no adverse effect on public safety and
welfare.
Finally, the Commission agrees that a variance will preserve substantial justice by
allowing Petitioner to reasonable exercise his riparian rights to develop the water -dependent
marina while reducing impacts to the coastal wetlands on the Site.
For all the reasons set forth above, the Commission affirmatively finds that Petitioner has
met the fourth factor required by N.C.G.S. § 113A-I20.1(a).
ORDER
THEREFORE, the requested variance from 15A NCAC 7H.0208(b)(6)(c) is GRANTED.
The granting of this variance does not relieve Petitioner of the responsibility for obtaining any
required permits from the proper permitting authority. This variance is based upon the Stipulated
Facts and Stipulated Exhibits. The Commission reserves the right to reconsider the granting of
this variance if there is a material change to any of the stipulated facts.

The purpose of this letter is to request a second renewal of Major CAMA permit no. 79-15 which
Is set to expire on 31 December 2020. A copy of the last renewal is attached. Major CAMA
permit 79-15 authorized the construction of an RV park and associated marina onsite my property
located off SR 1718, Yeatesville road adjacent Pungo Creek near the Town of Belhaven in
Beaufort County, North Carolina. A variance was granted by the Coastal Resource Commission
(CRC) on 17 December 2015 which allowed me to construct the pier over a wide (±800') fringe.
of coastal wetlands marsh 8' wide.
Although no construction activities have been undertaken at the project site, I remain committed
to undertaking and completing this project. I have demonstrated this commitment by seeking and
obtaining all required permits from the Department of Environmental Quality and other state and
local government for this project as well as the cost and time involved in obtaining the CRC
Variance for the wider marina access pier. To obtain these authorizations it required me to hire
experts in a wide array of disciplines including but not limited to a surveyor, engineer and Iawyer.
My primary business and source of income is my marine construction business. As DCM field
staff have witnessed first hand, the frequency of hurricanes has resulted in significant damage to
structures associated with water access and shoreline stabilization for resdential lots. Since
issuance of this permit this area has been subjected to Hurricane Mathew in 2016, Hurricane
Florence in 2018 and Hurricane Dorian in 2019. I have committed a Iarge part of my construction
staff to assist in recovery efforts after these storm events which has delayed starting construction
of the RV park and marina.
My plans, for the RV park and marina have not changed since the original issuance and renewal. 1
do not anticipate any changes to the project that would increase the scope and associated impacts
,not already approved.

13) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including the campsites, bathroom
facilities, laundry mat, store, reception venue, pond modification with associated bullhead, and required
access infrastructure, all as expressly and specifically set forth in the attached permit application and
workplan drawings. Any additional land disturbing activities and/or construction may require a
modification of this permit. Contact a Division of Coastal Management representative at (252) 946-
6481 for this determination.
Sedimentation and Erosion Control
14) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
General
15) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
16) No Coastal Wetlands shall be excavated or filled, even temporarily.
17) The permittee and/or his contractor shall meet with a representative of the Division prior to project

Marina
1) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage
disposal facility shall be installed in an easily accessible location, and a representative of the Division
of Coastal Management shall meet on -site with the permittee to ensure that the required pumpout
facility is in place and operable. The pumpout facility shall be operable and maintained for the life of
the marina.
2) The marina shall display a sign showing the location of the on -site pumpout facility, including other
appropriate waste disposal information, at the entrance and exit from each of the main piers.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit shall be accessible on -site to Department

3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the
permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence
of the permitted structure.
4) The permittee shall provide a Spill Prevention Control and Countermeasure plan to the Division of Water
Resources before fueling facilities are constructed and shall supply a copy of the plan to the Division of
Coastal Management.
5) Unless specifically altered herein, this permit authorizes only the docks, piers, and other structures and
uses located in or over the water that are expressly and specifically set forth in the permit application.
No other structure, whether floating or stationary, shall become a permanent part of this marina facility
without permit modification. No non -water dependent uses of structures may be conducted on, in or
over public trust waters without permit modification.
6) All portions of the access pier/walkway located over Coastal Wetlands shall not exceed a width of 6 ft.
and shall be elevated a minimum of 3 feet above the marsh substrate as measured from the bottom of the
decking.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
8) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
9) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
that may be caused from existing or future operations undertaken by the United States in the public
interest.
10) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
11) This permit authorizes a maximum of 66 docking spaces. At no time shall more than 66 vessels be
moored or docked at the marina facility.

12) The permittee may be required to apply for a submerged land lease from the Department of
Administration's State Property Office. Contact the Department of Administration's State Property
Office directly at (919) 807-4650 for this determination. Should it be determined that an Easement is
required, the permittee shall supply a copy of the easement to the Division within 30 days of issuance of
the Easement.

workplan drawings. Any additional land disturbing activities and/or construction may require a

Sedimentation and Erosion Control
14) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).

15) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.

sites, associated septic systems and campground building with showers, washer and dryers, and store. The
applicant also proposes to construct a 66 slip marina in Pungo Creek.

Project Setting
The 46.5 acre project site is located off SR 1718, Yeatesville road, adjacent Pungo Creek
near Belhaven in Beaufort County, North Carolina. The most common land use near and
adjacent to the project site is agriculture, with some scattered single family residences. The site
consists of 33.5 acres of uplands that is currently used as row crop farmland and 12.9 acres of
wetlands. The farmland has an elevation of ±7' above the normal water level (NWL) and consist
of sandy loam soils. At the east end of the field is a borrow pond next to a broad expanse of
scrub shrub wooded 404 wetlands that transition to a Coastal Wetland marsh adjacent Pungo
Creek. This wetland area is approximately 540' wide between the uplands and the normal water
level (NWL) of Pungo Creek. The wooded portion of the wetland is vegetated with bald cypress
(Taxodium distichum), red bay (Persa borbonia), dead and stressed loblolly pines (Pinus taida),
wax myrtle (Myrica ceriferra) and red cedar (Juniperus virginiana). The wooded wetlands
transition to an herbaceous Coastal Wetland marsh vegetated with black needlerush (Juncus
roemerianus), sawgrass (Cladium jamaicense), and giant cordgrass (Spartina cynosuroides).
There is an unnamed tributary off of Banjo Creek, a tributary to Pungo Creek, whose
channelized head waters traverse the existing project site/field. The channelization was
undertaken most likely to improve agricultural drainage. An unimproved dirt road was
constructed through the field to the existing borrow pond during the winter of 2013/14. This
road crossed the channelized stream with a 36" culvert pipe. An "after -the -fact" 401 Water
Quality Certification from the Division of Water Resources and a Nationwide Permit 14 from the
US Army Corps of Engineers authorized this improvement.
The project site has 854' of Coastal Wetland marsh shoreline adjacent Pungo Creek.
Water depths in Pungo Creek range from 3' at the marsh edge to +5' below the NWL
approximately 150' offshore. The Environmental Management Commission classifies Pungo
Creek at this location as SC NSW and the NC Wildlife Resource Commission as Inland Waters.
This area of Pungo Creek is closed to shellfishing.
Project Description
A pre -application scoping meeting was held for this project on 21 June 2013 in the
Washington Regional Office. The applicant proposes to develop the farmland into a
campground with 106 camping sites, that will include supporting infrastructure such as a 50'
wide x 150' long building housing full bathroom facilities, laundry mat, store, and a 100 person
reception venue. A 66 slip marina is proposed in Pungo Creek as well as a large groundwater
fed pond to be used for recreational purposes including swimming. A road system will be
constructed to access the camping spaces and other campground and marina facilities. A 90 RECEIVED
space parking lot is proposed for the campground building and a 33 space parking lot is proposed

systems. The marina will have a pump and haul system that will pump to a holding tank near the
base of the marina pier from which the wastewater will be trucked to local municipality for
disposal. The application did not include any documentation authorizing the proposed methods
of wastewater disposal.
The 66 slip marina will be accessed by an 8' wide pier of which ±50' is over highground,
±300' is over wooded 404 wetlands, ±240' is over Coastal Wetlands marsh and ±140' over open
water. The applicant desires to build the pier 8' wide because of the distance to the slips and the
extra width would allow traffic to pass on the pier. The applicant proposes to mitigate for this
impact by constructing the pier with the decking elevated 5' above the ground level to reduce the
shading impact. The pier will access an 8' wide x 586' long T-shaped dock with 66 slips. The
dock will have a square shaped, roofed, platform 30' x 30' at the intersection of the access pier
and dock. This platform will support the fueling area as well as the marine pumpout. Two 15' x
30' slips will be designated for use by boats fueling or pumping out onboard holding tanks.
There is also proposed 2-25' x 25' roofed platforms at each end of the dock. There will be 24-
18' x 40' slips with a "stern to" orientation on the offshore side of the dock accessed by 14-3' x
20' finger piers. The inshore side of the dock will have 40-10' x 10' boat lifts accessed by 22-3'
x 20' finger piers providing access to the boatlifts.
The existing borrow pond will be modified and enlarged to 3.6 acres. An area of the
existing pond will be filled ±50' x 250' for more highground space to accommodate camping
spaces and the perimeter road around the campground. Fill generated from the pond excavation
will be used onsite to build up the existing ground elevations where they do not meet the base
flood elevation. Fill dirt will also be sold and trucked offsite. The applicant states that a mining
permit application has been submitted to the Division of Land Resources. The applicant plans to
construct a bulkhead around the perimeter of the pond. An 8' wide pier system with a covered
platform and a 20' x 40' T-head platform are proposed to be constructed in the 3.6 acre pond.
The pond will be pumped out to prevent putrefaction pumping the pond water to highground
with sheetflow of more than 50' into ditches.
Project Impacts
The development of the campground spaces and associated infrastructure including the
pond excavation will disturb 33.5 acres of uplands. The access pier over wetlands will shade
2,600 ft' of wooded wetlands and 1,760 ft2 of Coastal wetlands. The proposed dock, platforms
and fmger piers will shade 9,478 ft2 of Pungo Creek bottom. Construction of the pier, dock and
slips will result in some localized short-term turbidity. The marina will increase boat traffic in
Pungo Creek and their associated impacts.

Subject: TJ's Land Development LLC Major CAMA Permit Application
Enclosed is a Major CAMA permit application package submitted by Mr. Hood
Richardson on behalf of Mr. Toby Tetterton with TJ's Land Development, for the construction of
a campground to be sited in an existing ag field and a 66 slip marina in Pungo Creek located off
SR 1718, Yeatesville Road, near the Town of Belhaven in Beaufort County, North Carolina.
This project was reviewed and discussed at a 21 June 2013 scoping meeting conducted in the
Washington Regional Office. There were no significant objections or issues identified by the
review agencies during this meeting. The marina will offer a pumpout to handle disposal of
onboard waste water utilizing a pump and haul system. The marina will have a "no live aboard"
policy. The marina will provide boat fueling services and there was no information in the
application package concerning plans to handle fuel spills. Water depths at the proposed marina
site are 5' or greater so there are no submerged aquatic vegetation issues and water depths will
support the size vessels anticipated at this facility.
Staff has reviewed the applicants project applying the use standards found in 7H.0207,
7H.0208 and most specifically those found in 7H.0208(b)(5)(A)-(Q) and 7H.0208(6)(A)-(J) and
have found that the applicant's proposal is consistent with the exception of 7H.0208(b)(6)(C)
that limits piers and docking facilities over Coastal Wetlands to 6' in width. The applicant is
proposing an 8' wide access pier over wooded 404 wetlands and Coastal Wetlands. I feel this
inconsistency can be handled by permit condition restricting the width over wetlands to 6'. Also,
the marina will offer fuel services. Therefore, 1 feel the permit should be conditioned that an
Emergency Fuel Spill Response Plan be submitted prior to DCM for approval prior to occupancy
of any slip. These additional permit conditions along with the standard erosion control and
marina development conditions, should prevent any inconsistency in the Divisions rules for
marina development. Therefore, barring any significant objection to the project from the other
state and federal regulatory or review agencies, staff recommends issuance of the permit.

5. Fueling Facilities
Fueling, lubrication and general equipment maintenance should not take place within 50
feet of a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC 02H
.0506 (b)(3) and (c)(3) and 15A NCAC 02B .0200 (3)(f)]
6. All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels,
lubricants, hydraulic fluids or other potential toxic chemicals. In the event of a
hydrocarbon or chemical spill, the permitee/contractor shall immediately contact the
Division of Water Quality, between the hours of 8 am to 5 pm at the Washington Regional
Office at 252.946.6481 and after hours and on weekends call (800) 858-0368.
Management of such spills shall comply with provisions of the North Carolina Oil Pollution
and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and (c)(3), 15A NCAC
02B .0200 (3)(f), and GS 143 Article 21A)

The Permittee shall adhere specially to 15A NCAC 02B .0220 Tidal Salt Water Quality for
Class SC Waters (3)(g) pH: shall be normal for waters in the area, which generally shall
range between 6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is
the result of natural conditions; (I) Turbidity: the turbidity in the receiving water shall not
exceed 25 NTU; if turbidity exceeds this level due to natural background conditions, the
existing turbidity level shall not be increased. (15A NCAC 02B .02201
8. Spills
The permittee shall report to the local DWR Regional Office, within 24 hours, all significant
spills as defined under Section 311 of the Clean Water Act (Ref; 40 CFR 110.10 and CFR
117.21) or section of CERCLA (Ref: 40 CFR 302.4). Additionally, the permittee shall report
spills including: any oil spills of 25 gallons or more and any spill regardless of amount that
causes sheen on surface waters.
9. Number of Slips/Dock Space
Use of dock space other than the approved 66 slips is prohibited. Handrails or other
devices, including signage, should be used to discourage use of any dock pace other than
the 66 designated dockage slips as shown in the approved plan. [15A NCAC 07H .12051
Other Conditions
10. Re Opener Clause
TJ's Land Development, LLC and their authorized agents shall conduct their activities in a
manner consistent with State water quality standards (including any requirements resulting
from compliance with section 303(d) of the Clean Water Act) and any other appropriate
requirements of State law and federal law. TJ's Land Development, LLC shall require their
contractors (and/or agents) to comply with all of the terms of this Certification, .and shall
provide each of their contractors (and/or agents) a copy of this Certification. A copy of this
Certification shall be included in the construction contract and available on the job site at
all times. If DWR determines that such standards or laws are not being met (including the
failure to sustain a designated or achieved use) or that State or federal law is being
violated, or that further conditions are necessary to assure compliance, DWR may
reevaluate and modify this certification to include conditions appropriate to assure
compliance with such standards and requirements in accordance with 15A NCAC
2H.0507(d). Before modifying the certification, DWR shall notify the TJ's Land
Development, LLC and the US Army Corps of Engineers, provide public notice in accordance
with 15A NCAC 21-1.0503 and provide opportunity for public hearing in accordance with 15A
NCAC 2H.0504. Any new or revised conditions shall be provided to DWR in writing, shall be
provided to the United States Army Corps of Engineers for reference in any permit issued
pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the
404 Permit for the project.

11. Any marina project that proposes a pumpout with a storage tank are classified as a Non -
Pumpers and will need to obtain a "Non -Pumper" permit from the Division of Waste
Management, Solid Waste Section and provide a copy to this Office prior to the
construction of the facility. [G.S. 130A-291.1(e1)]
12. Fueling at Marina Protects
Any marina project that proposes to dispense or store fuel shall provide an EPA approved
Spill Prevention Control and Countermeasure (SPCC) plan to this Office before the fueling
facilities are constructed. 115A NCAC 02H .0506(b)(3)]
13. State Stormwater Management Plan (SMP) and General Permit No.NCG190000 Approved
by Division Stormwater Program Required
You are required to provide one copy of the state stormwater management plan (SMP) and
National Pollutant Discharge Elimination System General Permit No. 190000 (NCG190000)
approval letters from the Division of Energy, Mining and Land Resources (DEMLR) to the
DWR 401 & Buffer Permitting Unit (1617 Mail Service Center, Raleigh, NC 27699-1617)
before any impacts authorized in this certification occur. The project must be constructed
and maintained in compliance with the approved SMP and NCG190000. After the approval
letter is submitted to the Division, the SMP and NCG190000 may not be modified without
prior written authorization from DEMLR. If the SMP and NCG190000 are modified in the
future, then you shall provide an approval letter for the modifications to the DWR 401 &
Buffer Permitting Unit prior to the commencement of the modifications. [15A NCAC 02H
.0506(b)(5)]
14. Diffuse Flow
All constructed stormwater conveyance outlets shall be directed and maintained to flow in
a diffuse manner at a non -erosive velocities through the entire protected stream buffers
without re -concentrating. If this is not possible it may be necessary to provide stormwater
facilities that are considered to remove nitrogen and phosphorus. Additionally, a
stormwater management plan for this project shall provided to this Office before any
impacts approved herein are conducted. The plan shall specify all stormwater discharge
points, plan details, and calculations to indicate that diffuse flow through the protected
buffers or nitrogen and phosphorus removal as described above will be achieved.
15. Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, any subsequent modifications, the applicant is required to return
the attached certificate of completion to the 401 & Buffer Permitting Unit, NC Division of
Water Resources, 1617 Mail Service Center, Raleigh, NC 27699-1650. [15A NCAC 02H

envelope. Signing the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.I or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B
with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-
2698 within twenty (20) days of this decision on your permit. You should also be aware that another
qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and review

CAMA Permit
TJ's Land Development, LLC
This project is to build a camp ground with marina on the Yeatsville Road fronting on Pungo Creek in
Beaufort County. The entire tract of land is 46.47 acres with 12.95 acres of undisturbed 404 and CAMA
wetlands. The remainder, approximately 33.52 acres, is farm land. There will be dockage for
approximately 76 boats and more than 100 camp sites with sewage facilities for both the dockage and the
camp sites.
The wetland area is well defined and has been examined by the US Army Corps of Engineers and The
Division of Coastal Management. No attempt has been made to make the distinction between CAMA and
404 wetlands because the only impact in these wetlands will be limited to pile driving. CAMA wetlands
are along the Pungo Creek shore line.
A pump out for boaters will be provided with disposal of the sewerage at a permitted facility.
Bathrooms and other amenities will be provided at a high ground commercial facility located as shown on
the plans.
Elevations range from sea level to 10 feet. Generally the project area is flat with grades less than one
percent. The entire project area to be disturbed is farm land and the existing excavated pond. Soils are
Augusta and Altavista fine sandy loam.
The project includes the excavation of an approximately 3.6 acre pond that is fed by ground water.
There will be no surface water flow into the pond or natural discharge. The pond will not be connected to
local ditches or streams. The existing borrow pit will be enlarged to construct the pond. A mine permit is
being applied for concurrently with these applications. The purpose of these permits is to construct the
pond and provide a partial place to place fill dirt resulting fromthat construction. The pond will be used for
recreation including swimming. Putrefaction will be avoided by periodically decanting by pumping to high
ground with sheet flow of more than 50 feet into ditches.
An after the fact Tar -Pamlico buffer permit has been granted to resolve the road crossing issue at the
head of the designated stream.
Borrow will be used to raise the ground elevation at those camper Tots that are below the base flood
elevation, and for raising the ground elevation at the septic tank disposal ground absorption drain fields as
required by ground absorption permits. There will be an estimated surplus of about 114,000 cubic yards of
borrow. The owner, TJ's Land Development, LLC intends do the excavation and construction of the
property. Some of the borrow will be used on properties owned by Toby J. Tetterton who is also the owner
of TJ's Land Development, LLC, and some of the borrow will be sold for use at other sites.
Storm water strategy in these sandy silts is to avoid collecting rainwater into hardened or ditched
conveyances. Roads will be constructed as nearly as possible without ditches. Gentle swales will be used.
The Tar -Pamlico riparian buffer will be protected by sheet flowing all water into the buffer.

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of your property located off SR 1718,Yeatesville Road, in
existing farmland adjacent to Pungo Creek, near Belhaven in Beaufort County, North Carolina. It
was received on 20 May 2015, and appears to be adequate for processing at this time. The
projected deadline for making a decision is 03 August 2015. An additional 75-day review period
is provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day. Steve Trowell,
Field Representative for the Division of Coastal Management is responsible for processing your
permit and he can be reached at 252-948-3854 or via email at Steve.Trowell@,ncdenr.gov if you
have any questions.
If this agency does not render a permit decision within 70 days from the 20 May 2015,
you may request a meeting with the Director of the Division of Coastal Management and permit
staff to discuss the status of your project. Such a meeting will be held within five working days
from the receipt of your written request and shall include the property owner, developer, and
project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property, or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
