Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The site is located between 1-485 (to the north), NorthLake Centre Parkway (to the west), and 1-77 (to the east). Two unnamed tributaries of Dixon Branch run through the property: one perennial channel near the western site boundary (parallel to Northlake Centre Parkway) and one perennial/intermittent channel that runs west through the center of the site. Riparian wetlands are located adjacent to sections of the streams. Otherwise, the site is undeveloped and forested uplands. Uplands support a variety of hardwood species such as American beech, black oak, red maple and sweetgum. Wetlands support hardwoods such as red maple, river birch, sycamore, and sweetgum. One tract that the proposed roads will provide an alternate access point to is currently being developed. Adjacent land use includes interstates and other roadways, multi -family development to the west, and retail (mall) to the south. 4b. Explain the purpose of the proposed project: * The purpose of the project is to provide access and utilities to proposed multi -family residential and commercial developments. Impacts to wetlands and streams are needed to install a sewer line and roads. The proposed street locations/alignments meet the specific USDG network street requirements of the City of Charlotte. This includes an ordinance requiring block length spacing, street connection/driveway locations and cross section requirements. The northern connection to Northlake Centre Parkway was located to allow separation needed from the 1-485 overpass and stays just out the existing floodway limits to the south. The proposed connection to Northlake Centre Parkway is is the only location where all of the required parameters are met. The new sewer alignment north of the larger crossing (Adjacent to Northlake Centre Parkway) is a requirement by CLTWater (Per Sheet 5). Because of the new street, CLTWater wanted the sewer line to be shifted to this proposed location to keep it completely separate. The existing sewer line and easement to the south will be abandoned in place. 41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: * The project consists of the installation of roads that will provide access to mixed -use development in the area. One road will extend east -west from Northlake Centre Parkway. Another road will run north -south from the new road to Tisbury Road. No impacts were needed to construct Tisbury Road, as the applicant constructed a bridge to span the stream and wetlands to access an apartment complex. The proposed roads will be 26' wide with additional space for on -site parallel parking, planter strips, and sidewalks (see Sheet 10). The roads will be narrower at culvert locations. Two bottomless culverts are proposed to minimize stream impacts. The crossing off of Northlake Centre Parkway will have a large bottomless culvert (+/-35' span) with CIP walls as a part of the design and installation process. The smaller bottomless culvert to the east is located at the upper end of the existing perennial stream alignment. The adjacent apartment BMP outlet will drain to this point to help recharge the system and will maintain current existing drainage patterns. The network street corridor will include retaining walls (CIP and modular block) to minimize impacts to existing high quality stream corridors. To install these culverts, the contractor will level the pad and prepare the footing/foundation; place the culvert precast units and walls for crossing area; waterproof & grout; backfill and compacting backfill; finalize finished grade related items for crossing (street, sidewalks, curb and utilities). A sewer line will also be relocated just north of the proposed bottomless culvert off Northlake Centre Parkway within a 20' wide easement. It will be an 8" line transitioning to a 16" line, which will go under the stream and connect to a 16" line on the opposite side of the stream. The sewer line will be installed via open -cut methods in wetlands and will be directionally bored under the stream. Once the pipe is installed, the open -cut construction area will be regraded back to pre -construction conditions. In wetland areas, the top 6" of soil will be stockpiled and re -applied after the pipe is installed. Vegetation within the easement area will likely be converted from forested habitat to herbaceous and maintained. No other impacts to jurisdictional features are anticipated within properties owned by the applicant. These tracts have been delineated and are mostly uplands except in a couple of locations near the roads where streams exist. The existing constructed southern street crossing (Tisbury Rd) connection to Northlake Centre Parkway included a full bridge design within floodway to minimize existing impacts. This overall site development area incorporates very high development costs to avoid existing jurisdictional areas (existing and future construction). Construction Sequencing: Sedimentation and erosion control measures will first be installed. Then the limits of disturbance will be cleared of vegetation. Accessways and utilities will be installed. Track hoe, loader, dump truck, bob cat, and other standard construction equipment will be used. 5. Jurisdictional Determinations 5a. According to their files, no federally listed species are known to occur on or within a one mile radius of the site. The USFWS IPaC database was also reviewed and several species were identified as potentially occurring the region. The site is forested and may provide suitable habitat for the tri-colored bat, which has recently been listed as Proposed Endangered. (DRG) is pleased to submit a Pre -Construction Notification form and associated attachments for the Northlake Street Extension project, located off Northlake Centre Parkway in Charlotte, NC. The purpose of the project is to provide access and utilities to proposed multi -family residential and commercial development. Impacts to wetlands and streams are needed to install roads. CLTWater is also requiring the applicant to relocate an existing sewer line, which will temporarily impact wetlands. The applicant plans to use bottomless culverts at two locations to minimize stream impacts from the road. Additionally, the sewer line will be directionally bored under a stream. Permanent impacts to 0.05 acre of stream (305 LF) and 0.267 acre of wetlands are needed for the road crossing. Additionally, temporary impacts to 0.04 acre of wetlands are needed to install the sewer line. These areas will be restored back to grade and but will be converted from forested habitat to a maintained easement. To mitigate for the impacts, the applicant proposes purchasing credits from the Wildlands UMB for the stream impacts and the NC DMS for the wetland impacts. Considerations when evaluating significant nexus include, but are not limited to the volume, duration, and frequency of the flow of water in the tributary and its proximity to a TNW, and the functions performed by the tributary and all its adjacent wetlands. It is not appropriate to determine significant nexus based solely on any specific threshold of distance (e.g. between a tributary and its adjacent wetland or between a tributary and the TNW). Similarly, the fact an adjacent wetland lies within or outside of a floodplain is not solely determinative of significant nexus. Draw connections between the features documented and the effects on the TNW, as identified in the Rapanos Guidance and discussed in the Instructional Guidebook. Factors to consider include, for example: • Does the tributary, in combination with its adjacent wetlands (if any), have the capacity to carry pollutants or flood waters to TNWs, or to reduce the amount of pollutants or flood waters reaching a TNW? • Does the tributary, in combination with its adjacent wetlands (if any), provide habitat and lifecycle support functions for fish and other species, such as feeding, nesting, spawning, or rearing young for species that are present in the TNW? • Does the tributary, in combination with its adjacent wetlands (if any), have the capacity to transfer nutrients and organic carbon that support downstream food webs? • Does the tributary, in combination with its adjacent wetlands (if any), have other relationships to the physical, chemical, or biological integrity of the TNW? Note: the above list of considerations is not inclusive and other functions observed or known to occur should be documented below: 1. How do I know if a bird is breeding, wintering or migrating in my area? To see what part of a particular bird's range your project area falls within (i.e. breeding, wintering, migrating or year-round), you may query your location using the RAIL Tool and look at the range maps provided for birds in your area at the bottom of the profiles provided for each bird in your results. If a bird on your migratory bird species list has a breeding season associated with it, if that bird does occur in your project area, there may be nests present at some point within the timeframe specified. If "Breeds elsewhere" is indicated, then the bird likely does not breed in your project area. What are the levels of concern for migratory birds? Migratory birds delivered through IPaC fall into the following distinct categories of concern: 1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands); 2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the continental USA; and 3. "Non -BCC - Vulnerable" birds are not BCC species in your project area, but appear on your list either because of the Eagle Act requirements (for eagles) or (for non -eagles) potential susceptibilities in offshore areas from certain types of development or activities (e.g. offshore energy development or longline fishing). Although it is important to try to avoid and minimize impacts to all birds, efforts should be made, in particular, to avoid and minimize impacts to the birds on this list, especially eagles and BCC species of rangewide concern. Details about birds that are potentially affected by offshore projects For additional details about the relative occurrence and abundance of both individual bird species and groups of bird species within your project area off the Atlantic Coast, please visit the Northeast Ocean Data Portal. The Portal also offers data and information about other taxa besides birds that may be helpful to you in your project review. Alternately, you may download the bird model results files underlying the portal maps through the NOAA NCCOS Integrative Statistical Modeling and Predictive Mapping of Marine Bird Distributions and Abundance on the Atlantic Outer Continental Shelf project webpage. Bird tracking data can also provide additional details about occurrence and habitat use throughout the year, including migration. Models relying on survey data may not include this information. If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid violating the Eagle Act should such impacts occur. Proper Interpretation and Use of Your Migratory Bird Report The migratory bird list generated is not a list of all birds in your project area, only a subset of birds of priority concern. To learn more about how your list is generated, and see options for identifying what other birds may be in your project area, please see the FAQ "What does IPaC use to generate the migratory birds potentially occurring in my specified location". Please be aware this report provides the "probability of presence" of birds within the 10 km grid cell(s) that overlap your project; not your exact project footprint. On the graphs provided, please also look carefully at the survey effort (indicated by the black vertical bar) and for the existence of the "no data" indicator (a red horizontal bar). A high survey effort is the key component. If the survey effort is high, then the probability of presence score can be viewed as more dependable. In contrast, a low survey effort bar or no data bar means a lack of data and, therefore, a lack of certainty about presence of the species. This list is not perfect; it is simply a starting point for identifying what birds of concern have the potential to be in your project area, when they might be there, and if they might be breeding (which means nests might be present). The list helps you know what to look for to confirm presence, and helps guide you in knowing when to implement conservation measures to avoid or minimize potential impacts from your project activities, should presence be confirmed.
