Hi Jim,
I contacted Mitchell Environmental regarding the mulch trail in the wetlands around the pond and we have
taken some steps to ensure this is handled correctly. Scott Mitchell does not believe, based on his knowledge,
that a mulch trail would be identified as disturbance. However, we have added the areas to the Phase II permit
just in case, and we have sent an email to the Corps asking if it is required. We have not had a response to our
email, so I’ve revised the trail to terminate prior to any wetland impacts in Phase I. Ultimately, the trail may
never be constructed as the county has agreed to all the open space improvement requirements being added
during Phase II and the trail would not count toward those requirements. These steps ensure that there are no
impacts in phase I regardless of requirements.
Regarding the 2:1 max slope on roadside swales: the 2:1 max slope comes directly from the NCDOT
Subdivision Manual and was transferred directly from their detail. I’ve added a note to the detail that 2:1 slopes
will require engineering calcs and soil evaluations. However, no 2:1 slopes were designed or called out on the
plans. The only place steep slopes may have been warranted are at the stream crossings to reduce the overall
footprint for impacts to the Corp., but again this will be addressed in Phase II as no crossings are proposed in
Phase I. I’m addressing all the comments that you and I have discussed to the Phase II drawings.

Spencer,
I was looking over the additional information you provided on 9/2/2022. Everything looks good except for a few small
issues:
Please correct the following:
- This project appears to have some wetland impacts (The proposed trail around the existing pond goes through
multiple wetland areas) that could require a 401/404 permit. If the permit is required, please indicate that it is
required in Part C3 of the Application.
- Please upload the electronic files for this project at the following link (as indicated in the 9/7/2022 email below):

While not required for approval of the ATC, the following items were noted during review and will most likely be
brought up during the final review once construction is finished (there may be other issues that arise from the final
technical review, but these items were noticed during this review):
- The details on plan sheet C6.0 shows the vegetated conveyances alongside the roads as having a maximum
allowable side slope of 2:1. Per the requirements of 15A NCAC 02H .1003(2)(c), the maximum allowable side
slope for vegetated conveyances is 3:1 (steeper side slopes are allowable, but only if engineering calculations
and an on-site soil investigation are provided showing that the soils and vegetation will remain stable in
perpetuity.
Please provide the following:
- 2x hard copies & 1x electronic copy of the revised page of the Application form (if needed).
- 2x hard copies & 1x electronic copy of the revised plan sheets (if needed).
- 2x hard copies & 1x electronic copy of any other items needed to address the above issues.

Since these are really minor things, once I get the hard copies, anything else that may have changed from addressing
these issues, and the documents are uploaded to Laserfiche (Provided everything is still in order), we can issue the
