Location description: The site is located off of Gum Branch Road, approximately 0.34 miles north of the intersection with
Western Boulevard, in Jacksonville, Onslow County, North Carolina.
Description of projects area and activity: This verification authorizes the construction of the following subdivisions: Twisted
Vine, Windsor Run, Secret Garden, and Southern Charm within the development known as The Vineyards. Specifically,
discharge of fill material into 0.19 acre of jurisdictional wetlands and 0.0072 acre of jurisdictional stream for road crossings
within the Southern Charm phase of The Vineyards.
*NOTE: Future phases of The Vineyards will be considered part of a single and complete project, and impacts will be
considered cumulative with impacts permitted during earlier phases. As such, if impacts proposed in future phases in
combination with impacts permitted in earlier phases exceed the Nationwide Permit threshold, future phases will be subject to
Individual Permit review.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
Conditions, your application signed and dated 12/7/2021, and the enclosed plans Overall 404 Impact Map, dated 4/21/2021, revised
10/25/2022, Wetlands Impact #1 and Stream Impact #1, dated 4/21/2021, revised 10/25/2022, and Wetlands Impact #2 and Stream
Impact #2, dated 4/21/2021, revised 9/27/2022. Any violation of the attached conditions or deviation from your submitted plans
may subject the permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal
action.
This verification will remain valid until the expiration date identified below unless the nationwide and/or regional general permit
authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide and/or regional general
permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided
it complies with all requirements of the modified nationwide permit. If the nationwide and/or regional general permit authorization
expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the
nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon
the nationwide and/or regional general permit, will remain authorized provided the activity is completed within twelve months of the
date of the nationwide and/or regional general permit's expiration, modification or revocation, unless discretionary authority has been
exercised on a case -by -case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You
should contact the NC Division of Water Resources (telephone 919-807-6300) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA), prior
to beginning work you must contact the N.C. Division of Coastal Management Morehead City, NC, at (252) 808-2808.

SPECIAL CONDITIONS
1. In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance
with the provisions outlined on the most recent version of the attached Compensatory Mitigation Responsibility
Transfer Form. The requirements of this form, including any special conditions listed on this form, are hereby
incorporated as special conditions of this permit authorization.
2. The following DEED NOTIFICATION shall be recorded in the Onslow County Registry of Deeds prior to
the sale of any lots for the properties referred to as Lots 197-220, 224, 225, and 230-230 within the development
Southern Charm at The Vineyard on the attached plan titled "Preliminary / General Plan Southern Charm at the
Vineyards to include Sheet 2 of 14, dated February 18, 2022, prepared for A. Sydes Construction Inc. by Parker
& Associates, Inc., now known as Tidewater Associates, Inc.
"A portion of this lot, as determined by the Wilmington District US Army Corps of
Engineers (USACE) under Action ID# SAW-2012-01392, contains waters of the U.S.,
including wetlands, which are subject to the permit requirements of Section 404 of the
Clean Water Act (33 USC 1344). Any placement of dredged or fill material within these
waters without Department of Army authorization may constitute a violation of Section
301 of the Clean Water Act (33 USC 1311). Prior to any work within the jurisdictional
areas, you must contact the U. S. Army Corps of Engineers, Wilmington District
Regulatory Division, Wilmington, North Carolina. This covenant is to run with the land
and shall be binding on all Parties and all persons claiming under them."

a. The DEED NOTIFICATION shall be completed using the format provided above. Within 30 days
of recording the DEED NOTIFICATION and prior to any impact of the authorized Waters of the United
States (WoUS), the Permittee shall provide a copy of the recorded DEED NOTIFICATION to the
Wilmington District Regulatory Division clearly showing a stamp from the appropriate official
indicating the book and page at which the DEED NOTIFICATION is recorded and the date of
recording.

Instructions to Permittee: The Permittee must provide a copy of this form to the Mitigation Sponsor, either an approved
Mitigation Bank or the North Carolina Division of Mitigation Services (NCDMS), who will then sign the form to verify the
transfer of the mitigation responsibility. Once the Sponsor has signed this form, it is the Permittee's responsibility to ensure
that Wilmington District Project Manager identified on page two is in receipt of a signed copy of this form before conducting
authorized impacts, unless otherwise specified below. If more than one Mitigation Sponsor will be used to provide the
mitigation associated with the permit, or if the impacts and/or the mitigation will occur in more than one 8-digit Hydrologic
Unit Code (HUC), multiple forms will be attached to the permit, and the separate forms for each Sponsor and/or HUC must
be provided to the appropriate Mitigation Sponsors.
Instructions to Sponsor: The Sponsor verifies that the mitigation requirements (credits) shown below have been released
and are available at the identified site. By signing below, the Sponsor is accepting full responsibility for the identified
mitigation, regardless of whether they have received payment from the Permittee. Once the form is signed, the Sponsor
must update the bank ledger and provide a copy of the signed form and the updated ledger to the Permittee, the Project
Manager who issued the permit, the Bank Project Manager, and the District Mitigation Office (see contact information on

Conditions for Transfer of Compensatory Mitigation Credit:
• Once this document has been signed by the Mitigation Sponsor and the District is in receipt of the signed form, the
Permittee is no longer responsible for providing the mitigation identified in this form, though the Permittee remains
responsible for any other mitigation requirements stated in the permit conditions.
• Construction within jurisdictional areas authorized by the permit identified on page one of this form can begin only after
the District is in receipt of a copy of this document signed by the Sponsor, confirming that the Sponsor has accepted
responsibility for providing the mitigation requirements listed herein. When NCDMS provides mitigation for authorized
impacts conducted by the North Carolina Department of Transportation (NCDOT), construction within jurisdictional areas
may proceed upon permit issuance; however, a copy of this form signed by NCDMS must be provided to the District
within 30 days of permit issuance. NCDOT remains fully responsible for the mitigation until the District has received this
form, confirming that the Sponsor has accepted responsibility for providing the mitigation requirements listed herein.
• Signed copies of this document must be retained by the Permittee, Mitigation Sponsor, and in the USACE administrative
records for both the permit and the Bank/ILF Instrument. It is the Permittee's responsibility to ensure that the District
Project Manager (address below) is provided with a signed copy of this form.
• If changes are proposed to the type, amount, or location of mitigation after this form has been signed and returned to
the District, the Sponsor must obtain case -by -case approval from the District Project Manager and/or North Carolina
Interagency Review Team (NCIRT). If approved, higher mitigation ratios may be applied, as per current District guidance
and a new version of this form must be completed and included in the District administrative records for both the permit
and the Bank/ILF Instrument.
Comments/Additional Conditions: A letter from Bachelors Delight Mitigation Bank, confirming they are willing and able to
accept the applicant's compensatory mitigation responsibility, dated 10/26/2022 was included with the preconstruction
notification.
This form is not valid unless signed below by the District Project Manager and by the Mitigation Sponsor on Page 1. Once
signed, the Sponsor should provide copies of this form along with an updated bank ledger to: 1) the Permittee, 2) the
District Project Manager at the address below, 3) the Bank Manager listed in RIBITS, and 4) the Wilmington District

Notes:
1. Work to reroute the existing drainage shall be done during periods of dry weather. In the event that a rainfall should
occur during construction, the contractor shall pump around site drainage to a sediment trap or basin to prevent any
additional impacts to the stream.
2. Wetland crossings: initial disturbance of these areas shall be limited to only that area minimally needed to allow
passage of construction equipment to prepare for the installation of the crossing and to execute upland construction
on the opposing side of the crossing. Grubbing or land disturbance of the subject area shall not be performed until
the culverts, backfill material, erosion and sediment control materials or devices sufficient to substantially complete
the construction and stabilization of the crossing are staged or stockpiled at the location. Due consideration shall be
given to impending inclement weather conditions that may adversely affect the completion of the crossing in the shortest
time practicable.
3. Drainage work shall be completed in the minimum time necessary.

Construction Sequence:
4. No construction of the drainage for the wetland impact shall commence until all materials needed for the impact are
staged on site, and the temporary dams are installed to impede flows.
5. Establish clearing limits per approved plans. Clear and grub impact area as needed. Immediately install the temporary dams
upslope of the headwall. Temporary seed and mulch disturbed area. Do not clear or disturb any unpermitted areas.
6. Install drainage. Fill, compact and finish grade area.
7. Install permanent ground cover (sod) on slopes near the headwall and pipe outlet.
8. Install silt fence at toe of fill slope and as needed to prevent erosion.
9. See the construction plans for additional details.
10. See wetlands permit for additional requirements.
Stream and Wetlands Impact Notes:

5. Work in the wetlands shall be completed in the minimum time necessary.
6. Contractor shall install temporary sand bags and/or sheet pilings in the stream prior to construction and bypass water as
needed via a pump around. Pump around shall discharge into a rip rap lined basin or a sediment bag to keep sediment out of
stream.
7. During excavation, stockpile the top 12"± of topsoil, and reuse topsoil as the top layer of soil when backfilling.
8. Install water under stream then storm drain pipe. See Plan and Profile for Additional Information. Backfill,
compact and regrade area to original contours, or to grades shown on plan.
9. Install silt fence at top of ditch bank and at wetlands line to prevent erosion.
10. If wetland or stream areas are disturbed, outside of the impact areas, they shall be regraded to
original contours using topsoil for the top layer, and the stream banks shall be seeded, with annual
seed, then lined with high velocity excelsior matting then staked with live willow stakes at 3' on
center to stabilize the banks to 5' beyond the top of bank.

12. The. 50' Stormwater Vegetative Setback extends form the bank of the stream. The nonwetland area of the setback
may be cleared or graded, but must be planted with and maintained in, grass or other vegetative or plant material. No
impervious surfaces are allowed within the setback.
13. Before erecting any structure each individual property owner shall verify the structure is not within the 50 foot stormwater
setback by measuring from the top of bank of an unnamed tributary. For definition of top of bank, contact City of Jacksonville
Stormwater/Water Quality Division (910) 938-6446.
14. Property lying beyond streets right-of-way and within bounds of sight triangles shall remain as property of homeowners, but shall
have no plantings, shrubbery, or other obstructions which will impede driver's vision (This does not include Public Utilities, or
street markers, traffic signs and controls.) The homeowners should ensure that all applicable standards of the City of Jacksonville
are met.
15. Existing ditch banks are not to be disturbed. If existing ditch banks are disturbed, they shall be re -graded to have 3:1 or flatter
side slopes and the centerline graded to produce positive drainage.
16. Elevations per NAVD '88 Datum.
17. Site subject to Jacksonville Comprehensive Bicycle and Pedestrian Plan.
18. The existence of utilities may imply the existence of an easement.
19. Setbacks are subject to change and should follow correct zoning setbacks requirements.
20. Areas noted for trails and greenways and/or required sidewalks shall be unobstructed from 6 inches below grade to 10 feet above
grade (overhead clearance). Telephone pedestals, electric transformers, drop inlets, fences, or any other obstructions shall be
removed and/or relocated in order to create and maintain this clearance and shall be free of cracks and damage prior to the issuance
of a Final Certificate of Occupancy.
21. All Stop signs will be R1-1, 30" High Intensity Prismatic. Mounting Height is 7' to the bottom of the sign. Galvanized U-Channel posts
are recommended for mounting.
22. Place 24"x30" R2-1, 25 mph speed limit signs maximum of 200' from the beginning of the roadway, and within 200' of each intersecting
road. All signs will have a High Intensity Prismatic white background with black legends and borders.
23. All Traffic Control Devices, (signs, pavement markings, etc.) will meet the Federal MUTCD, . NC supplement to the MUTCD, and City of
Jacksonville M5511) standards.
24. Place street name signs at each intersection. Street name signs will have a green background with a white High Intensity border and
legend. It is recommended that the street name sign for through traffic be 9" high and 6" high for traffic required to stop. Street
name signs can be mounted on top of the Stop sign using a post cap with blade holder and a cross piece.
25. Parcels within this project are subject to the provisions of the sewer allocation policy of the City of Jacksonville and that sewer
capacity for any particular parcel may or may not be available.
26. 40' temporary turnarounds shall be required at the ends of each phase.
27. Pedestrian cross -walks need to be painted and signed in accordance with the MUTCD.
28. All construction shall be completed in accordance with The City of Jacksonville's Manual of Specifications Standards and Design
(MS5D). A copy of this manual is available in the Public Services Department in Jacksonville City Hall.
29. Pavement Widths to be 31' B-B, except as noted.

31. All pavement markings are to be submitted and approved by City of Jacksonville before final painting on pavement.
32. Exterior lighting to be by the utility company, street lights shall be spaced 400-500 feet apart with a lumen output of
7000 - 10000 lumens.
33. Slopes 3:1 can be seeded, slopes 2:1 shall be sodded, slopes 1:1 require an Engineered Design.
34. It shall be unlawful for any person to make any excavation or do any other work which may cause a dangerous condition in or on
any street, alley, sidewalk, public way or public place in the city, unless a written permit therefor shall have been first obtained
from an officer of the city vested with authority to grant the same. No permit shall be issued in any case where a bond is required,
until a bond shall have been executed.
35. Sidewalk Turnout Areas To Meet ADA Requirements. Turnouts Should Occur Every 200' on a Proposed 4' Sidewalk.
36. Recreation fees to be paid in lieu of land dedication.
37. Driveway Limitations:
I. Minimum 12 feet.
2. No Direct access to Major or Minor Thoroughfares.
3. Access to Residential Collector. Lot(s) shall not have direct driveway access unless approved
by City Council. The streets need to be classified in order to ensure driveways aren't being
proposed where they require Council approval.
38. All proposed curb and gutter within the right of way will meet the MS5D's and match existing curb grade.
39. The stormwater facility that this development will feed into shall meet UDO standards in regards to
landscaping and fencing.
40. This project, including each lot, is subject to COJ's Stormwater Regulations.
41. Homeowner not to exceed BUA limit.

Contractor shall insure that he and all his workers (contractors,
subcontractors and other site personnel) do not damage construction
stakes or other measures used in laying out the project whether by
the Engineer or another entity including those under the employ of
the contractor. Contractor shall cause his workers to observe and
verify to the fullest extent practicable that stakes, other measures
and grades are, or appear to be, accurate and correct, and immediately,
but prior to any associated work, notify the staking entity of any
potential conflict, error or question regarding the work. The Engineer
