In response to your RAI, please see below.
1) Please see the attached agent authorization form. This was included in the original application.
2) The cutting and capping of the existing pipeline is within existing DENC easement. It will involve
minimal excavation to expose the existing pipe in order to cut and cap in place. Excavation activities
will not be conducted inside stream 005PS and there will be no impacts to the stream itself. BMPs are
proposed to protect the stream as either silt fencing or wattles. Impacts to wetland 006 will be minimal
and will consist of matting and access only. Please see the image below.

Katy,
On September 2, 2022, the Division of Water Resources (Division) received your application, with fee received October
27, 2022, requesting a 401 Water Quality Certification from the Division for the subject project. The Division has
determined that your application is incomplete and cannot be processed. The application is on -hold until all of the
following information is received:
1. Please provide an agent authorization form signed by a representative of Dominion Energy granting you
application signature authority. [15A NCAC 02H .0502(a)(11)]
2. Please provide additional details regarding the exact nature of the temporary impacts at 005PS and 006WL. It's
not clear what the impacts from cutting and capping the existing pipeline will entail. For instance, will stream
005PS be excavated as indicated in the impact table, or are the impacts associated with heavy equipment
access, or something else? Depending on the response, stream and wetland restoration details may be required
as well as dewatering methods for 005PS. [15A NCAC 02H .0502]
3. Please provide a copy of the Inadvertent Return Contingency Plan. [15A NCAC 02H .0506(b)(2) and (3)]
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide your response by December 2, 2022. If all of the requested
information is not received, the Division will be unable to approve the application and it will be denied as incomplete.
The denial of this project will necessitate reapplication to the Division for approval, including a complete application
package and appropriate fee.
