PROJECT DESCRIPTION: The project site is Iocated at 518 Twisted Oak Lane adjacent to the AIWW, near Sunset Beach, in Brunswick County. The site is approximately 1.27 acres and is vegetated with ornamental landscaping, oak trees, and manicured lawn grass, and coastal wetlands. There is an existing single family residence, concrete driveway, and pool on the upland portion of the property. To the south of the existing pool, there is a 6' tall metal fence running laterally across the property, following the transition area between uplands and wetlands. A few feet south of the fence, there is approximately 95' of shoreline as measured along normal high water (NH W). A large area of Coastal Wetlands extends 300' water -ward from the fence, along the entire width of the property. The coastal wetlands are comprised mostly of Smooth Cordgrass (Spartina alterntflora) and Black Needlerush (Juncus roemerianus). The waters of the AIW W are classified SA by the Division of Water Resources. This area is IS designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to construct a private docking facility for a total of three (3) slips. According to the application materials, the applicant is proposing to construct a new fixed pier that would be 436' long by 6' wide. The pier would extend from the high ground in a southerly direction, and would terminate on a proposed fixed covered platform (16' x 16'). On the waterward side of the proposed roof, the applicant plans to construct an open platform area (4'x 16'). Landward of the fixed covered platform, a proposed fixed finger pier (4' x 10') would extend to the east to a proposed gangway which would provide access to a proposed floating dock (8' x 16') that would be oriented parallel with the pier. The eastern side of the floating dock would serve as slip # 1. In between the western side of the proposed floating dock and the eastern side of the fixed platform, the applicant is proposing to construct a boat lift (11' x 10.5'), which would serve as slip #2. On the western side of the proposed fixed pier, the applicant is proposing to construct a 4'x4' `bumpout' platform, from which a proposed gangway would lead to a second proposed floating dock (20' x 8') serving as slip # 3, oriented in the same alignment as the access pier. According to the agent, the proposed floating dock and boat lifts would be located in water depths ranging from - 1.6' to -2. F @ NLW. The adjacent riparian property at 516 Twisted Oak Lane completed a survey of water depths (2015) for CAMA Major Permit 27-22. Some data points from that survey overlap the project area for 518 Twisted Oak Lane and those points indicate a range of approximately -0.77' to -1.35' across the project area. According to the work plan drawings, the applicant's proposal is located within their riparian corridor, and within 1/4 of the width of the waterbody, which measures approximately 588' across. The proposed docking facility would not encroach into either adjacent riparian corridor setbacks. The proposed features would be consistent with the USACE federal navigation channel setback. 10. ANTICIPATED IMPACTS The proposed docking facility would incorporate approximately 1283.5 sq. ft. of Estuarine Waters and Public Trust Area, shade approximately 1830 SF of Coastal Wetlands, and incorporate approximately 90 SF within the 30' Coastal Shoreline buffer as measured from NHW. The proposed docking facility would extend —135' into the waterbody (from the edge of marsh) which measures approximately 588 ft. across. This distance conforms to the pierhead line and 1/4 width. This area is designated as PNA, and the proposed slips would be located in water depths ranging from -1.6 to -2.1 at NLW according to the applicant. A new 6' x 436' pier will extend waterward and terminate in a 16' x 16' covered platform with a 4' x 16' finger pier on the landward side extending eastward a 4' x 4' finger pier extending westward and a 4' x 16' uncovered platform on the waterward end. From each of the finger piers will be an access ramp leading to floating docks, an 8' x 20' on the western side and a 8' x 16' on the eastern side on the covered platform. Located between the floating dock and platform on the eastern side will be a 101/2' x 11' boatlift. As proposed, both of the floating dock will be located up to but not encroaching into the adjacent Riparian Property Owner's 15' Riparian Corridor Setback Requirement Therefore, a waiver from the 15' Riparian Corridor Setback is not required. As proposed, this docking facility will create a 3-slip docking facility within water depths ranging from -19" to -2' @a NLW. The structures will not exceed the existing pier -head line nor encroach into the Federal Channel Setback of the AIWW. Box 16275 Wilmington, NC 28408 Dear Ms. Wilson: The Division of Coastal Management hereby acknowledges receipt of your application, acting as agent for Nikolaos and Tracy Gavrilis for State approval for development of the subject properly located at 518 Twisted Oak Lane, in Sunset Beach, Brunswick County. It was received as complete on November 8th, 2022 and appears to be adequate for processing at this time. The projected deadline for making a decision is January 22, 2023. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permit decision within 70 days from November 8th 2022, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or Federal agency.
